    I cannot thank Woods & Woods, LLP, for making and posting these videos. The information contained is invaluable to those in need of assistance in developing their claims for VA disabilities and TDIU. The clear and concise manner in which the information is conveyed is the most effective way to secure positive results. I hope all veterans suffering from ANY service-connected injury, whether physical, mental, or both, will watch these videos and take heed. Don't hesitate to call professionals, as well.

    Jan Dils is helping me right now. I'm at 50 percent in appeal for 70 or higher I need to be on TDIU. I am loosing control. I suffer from PTSD and MST. Took them 18 years to pay me after several denials.

    What if I own my own franchise. But my v.a shrink and therapist said that was the issue causing my problems. So I sold it. And seven years later I’m still suffering from mental and physical conditions.

    Sir I was totalling 70% combined rating with 30% flat feet, 30% depression, 10% lumbar spine, 10% left knee and 10% right knee when I filed for tdiu in January..today I checked my ebenefits online and saw that my combined rating is increased to 80%...70% for depression, 10% flat feet, 10% left knee, 10% right knee, 20% lumber spine, the decision letter is in the mail tho..so my question is do you think my tdiu is granted and is it possible to verify that online. Thank you

      I am currently 70% for ptsd and applied for TDIU on my own. My C&P exam is two days away. I'll see how the VA responds. If they approve TDIU I'm good. If not, I can still get a lawyer involved, but why sacrifice cash to a lawyer before you've tried on your own? Either way, if a lawyer gets me a win down the road, the bigger my check is going to be and it won't hurt as much to pay the lawyer. But if I get TDIU sooner than later by waiting to see what happens before hiring a lawyer, I keep all the money.

      First make sure that it’s in your medical records that your PTSD affects you socially and occupationally to the point that it’s hard for you to work and to be around people. Then file for TDIU based on your current diagnosis of PTSD. You don’t need a lawyer. You just have to make sure that your medical records reflect the facts for the claim you want.

      @@chino2037 That's right. My C&P exam for PTSD established my social and work issues, and I had never heard of TDIU until the VA sent my letter saying I was 70% PTSD and I may be eligible for TDIU. I researched TDIU and as soon as I understood what it was, I submitted my TDIU claim. I'm just two days away from my TDIU C&P appointment. I suppose they're going to ask questions about how my disability prevents me from working gainful employment. Man, do I have a lot to say about that. I feel good about my claim so far. If it is approved, it will essentially double my disability compensation. We'll see what happens.

    If I have a 70% for mental health and a 90% overall do I have a decent chance of convincing them?

      You have a great chance because the symptoms that goes into the 70% rating impairs your ability to keep a job. To give you a 70% rating they have already looked at your work history

      Yes, because 70% is almost the same symptoms of the 100%. I just file a claim for TDIU because my company removed me from Federal Service for reason: Not Medically Fit for Duty because of my service connected PTSD. I have 70% PTSD with a total of 80% disability rating. Just got done with the VES C&P Exam this Wed via doxy Video.

    I know this was posted a year ago, but i have really bad issues they grouped my "issues" as massive depressive disorder and they wont give me anything above a 70% for everything. I have nightmares to the point i actually hit my wife in her sleep and i told them that and they just kind of brush it off its difficult to even get help from them at this point

    I have 70% ptsd & recently stabbed myself in the chest with a knife - causing heart & lung issues. Would that be enough for 100% tdiu?

      A 70% rating for PTSD meets the rating criteria for TDIU, if that condition also prevents you from maintaining substantially gainful employment.

    Cant you be awarded 70% & TDIU off your initial claim if the C&P exam & other evidence shows qualification or are you saying you never get TDIU from initial claim and you always have to apply for it after your initial rating?

      It is not possible to receive a rating of 70% and TDIU. The VA will rate you with one of the other. Inferred TIDU is when you don't claim/apply for TDIU. but the evidence you submit makes the VA infer that it is the case. Many veterans will file the IU application and might get an IU award right away. But they don't realize they might have had five years of back pay from and inferred claim still open when they filed the application.

      @@woodslawyers ok so if I’m understanding correctly, submit initial fully dev claim, va reviews all evidence, schedules C&P exam and determines disability % if any as well as tdiu or SMC’s. If it comes back as just the disability % level, you can then apply for tdiu. That sound roughly correct?

    my ptsd is at 30% do I have to get the ptsd up to 50% to get TDIU ??

      You have to have one disability at 60% OR have two disabilities with a combined rating of 70% of which one has to be rated at 40%.

    Occupational Assessment (OA)? Didn't hear a thing about that.......Medical evidence is one thing, the OA is the Nexus between Medical and not being able to work due to PTSD and related issues. Medical experts typically have no clue how the workplace works, how to get and keep a job, though their inputs can add to these issues.
    A typical OA Conclusion:
    This evaluation was completed utilizing the peer reviewed, and RAPEL methodology. This evaluation has been completed within industry standards. Unless otherwise noted, or where assumptions are stated, all opinions expressed herein are provided within a reasonable degree of vocational and rehabilitation certainty.
    This individual's post-traumatic stress disorder and tinnitus with residual emotional,
    cognitive, and physical impairments presents a severe impact on his ability to obtain and
    maintain employment.
    Based on the results of the Vocational Evaluation performed on him as well as his retirement age, high school with some college education, and past experience of skilled work as an IT Specialist/Contracting Program Manager, the following are my opinions, as a Vocational Expert, regarding Mr. Veteran’s employability:
    1. Mr. Veteran is unable to perform his past work as an IT Specialist/Contracting
    Program Manager on a sustained, full-time, competitive basis.
    Employability Evaluation on Mr. Veteran. June 6, 2022
    2. Mr. Veteran’s past relevant work as an IT Specialist/Contracting Program
    Manager is considered skilled work, but due to his severely reduced vocational capacity
    resultant of his severe service-connected psychiatric and physical impairments, he is unable to transfer his skills to other types of jobs.
    3. Mr. Veteran is unable to perform any Sedentary, Light, Medium, Heavy, or Very
    Heavy Work existing in the local or national economy on a sustained, full-time, regular,
    competitive basis due to the residuals of his service-connected post-traumatic stress disorder and tinnitus.
    4. Mr. Veteran is unemployable for any job existing in the competitive labor
    market due to his severely reduced emotional and physical functional capacity.
    5. I have reviewed Mr. Veteran’s medical records, conducted a standardized
    vocational interview, assessed his mental and physical functional capacity, conducted a
    transferability skills analysis based on his current vocational profile, and conducted a Labor
    Market Research Survey in the xxx County, Texas area where the unemployment rate was 3.1 % in March 2022. In my expert opinion, Mr. Veteran has sustained Total Disability Individual Unemployability as defined by the ’s Administration. In my opinion, as a Vocational Expert with 49 years of experience, there are no full-time jobs Mr. Veteran can perform in the local or national labor market on a sustained, regular, competitive basis due to his service-connected emotional, cognitive, and physical impairments.

    I am serve connected for PTSD due to MST with numerous other mental illnesses. Can you cover how ADHD and Bipolar disorder were potentially preexisting and aggravated by military service and co-exist with PTSD? Is it worth filing for ADHD and Bipolar disorder if you are at 70% PTSD rating 30% Migraines?

    Can you lose your TDIU if your spouse files married filing Jointly on their tax returns?

      TDIU benefits are not income based, so your spouse filing jointly will not affect your eligibility for TDIU. TDIU benefits are also not taxed.

      How about a former supervisor or the human resources department of a previous employer? If those options are not available to you, a combination of opinions from doctors and vocational experts should do the trick.

      If your only VA disability rating is for mental health, a 70% rating would be required to meet the criteria for TDIU. Veterans rated at 70% for mental health experience significant occupational and social impairment. However, if you have ratings for other conditions like diabetes, musculoskeletal problems, hearing loss, etc. in addition to a mental health rating, you may not need a mental health rating as high as 70% in order to qualify for TDIU. Veterans with multiple ratings can meet TDIU criteria with a combined rating of 70%, where at least one condition is rated at 40%. Here's some additional information about that: bit.ly/3p9nrcO

    these people are giving sound advice for people who really are suffering. please dont use this to get something you should not really have. if you seriously are suffering (i mean really do suffer) then go for it. dont exaggerate your illness or symptoms just so you can be lazy when your mental health does not effect you as bad as some others do.if i could i would go back to 70% va for my schizophrenia. i would make more money working that way. from my 70% va, 70% military retirement and whatever i could make from working.
