    The fact that the hospital used the billing code for CRPS while saying it was factitious is how they will lose this case

      I doubt that would be the case… they also listed a few other diagnoses as well.. this is not unusual as CRPS was a working diagnosis and they are not billed by diagnosis but by treatment received… CRPS would be on the diagnosis list until officially ruled out…

      @@Allthekingshorses2 I think that is the issue. The hospital are accusing the mother for making up this diagnosis and initiated a chain of events that caused harm to the family through CPS. I believe the hospital did not do their due diligence to rule out CRPS in a reasonable time frame and because of this I believe they are liable.
      Sometimes we have to weigh the risk of harm just incase their suspicion was wrong. She was there for 3 months without a resolution. Simply allowing the mother supervised visitation would reduce the risk of harm to the child and the hospital could continue their investigation.

      But, her social worker testified she was trying to put Maya in a Psychiatric facility that specializes in pain , and her Mother "partly refused"...how would the hospital make money if they sent Maya to another hospital? Why were they video taping the child? To prove she could not walk?

      @@Allthekingshorses2 I’ve been in the medial billing field for 30 years ! The DX code is what determines the benefits and if the service
      is covered !!! Without Dx codes the claim would be denied as not medically necessary ! The treating physician who is treating pt is the one who needs to provide the DX if that was the CPS Dr who was employed by Hopkins and the one who was convinced mom was making her sick even more fraud and abuse ! Even if there were 12 dx codes on the claim! It doesnt matter! One of the dx codes would be the primary DX ! Aetna is suing the hospital ! So the claim was fraudulent ! They r a disgrace the CPS Dr who worked for the hospital ! and the hospital ! Also u dont put a dx of crps if it’s not crps u dont code with a dx that the patient doesn’t have it doesn’t work that way ! u code with list symptoms and disease comditions. CRPS is not a symptom it is a disease! u cant put a dx code on a claim if u dont think Maya has it ! Thats Medical billing Fraud !Which means the claim was filed with Crps diagnoses all the while claiming she was fine !! until it was time for them to be paid 450k from Aetna!

    EVEN IF they suspected the mother was causing the pain, everything was based on an assumption, they had absolutely no proof. They already had all the documentation from the other doctors for the treatment. They took a sick child away from a mother who knew what she was doing, was not even allowed to say goodbye or give her daughter a hug. It is beyond shocking what this woman went through emotionally and psihologically, the amount of fear she felt for her daughter's health and the humiliation she was subjected to by everyone. Her final action was her sacrifice that saved her daughter. Another slap in the face was then allowing the sick child to attend the mom's funeral but NOT allow her to hug her mom when she was asking for visits. I hope these people get what they deserve

      This needs to stop. The hospital actually charged the insurance for treatment for the exact illness they claimed Maya didnt have and that the mother made up. They sent her mom for a psychological evaluation and she was found to be fine except that she was suffering from being separated from her daughter. This happens all the time to thousands of parents all over the country. And this needs to stop.

    The judge who denied a simple hug to Maya and Beata the day before Beata killed herself should be disbarred. Among all the despicable and cruel things that happened to the Kowalskis, that was the worst.

      Yup that was shocking on the doco. I watched every minute of the trial and what a disgrace every person who was involved. The only decent person who got up on the stand was the physiotherapist, she never judged Beata and even said she was a good mother, she left Johnsdropkids pretty quickly, wonder why that was.

    Beata was a highly qualified nurse with a PhD. I think her intimate knowledge of Maya's medical condition invoked jealousy among the hospital staff and the ball started rolling from there. This hospital should be closed down the physicians have their licenses revoked and Cathi Bedi sacked from social work as she was arrested in the past for child abuse and this was her second round of torture as far as we are aware. These miscreants drove Beata to hang herself as she received no support only wrongful judgement. The hospital even interfered in her marriage not only her daughter's illness.

      I second this theory. So called "professionals" in the field undermine well versed family voice and advocacy as they think, "Who are you to know all of this than me?" Add on for Beata being one of them with credentials and knowledge higher than them, egos triggered to a tee. I've tasted this wrath upon me a number of times.

      The hospital wanted to settle the case to a much lesser sum of money I think around 30 million, so the family decided to take it to trail, and I don't think it's about the money for this family.

    They used the phone to test her pain?! Omg. I had known about the toilet, but not the phone. That's just fkn SICK! Knowing what they done (ripped a sick child from her family, and then taunted her calling her themselves, very likely making her believe her family may be calling. Im so glad she won 260+ million dollars! These people responsibilie need to be locked up!

    Maya definitely experienced child abuse. Not by the parents though, but by the hospital and its staff. The one place where children deserve to be treated with understanding and compassion and to receive the highest quality healthcare while comforting the loving parents who lovingly, and with not one complaint, carry their children's pain. This hospital not only killed Maya's mum, they destroyed that whole family's spirit. God, please let justice take place.

I don't believe that those Jurors have much choice options given the Specifics from the judge order on the final paper work for the Jurors basically they will side with JHH because of the jury His instructions that's called check mate.     I hear a lot of commentators saying the hospital did no harm to Maya or her family, yet if they had someone diagnosed with CRPS they would not be so quick to say there was no harm done. I suffer from this disease which was call RSD at the time and I can tell you that there are many professionals in the medical field have and continue to cause harm to us, weather it be medically or psychological.

      Yes. Completely destroyed. I can’t begin to imagine. Nothing can ever be the same for them, ever. It makes me feel guilty/lucky that nothing like that happened to me as a child bc my family was like theirs- happy, loving, caring, close. This case is almost more infuriating than sad.     That hospital, and its entire staff need to be brought down. Worse than Lucy Letby's hospital,
    The Drs don't care at all over her . They don't respect a diagnosis from a fellow practitioner, but worse, they expect patients and their families to just snap out of the diagnosis and treatment that worked, that they were given by a legitimate doctor. Very ironic that they consider it psychosis to believe the doctor.
    Same thing happened to me, i was yelled at when I politely asked why the other Dr told me something else. I was confused!
    He said THERE IS ONE THING NOT IN QUESTION HERE ! IT'S MY KNOWLEDGE! DO YOU UNDERSTAND?!
    I cowered. Sounds like these Drs are all on huge ego trips. God complex.
    And the patient is the victim of this bullying!
    This refusal to treat pain has to stop! Bullying this young girl is unconscionable! It's actually child abuse by John Hopkins All Children's medical.

      Unfortunately doctors, nurses, and social workers of this type are their own epidemic sadly.
      I believe that rather than places shutting down, the hiring and vetting processes for these lines of work need a huge overhauling and possibly some type of assessment for controlling and ab*sive traits if possible.
      I’m so sorry about what you’ve been through and I’ve gone through very similar experiences myself as well.
      In many professions, but even moreso medicine, there’s no one above them to supervise or fire if issues occur, etc. and they’re overly protected by hospitals, etc.
      These situations are so infuriating and also terrifying to me being that I am always trying to navigate around them to avoid these types of providers as much as possible but it’s not always possible.
      And then not everyone who doesn’t have chronic care requirements always understands so it’s isolating, too.

    Am I correct here...Maya was released from the hospital quickly after she killed herself? So her mom died for her. Because in the beginning I thought how selfish of mom...stay strong. But she knew as soon as she was gone that baby could go home. But she didn't want to live without her. This case is so messed up.

      yes she killed herself to get Maya out of the hospital she was even going to get a legal separation from husband so she could come home but that didn’t work out attorney said not to do that . she killed herself so they would let her come home she thought she was running out of time her treating dr not out of hopkins said maya would did iff left untreated

The dr did tell her “Maya will die if u dont get her out of there” Unfortunately she made the ultimate sacrifice but in the end devastated her family and forever changed them !

      ​@@deborah3912 Actually Jack explained that. Separation was an idea to get Maya out. But it was squashed by an attorney because Beata would be cut off from BOTH of her children. Not only from Maya but her son too...
      Being falsely accused of harming your child, awarness and helplessness that her child suffers, inability to even personally check if daughter is taken care of, not being heard... Anyone would loose their emotional balance. So to put it down to just "well, she was mentally unstable"... It's not that simple case...

    The entire system failed as there was no proof, just suspicions. They even ignored the MD who had diagnosed her with the pain complex in the first place. And Dr. Sally Smith needs to have significant penalties levied against her for malpractice. The social worker needs to lose her ability to practice as she has hurt too many families.

      @@aClownBaby- I had a situation where I was done so wrong by a doctor while giving birth to my second son. I literally had to go to therapy after for it, she traumatized me so bad. I tried to sue and at least get her to pay for the damages she did to my physical body and I was written a note by the hospital for apologizing but said she did nothing wrong. I spoke with lawyers and they said they can't because it's nearly impossible to sue the doctors or the hospital.

      I disagree. Hospitals should record everyone and should save the recording off-site so it can be review and not tampered-with. I don't expect privacy in a hospital. I'd rather have a record of what's being done to me. I don't care if my junk is being recorded, doctors are literally paid to look at people's junk.

    This reminds me of the case of the girl whose mother was making her sick but that’s cruel to move things away from her to test their theory. You are a hospital not a court, don’t worry about the intentions of people and don’t try to prove them all wrong and use a child to do this. If that was my child I would be mad as hell if she tripped or fell getting to those things because they decided to TRICK her and move it away.

    The child being recorded is violation of the child’s privacy! Children are HUMAN too and are entitled to privacy! Especially, with all the child pornography being produced from situations like this! How do they know that the person monitoring her was not a sicko a recording this child undressing and changing clothes! This hospital and violated so many ethical and privacy protocols/laws!

    Cps in Kentucky took my child away for 9 months claiming i was making my sick. For 9 months they took him to several doctors/specialists that informed them of my child's conditions that were in fact real and i never recieved an apology. Filed a lawsuit but dropped it in the early stages after several threats to take my child again.

      The answer to that is another question: why would the hospital charge half a million dollar to the family insurance for “complex regional syndrome” if their argument was that Maya didn’t had that condition (and called child protective services)

      They tried to have her transferred to another hospital at one point, but the mom said no because the other hospital refused to use the ketamine treatment that the mom wanted. The treatment had a 50% chance of death. The mom had

This is NOT someone with a good maternal instinct. The only reason I’m happy they won their case is for Kyle

    This is the problem with Dr and health care workers towards people who have chronic illness and disabilities that are invisible. Just like mayas. I have chronic illness too and i battle with these same issues

    I pray that Maia wins her case she got treated terribly. My prayers for Mýa. I can’t believe this happened at Tampa General. My prayers go out to the dad and Maya for the loss of their mother because she couldn’t handle. It’s so heartbreaking to see if she was treated like this in the hospital.

    I have amplifier muscular skeletal pain syndrome. Its just below CPRS. i got told for years i was fine, i wasn't in pain, one dr said it was "growing pains" i turned 25 when i FINALLY saw a pain specialist who listened to me, ran tests and said i have AMPS.
    Luckily the hospitals near me in Australia are pretty good, since my diagnosis, they read my file and treat me according to my specialist requests. Im 29 now and i have good days and bad days. Some days i seem perfectly fine, others im in so much pain i want to kill myself.
    I aleo have PoTS its a heart condition. I got told for years its just anxiety (because i suffer major depressive disorder and CPTSD) until i ended up in hospital with a heart of 200BPM and a blood pressure of 70/50. The ER dr took one look at my EEG and symptoms and came to the conclusion then sent me to a cardiologist and I got the formal diagnosis.
    I never had as horrific and inexcusable treatment as this poor girl. But i know what its like being told youre faking it and youre "perfectly fine" i hope the hospital get bled dry and reputation is fucked for life!

      I have cervical myelopathy from a spinal cord injury. It caused a cascade of complex symptoms. I fall under the dysautonomia umbrella and also have postural orthostatic tachycardia.
      I know exactly what you're explaining.
      I have anxiety BECAUSE of the effects of the injury and how horrible the medical system is.
      SO many "professionals" pretend they know so much .... when in fact they are truly ignorant about the way the body functions outside of their little subspecialties.
      And if you're a female ... they will blame everything on hormones (even after they've tested all hormone levels)...even if you insist this has nothing to do with hormones. If they don't understand something.... they won't and can't admit it.
      There is too much ego in medicine. The professionals need to start to admit when they don't know it all. It's giving complex patients medical PTSD.

      I also have PoTS. It is a form of dysautonomia (disorder of the autonomic nervous system), not a heart condition. It does affect the heart rate, but there is nothing wrong with the heart itself.

    Well the way society is headed I think soon cameras will be insisted on constantly that nurse that killed all those newborns people are furious there were no cameras in the nursery and yes how odd when they want to accuse the patient of self inflicted wounds there is no evidence so it's just selective recording. Everyone needs a nanny cam maybe it would deter some problems just like all cops should have body cameras maybe doctors and nurses should so proper context is given in court.

      Yes that’s likely. The plaintiff had some actual evidence of abuse but they didn’t bother to show it. They just invented other abuse that wasn’t documented. Definitely.

    Why am i not surprising this happened at TAMPA GENERAL... they killed my father by severing his spinal coard during exploritory surgery. He was left paralyzed from the waist down and put on dialysis . He only lived for 2 more years and his heart was FINE!..😢😢😢

    Johns Hopkins All Children’s Hospital - i think its important to keep naming the perp rather than say "the Hospital"

    Their Lawyer keeps slurring his words, is slow to ask questions, and um's and ah's, uhh a lot. I'm not sure he's really conveying how the hospital refused to listen to the medical history, past medical treatments and immediately jumped to the conclusion of abuse, making it up despite ample medical history proving she'd been suffering from this condition for years. That they have a genuinely sick girl who they spent three months trying to prove she was faking this at the force of her mother. Just ludicrous. I hope the Jury is seeing this. The lawyer should also be grilling the doctors involved. Did you speak to the previous doctor? Did you see the history of treatments trialled before Mexico which had no result? Are you a mother? Do you have children? If your child had a history of chronic illness, where after years of trying different treatments you finally got a result, when relapse occurred, would you not want doctors to listen to you? Would you not be doing everything in your power as a mother to try resolve her chronic pain.

They didnt care about the child or the truth ! They went on unsubstainted suspicion and disregarded the proof of this child’s disease from her treating physicians ! The hospital was careless reckless disregard of the truth and falsity of the information ! The mother knew more than any dr nurse or staff at that hospital and they treated her like a criminal because they didn’t like her !
