    A couple of years ago it came out an ex of mine had been knowingly living with HIV for 10 years, Id been in a 3 year relationship with him during this and he told me his medication and hospital appointments were because of a kidney problem he'd had all his life, I had no reason to not trust him. I found out eventually after we'd broken up when another ex of his from years ago had actually died from an illness caused by HIV and her only sexual partner had been my ex.
    About 6 of us were at risk of having HIV and all had to be tested, 4 out of the 6 had it. He wasn't charged because he was given a plea of mental illness, instead he has a social worker visit him and he's not allowed to have sex with anyone else without telling them. Meanwhile one woman is dead and 4 others have had their lives changed forever. It's disgusting that it isn't treat as the crime it is.
    Someone who has a knife isn't dangerous and shouldn't be treat like a criminal, but if they stab someone, then yes, they're a criminal.
    I sincerely hope the bill is retracted because it's horrendous that this is now giving more people the power to take revenge on exes or other people if they have HIV. It should carry a murder charge if that person dies from it.

    I'm not a Republican but the new HIV bill is not right... I understand they you CAN live healthy with HIV but the fact that you are potentially putting a person in such a bad place physically and socially knowingly, I think it should be a felony.

      I think they were forced to release it this time, because there were too many witnesses with cameras rolling during this for them to try and pretend or cover it up. But yeah, more often than not, especially in scenarios with no outside witness or camera footage, we often hear that the body cam was "malfunctioning" or "not turned on".

      Not at all what Arun was saying. They were criticizing the fact that many times when a police officer commits a crime, the police try and claim the body cam was "broken" or the footage was "lost" or the "body cam wasnt on". That is what they were criticizing. The consistent cover ups perpetrated by the police for their own. Many of the videos catching police abuse towards anyone of any race has often been cell phone footage or security camera footage and not bodycam footage. But I also dont think they were writing off any good incidents where the body cams showed police abuse of power. Merely criticizing how rare it is for the body cam to be of any use to the public because of constant cover ups.

      I don't know. I've seen a fair amount of body cam footage for various incidents. I'm for body cams, but I think they're more likely to exonerate the officers than convict them. You just never see the times the police did nothing wrong, because it doesn't hit national news.

    I agree that people should not be persecuted for simply having HIV, that they should not have to live closeted lives and that educating people on it is a good way to end the stigma. But if any person INTENTIONALLY gives HIV or any other life threatening illness to another then they deserve way more than a slap on the wrist.

    My best friend was infected with HIV a year ago by someone who withheld that info from him before hand. Now he has to take daily meds that cost $1500 a month for the rest of his life. The meds give him horrible side effects such as overall just feeling like shit. And now he has to do what that individual did not, and explain to anyone he might date that he's infected with HIV. Its ruined his life & all the money he earns goes to treatment & medication. Its a horrible cycle to watch.

    As a democrat I’m so upset about the HIV story. I have several chronic illnesses and have a very weak immune system. If I were to have sex with someone HIV positive I would almost definitely die from it. I understand if you don’t know, which is why I’d make partners get tested (I would also get tested). I understand that the stigma around HIV needs to end and that there are some treatments available, but seriously fuck California.

      You are missing a lot here. The old law wasn't just targeting people like Phil mentioned who were actively infecting others but was routinely used to prosecute ANYONE with HIV who might have transmitted it to others regardless of how the transmission occurred or if the person even knew they were infected. A person who didn't know they were positive and infected someone, a person who knew, disclosed, and accidentally infected someone (like a condom accidentally breaking), and someone intentionally infecting someone were open to prosecution and treated the same. The criminalization also made people at risk less likely to get tested and could significantly impact their ability to find a job.

      Katpocalypse Meow I've not heard most of those arguments, in fact from what I read the problems with the law were the one you stated at the end (dumbest argument ever because it assumes people will get tested just cause the punishment isn't as bad) and the fact that you can convict someone who hasn't actually infected someone but had the intent to (another no shit). I did think what you were saying could be an issue but I haven't seen any evidence of that. There did seem to be some problems but they should have fixed it. As liberal in CA this has got to be one of the stupidest things signed because it does nothing to address the problem

      Except they didn't simply correct for a simple unintended accident. They made knowingly and intentionally and infecting someone a trip to jail for a few months.
      I'll admit a simple accident shouldn't recieve the same penalty as intentional though. Possibly having to pay medical bills or treatment costs. Lawsuit stuff. But an intentional infection should in no way be lightened.
      I am so tired of these politicians and their lazy legislation. It would have been so simple to split the two up and clarify the differences. Instead it's, "Let's just do away with it all. It'll be fine."

      The whole situation is misunderstood. This is not about giving criminals a free pass, it's about destigmatizing people with HIV who take all neccessary precautions and therefore can't possibly transmit a disease (at least that's what is being argued, I don't know what exactly the truth is).

    For once I have to side with the Republicans on the HIV issue. If you are INTENTIONALLY infecting someone with any kind of communicable disease then, yeah, you very much should be punished severely for screwing up someone's life and possibly giving them a death sentence.

If they're taking medication they know they have it, and they know they're risking infecting someone (although it can be untransmittable and undetectable, so sexually a person may be safe). Basically, they can't claim ignorance if they're taking treatments

    I'm with Phil on the HIV issue. It's attempted murder. Biological warfare. It's all about the foreknowledge. HIV should be better understood as the SDT that it is, and stigmatizing victims is not acceptable, but knowingly infecting someone with a deadly virus is as serious as purposefully poisoning them. I just feel that it should be the focus of the Judiciary to better define the burden of proof of intent. Just like a sexual assault, there should be a mutual consent between partners otherwise anything else would be considered a violation. Let's not forget that not everyone is effectively treated for HIV or AIDS. For those unfortunate folks, it's a death sentence.

      Riske Worldstage not just for those who are under treated. There is such a thing as drug resistant HIV where none of the drugs will work and don't forget that the medications used to treat HIV can be life threatening themselves. There are the very unlucky who cannot tolerate any of these medications. It really irritates me when people say things like "it's not a death sentence anymore so what's the big deal". The human and financial cost is tremendous.

      So what if there is medicine for it? It does not cure it, even if you take the medicine eveyday it brings a lot of problems with it. The medicine damages your health in other ways, shortaning your life, it changes your life style, etc. And that's assuming you even get the access to the medicine. After all it's not free. The treatment can cost from $1000 to $3000 MONTHLY, how many people can you expect ot actully afford that?

    I have worked for a number of high profile artists (musicians, actors, film writers, directors) and there is so much that never becomes public knowledge for a number of reasons (hotel "meetings" and "auditions", confidentiality agreements, threats of black balling). Abuse by those in positions of authority and power is such common place behavior that for many years this sadly has become accepted as part of the industry. What is happening with Weinstein is disgusting but not surprising. In regards, to Affleck...there have been rumors about his behavior for many years. Even some that these issues were the cause of Jennifer leaving him. So for Affleck to make the sympathetic statement came as a shock to many and I, too, am glad he is getting exposed and hope others come forward. It is gut wrenching to see so many women (and men) that have suffered through these abuses, but I am thankful that all these victims are coming forward because I believe this will not only benefit the entertainment industry, but other professionals where this type of behavior is prevalent (law, military, religious ministry). People that are in positions of power and control, particularly in an employment situation, have an extremely unfair advantage because when your livelihood or family's livelihood depends on these jobs, sometimes people feel they have no choice. It is a horrible, helpless position to be in and this needs to STOP. This country has made many advances in dealing with work-place harassment, but there is still much progress to be made. My hope is this sad situation will result in healing for the victims and appropriate repercussions for the perpetrators.

      Don't get me wrong, their behavior is worse than terrible, but most of these "jobs" are luxury jobs as far as I'm concerned. Artist is a cool ass gig, I get it......but 2000 years ago and there was only a handful of "Professional Artists" and a lot of art, to my knowledge, was just average ass people doing art in their free time. A lot of these art jobs are just......well......not needed by society :/
      These industries have always been like this to my knowledge. People made jokes about sucking dick WAAAAAY before this story broke. We ALL deep down know about the "cost" to be famous, and it's very real. As sick as I find these people, majority of their jobs are "honest hard working professions" so I really don't care too much about all this stuff. If sick people wanna get together and be sick in some industry that society doesn't REALLY need, then hey, who am I to judge ;)

    I'm currently in college in Southern California, but I am originally from Sonoma Valley, and the fires have been absolutely devastating to my town and much of the surroundings. I know several people whose houses burned down, or even their entire neighborhoods gone. My parents were forced to evacuate from my home in the hills just the other night. They were sending me videos of ash raining down from the sky and fires along the hill crests looking like something straight out of hell. However, the continuing support has been incredible, and it has been amazing to see such a small town all coming together as a community and helping out one another. My heart goes out to everyone effected #SonomaStrong

    There is a difference between not knowing that you're HIV positive and unkowingly passing it on and knowing that you are and doing it anyway. It's a life sentence for people medications or not. It can affect them when it comes to finding partners, having children. It should be destigmatised and not be something to be ashamed of saying to a potential partner as they have the right not to shell out for meds etc . I cannot get behind this bill if the word intentionally is in it. It is essentially an assault. Yet, instead of broken bones which can heal eventually, this will never go away. Let alone that it can cause AIDs which nothing can be done for. I hope anyone who participates in this "misdemeaner" finds a place in hell for it is incredibly cruel.

    Thanks for covering the California North Bay fires and sending us love! I live in Santa Rosa, and evacuated Monday morning at 3 am. There was a tower of flame dozens of feet high a mile from my house. I have never been so scared. My family and fur babies are safe. I’m so lucky I didn’t lose my house. Half of our city is in an evacuation zone, and so many people I personally know have literally lost everything. I’m numb and can’t believe that this is happening here. It’s so weird to be “that town on the news with that horrible disaster”.

    I'm confused on how "well we can treat it now" makes the passing of HIV okay. That's a lifetime of expensive medication for a condition that was forced on them by another person. I'm all for de-stigmatizing STIs , but lessening the punishment for,intentionally ,changing someone's life forever and putting their health at a severe risk is ridiculous.     I am so baffled at the bill passed in my state of California, especially when you have politicians who know nothing of the virus. HIV is unlike any virus, you require constant treatment of Standard antiretroviral therapy(ARTs) which are multiple cocktails of drugs taken at once. The reason you need this is because HIV mutates at a ridiculous rate and it take multiple drugs to ensure HIV does not have the ability to multiply and mutate which could lead to immunity to the medication.
    Aside from the fact that you need to be on medication *for the rest of your life* which is extremely expensive and can cause complications to your immune system(Since HIV attacks your immune system). It also has many side effects, while drugs have improved over time and side effects are being lessened over time, you still can have massive reactions. Such as liver damage which can occur over time since you are taking so many different medications(dependent on the strain you may have) which are usually toxic to the liver.
    I am a liberal but I'm also a biologist and a med school student and this virus isn't something that should be taken lightly. How is such a short sentence possible knowing the fact that someone will can knowingly infect someone with a virus that can cause so many complications and alter someones life.

      I think part of it is that the severe punishments disproportionately affected minorities kind of like how you are way worse off being caught with crack cocaine instead of powder cocaine: black people are more likely to use crack cocaine and white people are more likely to use powder cocaine. I agree that it seems like it is harder to punish scumbags who try to infect as many people as possible, but I also think those people are rather rare

      Bodycams for all, get your own personal bodycam as a citizen too, they're getting cheap now. This incident is one of those times in which police bodycams didn't "happen to malfunction", probably because there's hospital cameras and multiple witnesses which would make things look worse if they did.

    Joel Anderson's thoughts perfectly sum up my own on SB-239. Except there's one more issue. Donations. This law not only applies to sex, but blood donating. People could potentially be on the receiving end of that tainted blood and be infected without even ever meeting the infected person. Granted, it would still have to slip through the cracks, but the fact that it wouldn't even land the culprit a year at max... That flat out baffles me.

      What's sad is you misinterpreting the host's statement to try to divide men and women. The vast majority of the victims of this abuse are women, that's just how it is. But it can and does happen to men, and we want justice for *all* victims. Props to Terry Crews for speaking out.

      Disgusting, I absolutely agree on. No remorse... I honestly don't know. There literally are no words you can say to make anyone believe you regret something this abhorent. It is very much possible that his apologies are all just for the press, to take some of the steam off him, but to me it seems just as likely that he does see that he has a problem and does try to better himself.
      Not that that should matter. He still needs to be punished for all the disgusting things he did, but I really don't like how everyone is calling "fake apologies", when there is literally no way of telling apart fake and real apologies based on written words alone.

    Yeah, I can understand their point of view on the whole HIV thing in California, but the execution of their plans is... fucking awful. Knowingly infecting someone with a disease, no matter what it is, should be way more than a misdemeanor. That's arguably worse than giving someone a beatdown in many cases.

    On HIV specifically the argument that since HIV affects LGBT and minorities more that this law is now somehow less discriminatory. That's complete BS. Just because a virus is more common in certain groups doesn't mean that laws around that are discrimination against those groups. Especially when this isn't punishing people for having the virus, it's for intentionally spreading it. Disproportion in who it affects does not mean there is discrimination.

    Regarding the blood draw incident; if you want to rebuild trust with the public, _this is the way to do it._ If this kind of accountability happened more often, there would not be _nearly_ as big a rift between police and civilians as there is now. Chief Brown, you have my respect and thanks. Hopefully more chiefs will follow your lead.

    With the more that comes out with this Weinstein situation, the more disgusted I am. The saddest part is that this is pretty much par for the course in Hollywood. Young, desperate actresses (as well as some actors) are constantly taken advantage of by the executives and producers who hold all the power.

    it would be awesome if some day this week you could speak about the 3yo special needs girl that went missing in Richardson TX this past weekend when her dad made her stay outside because she wouldn’t drink her milk. she still hasn’t been found and maybe if the most eyes possible see this story she may have a better chance of being found, although some people think her father might have had foul play and its a cover up. i would love to see you investigate this.

      I live close to Richardson and it is heartbreaking to hear about this. Given the negligence of the guardians of this girl the police definitely find it odd and are investigating. I feel like it could be a huge help if you covered this ongoing development. People in Dallas county are rightfully confused as to how someone could let this happen to a child.

    Hey Phil, love your show. I just wanted to let you know about a fire that happened in the gorge scenic area on the 2nd of September and grew to almost 35000 acres at its peak in only 3 days. It only evacuated the small town of Cascade Locks and threatened the towns of Hood River, Odell, and Parkdale, but it was still a large fire that hurt a lot of the wilderness and trails and natural beauty that makes the gore famous. The fire trapped 140 hikers on the eagle creek trail and they had to stay overnight at Punchbowl falls before starting a 14 mile hike to a safe exit point. It was caused by a high school kid lighting off FIREWORKS down the canyon IN THE DRYEST TIME OF THE YEAR. AND THEN A COUPLE DAYS LATER ANOTHER KID STARTED ANOTHER FIRE WITH MORE FIREWORKS MUCH CLOSER TO THE TOWN OF HOOD RIVER, ON INDIAN CREEK. I would appreciate it if you could tell your audience about the importance of not doing stupid fucking shit like lighting fireworks off in the forest but also about being prepared when hiking. The trapped hikers were able to have fresh water from one person being super over prepared and having water purifying tablets so they didnt have liquid shits from drinking creek water. You have a large audience and letting people know how important it is to be prepared would help be feel better about the security of forests and the wild all around the world, thanks.

    I live in the Bay Area and the fires have been really bad up here. I live a decent distance from Santa Rosa, but the smoke has travelled throughout pretty much the entire Bay Area. There's smoke everywhere, and a lot of it. At first I actually thought it was fog. I first noticed this 2 days ago, and it's still happening. The smell is really strong too. At first it smelt like a camp fire which was actually quite nice, it wasn't too strong. But as time went on, I noticed my backyard filling with smoke, and the sent becoming a lot more pungent. It got to the point where I actually thought there was a fire in my neighborhood because the smell was so strong. And we have it easy where I am. My dad works a few towns over, and he told me that people are actually wearing paper masks because the smoke is that bad there.

    Going after Affleck is a bit of a stretch imo. Affleck had 2 choices, go public against Weinstein, or personally try and talk to Weinstein to get him chill out. Like you said Phil there's power in numbers and it's hard to be the one that speaks out first. I'm sure A LOT of people knew about it, but like the Terry Crews situation, it's hard to be the one that leads the charge against a person with power and influence.
    Regarding the second clip with Affleck, he's flirting with her and she's flirting back, sitting on his lap, genuinely laughing and having a good time.
    Flirting and sexual assault ARE NOT THE SAME THING. If someone feels violated, it's sexual assault. Grabbing a girl's breast if it makes her feel uncomfortable is sexual assault. Commenting on a girl's cleavage if it makes her laugh and smile is flirting.
    You can fault Affleck for not speaking out, he SHOULD BE faulted, but fault everyone else too. And you can fault him for that 1 other incident, but I personally don't think he deserves to be demonized over 1 thing from 10 years ago.

      I do agree with this, and I also think it's stupid people are getting mad at him for something his BROTHER did, and the fact that he didn't condemn it for it. It's understandable for someone to be light on his family. I personally think he SHOULD have said something along the lines of being disappointed in him, but if he didn't then I won't hold that against him, they're family. It's not like he openly defended his brother's actions. Seriously, criticizing someone for something your family member did is stupid as all hell, and bringing him up is scummy.

    Stigma or no stigma, this is a matter of other people's health. If you are knowingly giving someone else a deadly disease, you should be put in prison. End of story. Unlike most controversial issues, this actually does seem very black and white. The same lowering of the sentence would not fly for any other disease you could knowingly give someone, so why is this one okay? To spare people's feelings? Ridiculous.

      Except that's not entirely true. Prior to this, in California, it was illegal to not tell your partner you have HIV. This did not apply to any other STI. Knowingly infecting your partner with other STIs already falls under misdemeanor not felony charges. And of course, outside of STIs there's plenty of things you could knowingly infect people with, with no criminal charges, giving people the flue is one instance. Knowingly infecting your child with measles or other so called "childhood diseases" is again, not illegal.
      Not liking this is perfectly fine, but pretending US law is at all consistent is ridiculous.

    To the California Senate Bill #239. I think it’s absolutely ridiculous to allow someone who is willing to transfer a life destroying illness to another human being and only be sentenced to six months or less. Six months in county jail is not nearly as life altering as having a disease that can kill you and take control of your life.
    For anyone who has HIV or AIDS: No, you are not the untouchables; but I’m sad to say that you are burdened with the responsibility to acknowledge your illness and understand that it is something you must face. Seek help. Be progressive and let people know how it affects you and teach others how to avoid it so that you mustn’t be avoided. The stigma is destructive and I can’t fathom what it’s like to bear such a heavy weight.
    On the other hand, to the people that it affects, like young high school girls who are uneducated about it and easily persuaded to not use protection. Like a girl I know. This can destroy your life. Not knowing is one of the hardest things when you have so much life left. Allowing someone to be taken advantage of and misleading them so that you can feel better is unjustifiable. It’s cruel to live with it, which is why shouldn’t make others live with it.
    To conclude, I agree with you Philly D. I think that a misdemeanor is not nearly enough. Honestly, don’t fix what ain’t broke. But what they can fix is the education about the topic and teaching young adults to be more responsible and allowing better means of controlling the virus so that people don’t have to worry so much.

    The thing is, HIV is something that someone is stuck with for life. In health class we were talking about protection and STDs and found out that it is not illegal to lie to your partner about having any types of STDs, (including HIVs). We all decided this was pretty messed up. I'm all for destigmitizing whether it be for mental health, sexual identification, or STDs. But having someone not tell someone about having HIV, that's really disgusting. Sure, they shouldn't be yelled at by a nurse for trying to give blood, and nobody should look down on them in any way. The only carriers of HIV who should be looked down on are those intentionally infecting others with this essentially terminal illness. There are healthy ways to help out other than giving blood and there are ways to live a healthy sex life while taking precautions for you and/or your partner.     With so many massively destructive events occurring recently, it's difficult to see when we'll get a break from tragedy and begin repairing our foundations. The natural disasters and human created tragedies have effected so many lives. There are many people missing, wounded, and dead. This carnage may not be the result of war on American soil, but these people have faught and are still fighting very legitamite battles.
    The light at the end of the tunnel in all of this, at least for me, is how unified people have become in helping those effected by the destruction. People from every corner are sending help in any manner they can. That is beautiful.

    Hey Phil, I'm here in Petaluma, Sonoma county just about 15 miles from Santa Rosa and I just want to say thank you for mentioning us and for your thoughts. Our town has taken in hundreds of evacuees from our neighboring towns. My business along with so many others and so many individuals have stepped up and have been keeping the shelters full, so full that they are turning donations away! Hundreds have opened up their homes and I've been able to cook and deliver food for over 200 people and restaurants have opened their doors offering free meals all day long. Another appliance business put together a free laundry mat. Thought you would appreciate all the kindness being shown in our community while this is happening. We are on alert for evacuation now. Winds are higher today and expected to increase overnight. Everyone, please do call the Red Cross or other organization before just coming here to help. We need our roads open, both inbound as more support is needed to fight the blaze and most importantly outbound so if more evacuations are required, especially from here where we are hosting more than our town normally has, to get out. So please, donate monetarily for now and if you want more local charities I can help find them. Also, latest local reports here say 3500 homes and businesses have been destroyed, not 300. It's incredibly devestating. Mutiple of my friends and family members have lost their homes already. I'm feeling lucky that for now we are safe and our home and business is safe as well. Please pray for Sonoma County! #SonomaCountyStrong love yo face!

    I was literally down the street from the Canyon Fire 2, my family was evacuated. We are all safe and sound, but my brother told us that two of his friends lost their homes to this fire. Such a shame.

    I live about 50 miles away from the Sonoma and Napa fires, and I've heard from people up there that donating to the Red Cross isn't of much help right now. What they need is supplies (especially breathing masks as they're beginning to run out!) donated directly to shelters for the humans, as well as to the shelters and rescues saving the pets. If anyone wants to donate directly I can get the addresses of the shelters :)

      dancer4evr1000 I live in Rohnert Park (a mile below Santa Rosa) and I can confirm the air quality is very poor and many people with asthma are negatively affected

      dancer4evr1000 Direct donations to shelters are also much appreciated as over 8000 people have been displaced and 1500 homes destroyed

      Let's not forget Planned Parenthood coming out a few years ago saying an HIV infected persons right to sex to more important than the partners right to live.

    im a high schooler in the East Bay Area and my school was canceled today (Thursday) and tomorrow (Friday). Sports were canceled Tuesday, Wednesday, Thursday, Friday, and into the weekend. I just want people to recognize that even though we get out version of a "snow day" it is at the expense of people's lives and homes.
