So, the ATC was not accurate enough. It still never should have happened.

Every flight is a training flight of some sort. Gaining experience, newer people getting qualified, performing check rides, it never stops. When my UH-60 unit crossed the border, flying into Iraq, we were training people. We are careful to mix properly experienced and newbie crews properly, so we didn't have an aircraft full of newbies together. Keep in mind the US military starts people flying from square one, so we were never full of ultra highly experienced people. But we constantly trained to improve skills.

Imagine if a drone took down a plane because it was violating airport landing space. Would everyone blame it on not seeing lights?

The only common sense answer that makes sense is to just stay in your lane. Which includes altitude and flight paths. The passenger jet was cleared for landing. Its eyes were fixed on lining up with the runway. They were almost home free. Everyone knows that no matter what you're doing, everything looks different at night. It's a common perception. Some people chose not to drive at night because of that reality. But when you put night vision devices in the mix it complicates things. It seems there should have been more radio traffic from the tower than just asking the helo pilot if he sees the aircraft. The video showed a fast and steady incline from the helo that went straight to 300 feet. If they've done that many times, and they're so experienced why didn't they level off at 200 or 250 feet? But even if they did that their air speed closed the gap between the aircrafts. Every pilot and air traffic controller should know that when a plane is on approach it slows down. The helo showed no sign of slowing down. If they were practicing quick extracts why cross a heavy traffic flight path to do it.
