    It's more of a moral crime, not an unlawful one. However, during a divorce settlement, the adulterous partner should be put in a disadvantageous position

      Morals are the base for law. Assault for example is illegal because it is immoral and hurts the victim of it, the same goes for Adultery. Marriage is not only a religious thing it is also a governmental contract and as such the punishment for Adultery should include a fee to pay and a loss of many privileges during the trial when it comes to the inevitable divorce.

    Some outrageous statements in the SC Judgement. Adultery is not a crime anymore but "merely" a civil dispute between 2 persons. What utter debauchery!
    Here's my conspiracy theory, by passing controversial & somewhat ridiculous judgements, they want SC to lose credibility as a protector of rights & undermine its efficacy in providing genuine relief to public by addressing litigation. In short reversing the phenomenon of legal & judicial activism which has until now thankfully empowered citizens & checked governments. So when it comes to Judicial appointments, politicians can say with more ferocity, look! your judges know not what they do! let us guide them. Thus ultimately politicians rule the roost.

    Adultery is absolutely criminal otherwise it is as good as a vegetarian become non-vegetarian when you're are served non veg and vice versa.
    And in my opinion arranged marriage are likely to commit more adultery than Love marriage, because you can't arrange/fixed someone's Love but likeliness can develop in the union of couple based on wealth, caste, religion etc....

      Contempt of Courts Act of 1971 - section 2(c)
      (i) Scandalises or tends to scandalise, or lowers or tends to lower the authority of, any court
      there is a law on our country for ur kind information which governs the judgement of the court from abuse or suspicion
      You can file a contempt case against this person and the channel for allowing this by paying Rs 130/- in the local court and hearing will be in 30 days.

    It should be illegal for many reasons because for some ppl it can cause a rage attack and someone can get hurt in my case I was loyal for 6 years he wasn’t helping me out with anything he cheated on me with his exe that cheated on him and I thank the lord I didn’t see them because honestly idk how I would’ve reacted after waisting 6 years expecting to have a good marriage

    All women in the show are MISSING ONE VERY GRAVE POSSIBLE situation ... Which is actually a very simple logic... I promise you will agree too...
    Allow me to tell that ....
    As now section 497 is " de - creaminalised " ... In simple words it has actually lifted fear from at least significant PENALTY FEARED MEN (as earlier only married/unmarried men were being prosecuted )
    that HE will not now go to jail if gets caught while having extra marital affair with a married woman .... So now these PERSIUT OF HAPPINESS attempts will increase obviously because sexual , mental need excites everyone (THE LAW was deterrent for least some PENALTY FEARED MEN ) this will increase chances of getting caught , which can in tern increase number of divorce ..... And we all agree that such UNPLANNED BROKEN MARRIAGES almost always badly affect ( FINANCIALLY , EMOTIONALLY , PSYCHOLOGICALLY etc ) all the 4 or 3 persons involved in that case ....
    REAL Solution of unhappy marriage is trying to solve the exact problem or getting divorce .... though many a times it's difficult to take divorce keeping in mind issues of children , old aged dependents ...
    Very sorry to see and surprised that THESE PERTICULAR
    ( EDUCATED , GOOD JOB HAVING AND SO CALLED SENSIBLE )
    WOMEN TALKING ACTUALLY and unconsciously *AGAINST* AT LEAST 75% WOMEN & THE REAL SITUATION THROUGH WHICH 75% INDIAN WOMEN'S ( LESS EDUCATED ,JOBLESS , SKILL LESS ,POOR ,INHERENTLY superstitious , conservative) ARE GOING THROUGH ...

    I say both man and woman should be be prosecuted under 497... And both man and woman should have the right to file a case against his/her partner and the third person ....

      You are totally right, and have illustrated well.... I feel the same thing. There will always be cases (in fact in majority) when sincere spouses will be cheated. The word cheated doesn't begin to do justice to emotional trauma suffered by the innocent spouse, god forbid even his/her children. What about the justice for them? No punishment? It's the point where humans begin relinquishing their humanity & adopt animal-like tendencies(like thousands of years ago, no). Such "freedom" is not honourable. It's evil will, not to be allowed but abhorred. How can people come to accept that shattering someone's dreams in a dishonest & vulgar manner after bonding with them in the first place is alright. It's disgusting moral fraud, a crime. If you don't have the wherewithal to mend differences in a marriage and create an amicable environment, at least get a proper divorce first.
      As we all have come to know by now, IPC 497 can be broken down into 2 aspects - Gender Neutrality & Criminality of Adultery. Only the former ought to have been corrected, and it should have been done long ago.
      The judgement text says that adultery isn't necessarily a cause for grief in marriage but may be a response to grief in marriage. Are you going to justify & let go wrongs done to innocents then? There can always be apparent explanations for such reactions to circumstances, but it has to be done in the right way. At least in theory, in a legal deterrent, a precedent. If not, then nothing matters and no law or principle need be followed, only the will of individuals.
      This judgement indeed has the potential to let people rip with gay abandon and complete impunity. Honest people will be made to suffer, without even a semblance of chance of punishment. Its morally and logically flawed. Massively. It sets a very bad standard, to not have any criminal punishment, only divorce or compensation. I really hope this is just a temporary situation before a proper law is created.
      Consider some of the rhetoric in support of this, which is available on quite a few platforms, it's pretty revealing and frankly ridiculous. 1) "No physical activity between 2 consenting persons can be considered a crime in the 21st century." Why? Whats so special about the 21st century. The Era in which u belong has nothing to do with legitimacy or otherwise of human actions. Human values are timeless & universal. Decriminalizing Adultery reveals an indiscriminate short-sightedness; it lacks wisdom. Wisdom is a virtue hidden deep inside the conscience & intellect of every individual bar none. It has to be extricated painstakingly through moral & logical reasoning. This is neither easier today nor was any harder centuries ago. One just has to withdraw a little bit from whats happening in the world and apply their own mind.
      2) "Justice Chandrachud is reversing the sins of his father." Meanwhile wasn't this a unanimous judgement, which is even more startling.

      I totally agree with you. This abolishment of the law will make impact very much in our society. On the other hand , it is making adultery legal .
      Woman are talking about right. But they are not knowing about the consequences of it. They will have to face DIVORCE in future. Be ready woman.

      Actually The law and The judges never really care about honest women who's husbands indulge in extra marrital affairs and if seen critically you will know that such cases are majority in the total cases because of our highly patriarchal society ... So Earlier as well as now also the law didn't gave a chance to honest women to seek justice ...

    I saw this when the torrential rains stopped & I could listen to the conversation. I feel that Nisha Khanna made a lot of sense when she said that there should be premarital counselling which the non working so called housewife mothers gave their children in the previous gen. Better still 'relationship' can be made a subject to be taught once a week without exams & marks where the students can discuss their domestic problems with a kind listener & be interactive. It was there in joint families of yore. Full marks to Nisha Khanna. At last a psychologist who is worth her salt & tells it as it is & does not speak for the gallery.
