USC Detains Person Making Free Speech Argument in Village

- An individual was detained in the USC Village Monday afternoon after shouting near the Hecuba statue about freedom of speech and holding a sign reading “Sue USC.”
The person said they are a USC student and they had a right to express their opinion. DPS officers asked for the person’s ID and were filming someone who was taking video of the long interaction, witnessed by journalists.

It doesn't matter. He was standing on a sidewalk, which is by definition a traditional public forum. Sidewalks are NOT private property. He's a nut, but he has the right to express his opinion.

@@AirborneAuditsprivate properties can have sidewalks on them. Example: Walmart has a sidewalk in front of the store. Churches have sidewalks leading to the front door. Houses have "sidewalks" that lead from the sidewalk to the front door/stoop. It's a private walkway, it just looks like a sidewalk.

You don't have to be a student to stand on a public sidewalk and exercise your right to free speech. The kid is an idiot, but he has a right to be an idiot. By definition, sidewalks are a traditional public forum, and you can say what you want in this country.

It doesn't matter if it is a public college or a private one. It doesn't matter if the "owner" of the sidewalk is a private entity, either. Under Title 3, Section 3 sidewalks are defined as public right of way. You CANNOT be trespassed from a PUBLIC right of way. Not all sidewalks are in the public easement, but 99% of them are public right of way.
Also, sidewalks are defined as a "traditional public forum;" consequently, your First Amendment right to free speech enjoys the highest protections in these quintessential areas. The kid is an idiot, but he has the right to say what he wants without government interference. This is likely an unconstitutional arrest, and if he will probably win a civil rights judgement against the city and college if he sues (and he should). @@masonmurphy6009

Clearly this kid has been coached. This is not normal behavior. People should question what their "told" to believe, form their own opinions, and be wary of forced ideology.
As stated in the Student Handbook, “Students and student organizations shall be free to examine and discuss all questions of interest to them and to express opinion publicly and privately."

@@cory6266 Trespassing is not a felony lol. Nobody is in Jail simply because they were on a school ground when they were not asked. They didn't even give him a trespass notice, to lawfully detain him, let alone arrest him.
Secondly, Resisting arrest is a secondary crime, they don't have a primary. Therefore what they did, was Unlawfully Detain him, not arrest him.
The problem is 99 percent o their orders are unlawfull that why no one listens to them it's all their ego .I'm not defending this kid at all don't get it wrong if h trespassing then he's trespassing n needs to be dealt with .

Is this a pubic campus or private, that is a serious question. If it is a private campus they could have him removed. If it is pubic then they Did violate his first amendment rights. Big paycheck if he sues. (Not legal advice)

It's a public campus but placed in the stewardship of the college. The government cannot prohibit marches on public sidewalks or streets, or rallies in most public parks or plazas. However, it can require a permit. Which I doubt this guy had.

@@LuxParadoxx I understand your point but permits are a way to manage the chaos. If you go to say Washington D.C., there are protests all day every day. Requiring a permit ensures that who ever manages the space can properly prepare. Will there be a counter protest? Do the police need to be there? Is another unrelated protest set to be there at the same time?

Crazy how I've seen crazy stuff happening at USC and the cops are chilling for the most part. But probably the most peaceful protester they've had in the last week and they are like we got him.

USC is private. They most certainly can remove this person. Order was given to leave and was refused. So they do have the right to arrest him.
