Steam made a similar mistake with Dark Souls Remastered when the dev put it on sale they had the discounted price listed for 9.99 instead of like 29.99 or 19.99 and I ended up purchasing it for 9.99 but they corrected the price pretty quickly afterwards but never canceled my order or deleted the game from my library. This reminds me of a really annoying eBay purchase I once made...
Was browsing for speakers and saw a set listed for $15. Based on the model I was fairly certain they intended it to be $150 BUT wasn't going to pass up the deal...
Sure enough they canceled the order...
Instead of fessing up to their mistake, they claimed eBay made the mistake therefore eBay required ME to cancel the order. Though they canceled it they chose "canceled at buyer's request".
Their crafted narrative was supposed explain away the chosen reason for the cancelation (my request), as other options count as a seller fault. I ended up reporting them to eBay, though I doubt eBay did anything about it.

      @@puppieslovies No, I disagree.
They created the listing, set the price, then confirmed the listing, and they didn't verify it afterwards. THEY mispriced the item, it was their mistake.
If I bid on an item and win, I'm obligated to pay what I won at. I can ASK the seller to cancel my bid, but they do NOT have to accept it. When I make a bid it's a binding agreement, it only makes sense that this goes both ways.
If a seller does an at fault cancelation once or twice, they will have a couple of dings on their account, but it won't really mean anything. If a seller repeatedly does this, perhaps they shouldn't be allowed to keep selling (which is the point of having a system that tracks this).
And they definitely shouldn't have lied to me about the whole thing.

    • @puppieslovies
      @puppieslovies Рік тому +4

@@BobbyThompsonRocks it's dishonest business for sure, but we can't exactly expect a seller to pack up and ship an item they sold at a loss because they were not able to modify their mistaken listing. Ebay is at fault here for creating a system that prefers sellers to accept a bid and cancel rather than stop the listing and pay out a fee
Some sellers legitimately cannot afford to pay for a mistake like that. In your case, the seller would lose like 5 dollars or so to just remove the listing, and that is on them for being scummy

We had to honor all orders because we listed not just the reduction in price but the actual 80% reduction figure. That according to the court was enough to make us have to honor it. If we had only posted just the reduced price we could have gotten away with not having to honor the deal. Of course this is in the United States not sure how it applies to Canada. @@veysher3756 Not "garbage" at all buddy - it's clear you don't understand why there are LAWS regarding this sort of thing; because of a LOT of companies in the past would advertise a "great deal" on something high end, only for people to turn up at the store be told "oh we've "sold out" of all the ones we had on sale but here's a similar model for the pre sale price, or a lower model for less". Selling Psychology usually dictates that the person was looking for the higher end model and because they've made the trip to the store etc etc they will often say "fine we'll pay the extra monay" and buy the model they want at the normal higher cost, and the store makes a sale they might not otherwise have done, and with more profit.
When that is done DELIBERATELY by a retailer it was recognised to be a SCAM, and retailers have been doing that for a LONG LONG TIME, so most countries introduced LAWS TO PROTECT THE CUSTOMER FROM THESE SORTS OF "SALE" SCAMS.
However sometimes a mistake is made or some other human error and the company is legally obligated to sell stock they have for the price ADVERTISED, even if the price was only there for 5 minutes, in those 5 minutes if a customer coems along and says "here's the money give me one" the retailer MUST SELL IT at the price the customer saw.
So the onus is now on the RETAILER to GET IT RIGHT. and if not - well good for those customers who take advantage.
In the case above, the company lost 250k - you know how much a bad rep with customers and breaking advertising laws can cost you? EVERYTHING - closer of the entire company in some cases. At 250k I'd say they got off lightly.

Luke mentioned charge backs but that is a stupid good way to end up in trouble. The people knowingly made the purchase of said games by all definition. And by accepting $25 credit it means they have accepted a resolution. Honestly if a deal is too good to be true people need to stop trying to work so hard at scamming businesses because of mistakes. @@pokerus4511 First of all, the deal was not too good to be true. EVGA had already discounted the 3090Ti to around that price, so it was a reasonable discount.
Second of all, it's still a purchase that went through. A lot of the time I see people get stuff like cheap clothes or games due to pricing errors. I've only seen them consistently cancelled when the price was free, which is reasonable.
Third of all, people bought the 3090Ti for the cheap price, not for the game bundle. This sounds no more different than a scam, getting people to buy a 3090Ti but then taking their money for some games they likely never wanted (at least not all of them) at full price, even if they could be had for half the price on a steam sale.
Fourth of all, they might not have accepted the store discount, but instead got a "here's some compensation :)" email without actually agreeing to drop any issues they have with this.
Ultimately, the mess-up was Newegg's, so it's their duty to compensate the customers for the trouble they caused them, not the other way around. You can bet the bundle didn't cost Nvidia or EVGA nearly as much since it was an add-on, so they could clearly work out a deal with them if it was needed. But of course Newegg goes ahead and troubles their customers instead, because it's much easier to forcibly take their money as compensation.
There is no need for sympathy towards businesses who operate as such. Whatever the cause of their errors, it's their mess-up, and no matter how they wish to handle this situation in order to minimise their losses, it should be imperative that if they cancel the shipment they either give out either all the money they took (+a small compensation preferably) or that they give a large compensation (store credit most commonly) that exceeds the amount of money they took from you. Store credit is also less valuable than cash because you're forced to buy from one place, possibly overpaying for the goods, it usually expires after a not so very long time, and you can only use it for the things you find in that store (so no groceries or rent can be paid, which may mess up someone's budgeting if they suddenly have their money taken away from newegg).

It is no ones duty to compensate. That is your entitlement showing. You must be the one who uses self checkout and expects a discount because you rung up your own purchase. People throwing a fit over an items being refunded is ridiculous. Maybe whatball stores need is a steep restocking fee and penalty for returns. Maybe all stores should do it to compensate them for your lack of self awareness buying the wrong item, or changing your mind. It doesn't go so well when its an inconvenience to the company.
These people literally knew what they were doing, and do it regularly. There are people who regularly wait for mistakes just to complain. Just like yourself. Its seriously annoying. You are what ruins retail. The business is actually doing you a favor by making it a hell of a lot easier to make purchases, offer free or heavily discounted shipping, standard discounts, and a central location to make orders for multiple items. I bet youd love to figure out what it would be like to deal straight from the manufacturer for every specifc item, and realize shipping isnt free. If you can not deal with the fact pricing can have mistakes, and realize that sometimes orders vet cancel then you have no sense to shop online or in a store. Seriously entitlement in this community, and many others is above ridiculous.

Im not sure how it is in other parts of the world, but such pricing errors are common, especially when using a trading-platform which automatically feeds your shop the "latest" prices (which already can lag behind) and your shop still has to process them, maybe youre using an additional pricing tool which adds extra delays (and sources of potential failure).
Here (western Europe), if there is a pricing error the shop can cancel the order within a certain timeframe without any consequences by law, especially if the prices are obviously false (600€ Monitor for 90€ for example) since the transaction/deal is only valid if you get a "real" order confirmation. The one automatically generated by your/any shop does not count as one btw.

I've worked in retail for my entire professional career, albeit from the technology side of things, retail inventory systems, pos, eCommerce etc. The "cost price" is always fluctuating, based off of rebates or manufacturer promotions you name it. Working in retail has really been an eye opener on the kind of margins that big box stores make and it's not always clear what those margins are at the lower levels because a lot of it comes down to the negotiation between buyers and the vendors, sometimes retrospecitvely.

@@leonguyen896 That's actually still Nintendo. Linus discussed something similar in his video about the budget OLEd TV, but manufactures will generally have "minimum pricing" for items to prevent a retailer from firesale-ing a particular item to drive traffic to their store. That could lead to another retailer doing the same and undercutting them, essentially creating a prisoners dilemma race to the bottom.
Because when customers see a low price that went out of stock, they tend to wait to see that price again which hurts all retailers involved.
There's also how Nintendo views itself as a "premium" brand, they would rather artificially keep a game priced high to avoid sending it to the bargain bin when they don't want to. For example, Mario Party The Top 100 on 3DS is 39.99 on the eShop, but many WAY better games made by Nintendo are in the Nintendo select series priced at 20. The games value on the used market is way less than 40, so it makes no logical sense traditionally to keep the price there.
For physical goods that kind of screws over the retailer, so I assume Nintendo eventually buys the game back from them or something.
Another aspect of Nintendo is that AAA games rapidly dropping prices causes customers to hold off which causes them to drop faster next time. Nintendo basically picks a price and says "this shit will stay here, maybe if you wait 5 years you can save 20 on Breath of The Wild", so their games keep a more consistent value and customers feel safer purchasing now than having the price cut in half by the time they finish the game. Obviously this only works because the brand and games are so desired. I do wish they picked 50 bucks as the standard price, but maybe they see the Switch combining handheld and console play making them sell less games overall.

I spent around $10 in gas and all that time because they didn't let me know it was canceled. Days go by before I get anything showing it was canceled. Luckily they atleast refunded my card but still

If I get a shipping confirmation, and that email is in fact a lie, it's not really an excuse to cancel the shipment. I used to work in sales, and we all know that the shipping confirmation is created when the label is created, and we all know we could easily inform the consumer that this is not actually confirmation that the product has been shipped and also that we could easily actually confirm the date of actual shipment as well... Can't have it both ways....
In regard to the speculated pricing error and how it occurred, it's none of the consumer's concern about any of that. A price was advertised, and the consumer is entitled to rely on that advertised price. The manufacturer, wholesaler, and retailer can work out who has to pay for the mistake between themselves.

So glad I took the pains of not just quitting Newegg after the exploding bundled power supplies and refusing returns of items _they knowingly sent out broken._ I actually made them scrub my account. The customer service people were ok, and I didn't get nasty with them, but I did say that I needed my entire account purged because I could no longer trust them with my data, and I didn't want to inflate their numbers simply by having an account any longer. I had stopped buying months before that, before deciding I had to make the effort of registering my disappointment.

Starting to see huge price slashes on 30 series NVIDIA cards in the UK. Sorry, but waaaaaay too late. The horse has bolted and most of the people (myself included) that had been eagerly saving/waiting to purchase a new PC build spent that money on other luxuries months ago or are sandbagging the money to prepare for insane cost of living rises. I'm sure they will sell well but only at the cost of cannibalising purchases in the future of new card series'. They held their hand for too long and kept those prices too high, sure there were some inevitable price rises from supply/demand but they clearly got too greedy....

Once they figured out there issue. They corrected it on the website. However publicly announced that they would honour any sales made at the lower price.
Now yes, they were loosing money. Selling way below cost price. But they gained alot of respect from the consumers.

All i know is in the US if the goods/services are listed for a price and money is exchanged then the seller is obligated to it. Even if money isn't exchanged. If i go in a store and the price tag says one thing and it scans for a higher price, they must sell at price listed at shelf even. I've got experience in retail. In the US they would have to honor the transactions for those who managed to place the order. Only thing they could do is delay shipping due to lack of stock but not cancel nor refund.

A vendor can refuse sale at any point, but not after the sale is complete.

In the US it is a common mistake that a product or service must be sold at a listed or signed price. An error or mistake does not fall under false advertising, and there is no law in the US stating a listed price must be honored. False advertising applies when the pricing confusion is intentional.
