      @@86partha there is if you had good laws. Rent and tenant cases are resolved within a day or week if notice is to be issued in other countries. You would have to do nothing rather police would come and ask the tenant to vacate.

      They can live for free for more than just 1 year. Civil cases last a long time in court and can last a few years. Mainly due to absenteeism of the judges, transfer of judges and opposite party can get upto 90 days time for each step of the litigation process .Best is to try and avoid court cases all together and try and settle out of court. I have been trying to evict tenants for almost a decade now.

      Get your tenants to sign a contract with all the conditions. It helps your case in the court if your tenants are not vacating your property...

    These good chances may cost you lakhs of money and not 1 year but 20 years.
    My dad fought for the possession of our rented property for 20 years and still we have to settle the case by bribing the opponent lawyer. As both ours and their lawyer had mutual agreements to lengthen the case to milk out more money. We changed multiple lawyers but it was always the same story.
    Currently this building has 4 more renters illegally occupied and not paying any money. My dad poured all his hard earned money just to remove one renter.
    The judicial system is a joke and these lawyers are just clowns spitting fake promises and beliefs.

    As per recent judgement of supreme court if you occupy a property for more than 12 years you can rightfully claim ownership of that property ! i rent my 3 shops for 11 months agreement. but end of every agreement i will ask them to handover the keys of their shop to me for period of 7 days i will open & close the shop for 7 days claiming my ownership ! then on 8 th day we will do new agreement for 11 months . incase they dont agree i will make new agreement with my best freind at end of contract expiry as new tenant and he claims to vacate the property as she is tenant now

    Woh sab toh thik hai...
    But if the tenant files a false rape/molestation/sexual harrasment case then case will take a different route. Now first you gotta prove that you're innocent then think about the house. That's why it is highly recommended that don't provide rental accommodation to any single woman and be cautious even if there's a family but with a female member in it. Especially, if you and your family is also accommodating in that house itself.
    One such family living at a little distance from my locality had rented out their house to an old lady and when they asked her to vacate the room she filed a physical assault case on them. Best part was her son was a lawyer. IDK what happened further but all I hope they got justice.
    Never ever rent a part of your house in which you/your family is residing. If you're renting some other house, keep a broker or some middle man. This rule is not just recommended in terms of renting but with any kind of trade involving women.

    I had new tenants sign an undated eviction notice before moving in. The deposit was equal to a month's rent. It worked every time.

    My ancestral home case is in court for 19 years now that too in the lower court just because the tenant was Janeshwar Mishra (lohiya) my great grandfather let him as tenant at my ancestral home then after that his party workers occupied it and now they live there my grandfather took them to court in 2004 and my grandfather passed away in 2019 and the court case is still going on.

    Yes. I have personal experience, your own lawyer convinces you to settle for the same rent amount. No compensation. Case went on for 1.5 years.

    Most of the lawyers do not even know the lethal provisions available in CPC that can be used against the Defendant, that is the reason why petty cases are pending since decades. A good lawyer can get the eviction done in this particular case within 6 months.

      Can the police do anything in civil disputes? I have heard that unless it is a cognizable offence, police cannot do anything without the magistrate's permission. Is it true that we need magistrate's permission for the police to act on non cognizable offence?

    Can we file civil suit if there is rent tribunal also ?

    Once gone to court you end up playing a game of cat and mouse.
    Never allow a tenant to stay for more than 2 years. Even if the rent is coming on time and even if they are keeping your house in good condition.

    Yes you are absolutely correct we done that it just takes only 18 years 2 generation and atlast out of court settelment because court give such stupid decision that even if i am the owner on paper i am not actuall owner then and the fun is that neither the illegial occupant is owner best solution every one should try atleast one time this in life so you have a story to share with you children and grandchildren how to not indulge in fights even if you are right😅😅

      Un-fun fact: if a tenant is renting a house for 15 years or more, than he can legit file an occupancy appeal in the court stating that he should own that house now and the court will most likely be on his side.
      So, it doesn't matter how nice or bad your tenants are, before letting them live in your property, make them sign a contract. Issue them conditions for payments of rent and for how many years they can live (keep it not more than ten years)... This way, if something happens, you'll at least have the contract to help your case in the court...

    It took my father 20 years to evict a tenant who was paying 200 rs for a prime commercial property. He couldn't open a showroom even though he wanted for his own use. I lost out too as my life just passed by and my father couldn't leave a business for me. Justice delayed is Justice denied and our courts are notorious for it. But for people like teesta setalwad who was accused of fabricating evidence to implicate no less a person but our pm Modi ji, the chief justice came out of the auditorium where he was watching a Bharatnatyam performance on a saturday evening, constituted a bench in Supreme Court and gave bail. There's no Justice for common man. Politicians get bail even though they are accused of serious crimes and the cases will never be taken up. That's the situation in india now. No wonder many are leaving India and giving up citizenship of a country where reservation is the rule though it was supposed to be temporary.

    I think Rent control Act mei remedy di hui h and waha pr clearly mention hota h eviction of tenants se related section in which grounds are mentioned that under what conditions a landlord can evict his tenant. Order 12 Rule 6 ka apply hona banta nhi h. Just because he accepts that he is a tenant it does not mean that Court will straight away order eviction.

    That is what the Tenant wants. Let the House owners go to Court. The date of hearing will be once in two months, if not three months. It will take minimum 2-3 years for judgement. I agree, a tenant should vacate when genuine requirement of House Owner exists. In most of the cases House owners want the long years old tenant to vacate to give the vacate property on rent with fabulous and exorbitant rent.
