    My Question is That High Court issued stay to our promotion orders and later on after CAT introduced in JK ..The said case got transferred to CAT Srinagar and from 4 years the CAT is delaying case ….is there any possible way to quash stay order issued by HC in Same HC as the CAT is just delaying the case despite the fact that respondents have already filed the Objections …The main applicant /Petitioner of the case stays Retired now and he is not attending to case thereby creating unnecessary delay to our promotion orders

    Great sir wonderful explanation..Sir kindly clarify after engaging Advocate in Highcourt is it possible petitioner also argue the matter with the permission of the court..K.MADHUKAR REDDY

    • @LegalInspiration
      @LegalInspiration  7 місяців тому

      Normally the petitioner cannot argue, once he engages an Advocate. But in very very very exceptionally strong situation the court may permit the petitioner to speak, if the court thinks it proper. A proper request will have to be made.

    Sir, what is the remedy if even after giving much more time to respondent government authorities, the authorities sit on case without filing any reply in special civil application?

    • @LegalInspiration
      @LegalInspiration  9 місяців тому +2

      High Court then has the power to decide the case in absence of their reply.

    • @anilparmarhimmatlal6549
      @anilparmarhimmatlal6549 9 місяців тому

      @@LegalInspiration Agreed, sir, but high court itself on various dates allowed the respondents to file reply belatedly. 😉 Government authorities now even don't bother about the high court's instructions. I have observed it in a number of cases filed against various government authorities.

    • @LegalInspiration
      @LegalInspiration  9 місяців тому +2

      Yes that happens. But a point comes when the court would strictly say no for granting further time. At the same time the counsel for petitioner will have to press for hearing without the reply of the respondent government.

    • @anilparmarhimmatlal6549
      @anilparmarhimmatlal6549 9 місяців тому

      @@LegalInspiration Yes, SIR! That's what I had precisely done. There too, respondents filed reply only 4 days before next hearing. Judge on the day of hearing advised me to file a rejoinder. I said I wanted to argue my case straight sans filing rejoinder. Judge was reluctant in beginning but asked me to give a short note. I gave it in next hearing to Judge with copy to respondents. THX SIR, FOR TAKING TROUBLE.
