It's a shame the government is trying to change the treaty law, which is going to effect these leases as well. With those provisions removed, we might be looking at these leases being confiscated again. Since those clauses were one of the few reasons they weren't stripped from us in the first place. All it'd take is the local councils voting for it after the government removes those clauses

Excellent report Mihi. Sadly, in Aotearoa the settler colonial mentality still prevails and the injustice of Maaori perpetual leasehold land is the proverbial can been kicked down the road. It is a strength of maaori to be able to absorb such inequity and yet show integrity, self-respect and patience. If the gumboot was on the other foot, would the farmers display the same principles? Justice delayed is justice denied.

Brilliant article. In Tairawhiti there is also the issue of Maori Landowners paying market rent to lease and live on their own land which is administered by Te Tumu Paeroa using antiquated leases. We would love to follow up this program with that issue too.
Thanks Mihingarangi and team for this great doco. This has given me greater resolve as a Tangata Tiriti to expose this long-standing injustice amongst my networks of influence by sharing this doco and/or having friends over for a "viewing" and discussion afterwards. As the historian interviewed commented. If the land belonged to Remuera landowners (or any pākēhā for that matter) the law would no doubt have been amended years ago. I was also humbled at the attitudes of those most impacted, especially Tina who embodies that generosity of spirit and quiet courage, despite generations of deep hurt and injustice, that allowed tangata Tiriti to share this whenua in the first place and gave us a place to call home in this country.
I feel physically sick hearing this history. I have learned very many things in recent years about the thieving and destruction caused by my people. I am very shocked by this, but also shocked that I can live for so many decades on this island and not know anything about this thievery and oppression. I salute the trusting warrior who enlisted and went to fight the pakeha war. I would love to know where he is buried and what happened in his life. Does anyone know? I think about these heroes of ours rather often. I won't forget this man who was so very terribly treated after his time in France etc. I will tell others about this injustice as this history was never included in my 12 years at school (when I learned other stuff, like Chinese history and the Treaty of Versaille, and the French & Latin languages). The entire story, ending in them being in debt. And the story of Taranaki is so, so awful. The lease holders and court outcome is heartbreaking. The situation is so shocking. Everything said is so, so heartbreaking, so sickening. One of the most sickening things is listening to Tama Potaka, my arrogant MP. And then learning about Mr Oates, the sneaky, thieving prick. What an utterly wrong situation. As tangata tiriti, the one-sidedness of this situation feels disgusting. It’s like some dark aspect of the NZ Wars has continued. The legislation was enacted to punish and hurt Māori. There is no reason for it to continue to exist. Yes businesses will have to be paid out. It’s somewhat complex but not really. Complex Treaty claims have been settled. The claims of lessees can also be settled. To be denying tangata whenua control of their whenua, security (food, housing, culture, health), opportunity, creativity, but still giving all that to lessees is utterly contempt and disrespect. (The current govt is also being totally hypocritical about this - David Seymour has banged on about changing legislation to give all NZers incl Mãori more opportunity to build houses on their land, but is on record (in an interview with Mihingarangi?) as being uncommitted to doing anything to change this dark, disgusting situation. As an Anglo NZer, I am very thankful for such stories and media outlets, that allow me to hear from and learn from Māori. A very clear view of the dark side of a paradise stolen. Rather telling that the occupiers of leased land threatened violence if they must abide by a fair settlement, but the owners, for hundreds of years, so obviously wronged, want a non violent legal resolution.
The system has given so much entitlement to Pakeha over 180 years that they have become entitled to the point if you take it away( entitlement) the will use violence like those farmers threatened to do, they don't have the intestinal fortitude to do the right thing or even better work alongside Māori in this controversial space. Māori will get justice, the system is crashing. Māori will be the paternal parent to the Pakeha soon, but we won't be treating them like how they treated our tūpuna, were not mean-spirited like they are which is were entitlement stems from.
True there's a lot of entitlement and unnecessary paranoia among some Pakeha people, particularly in the older generations. People will profess not to be racist, but if certain subjects come up like land rights or Maori language something dismissive will come out. A lot of it is ignorance and a lack of self awareness.
Without the lands from indigenous people, Pakeha or white settlers would have nothing to build on, to prosper with. Every country you hear about the white people/govt stealing from these people for centuries. Really heartbreaking to hear and watch 😢😢

The crookery continues. This is why lease agreements should have a "no first right of refusal" clause within it. Have your lessee reapply at the expiration of any lease. Maori owned land is around 10 percent less in value than general land.

Kia ora whanau. My partner Peter was interviewed for the Maori leasehold land doco. We purchased Café 35 in Tuatini/Tokomaru Bay three years ago. I have always respected Mihingarangi Forbes body of work however feel her editing of this show and splicing of the context as being unfairly detrimental to both him and myself which was disappointing. When we discovered the factual history of the area we were appalled & motivated to do whatever we could to mitigate the situation. We were the only leaseholders who spoke up & supported a petition against this injustice. We do not have the wherewithal to change Government wrongdoing, but legislation & compensation is required. Let's fight for that!
I appreciate his honesty and that you both seem to be reasonable, considerate and thoughtful people that are obviously just trying to run a business. It's very admirable that you were in support of the petition which is clearly at odds with your own financial interests but did it anyway so I commend you both for courage to speak out against this ongoing injustice. I feel sorry for any backlash Peter has received from this interview personally I felt that I understood his motivation for supporting the petition came from wanting to do the right thing and it was unfair to leave in some of the more awkward questions and answers around allowing the iwi to have the land back which was a pretty loaded gotcha line of questioning. Unfortunately despite it being one of the points that is repeated throughout the episode this shouldn't be blamed on the current lease holders so anyone with a brain should understand that this injustice was not of your making nor within your power to rectify and yet Peter and yourself chose to sign in support of change when you became informed of all the history and had to face the reality of what change could mean for you directly you choose what was right and not what was easy which stands you apart and in direct contrast from those lease holders in 1996 that actively protested and petitioned against the government's previous attempt to try changing/updating the Perpetual lease legislations stating how unfair and unjust any changings would be to them financially without any thought or empathy for Maori. We are the rightful owners of that land who have lost and continue to lose the enormous financial potential by that exact same legislation. Maori didn't just lose the land and the ability to control the land and its use but we lost our legal and human rights also having little to no way to legally take back the land except at extremely high costs despite already being the owner seems intentionally callous considering the lengths by which the legislation insures that the maori owners are blocked or extremely limited in extracting any meaningful financial benefit from the lease holder despite all this its fact that many Nzers think maori need to just let it go and move on already but these are the same ones that also look down their nose at us in our own country because they believe Maori get special or preferential treatment, many of whom make up the National and Act base currently railing against Te Treaty spouting one law for all and yet the specific laws they want to change are those that will reduce or diminish maori right right even further. So thanks for being an ally you deserve recognition for standing up in support when so few would do the same in your position. All the best.
This is very eye opening. Very, very sad..!!! this sort of thing has happened globally..ie, the American Indian were put into reservations and delivered, food , only not all of it made it's way and many starved,.... the Wounded Knee history is also disgusting........ . Romans, enslaved the English, Saxons, too... Many injustices have been done , Greed, is so very evil, far too many innocent suffer from others demise. I know some of my history on my maori side , and my European side, both, are not very colourful.
I've worked in government especially the Land Office. Leases in NZ were never mentioned in the TOW. They were introduced twenty years afterwards, at a time when the UK was getting rid of them. It isn't possible that the 21 year leases became perpetual leases 'by mistake.' Instead that action smacks of bribery or fraud.
Same thing done to my nannyma the orchard taken from her, I'm gonna try my hardest to get it back. She was the sole owner but somehow those that leased it now own it

Don't forget that Maori colonised each other in conquest. The Central Plateau is a good example. Many who call the Maunga their own originally came from the sea. Should they give whenua taken in conquest back to the original inhabitants?
Maori have been in Aotearoa for nearly 600 years, likely longer after archeological findings of a Maori Shrine dating back to 1200AD. Moriori were primarily on the Chatham Islands. A land of which was left mainly untouched until European colonizers went and drove the remaining full blooded Moriori to extinction in 1933. The argument you make with Maori taking land and property from other Maori in this day in age is essentially stealing from your cousin and having to give what you stole back. Your ignorant oversight is that Maori are no longer separate tribes in our collective struggle against systematic oppression. Other than that, there is no recorded history between Maori first setting foot on Aotearoa and the first Waka that left the Polynesian Islands. But I wouldn't expect you to know anything regarding this situation, except for what you type into your search bar and paste the first result that appeals to you.
Perpetual leases need sorted. Maori are impeded by it but it is a general fairness issue! It would go a long way to help things .while the problems being fixed , similar but not such extreme issues exist with glasgow leases and leasehold land where the lessees are denied capital gain . Govt could force the issue to be solved!

Thank you for airing this as perpetual leases are nation wide. The tasman pulp and paper mill is on a 99 year lease which started in 1955 with rights to renew also promised jobs to the whanau unfortunately it was a handshake promise from the cunning man Mr fletcher.

To suggest multiple ownership of land is unproductive is not true. The businesses on the land can be and are seperate entities and be individually or collectively owned with rent obligations.
By rights, give the land back to Māori that is theirs by the treaty of Waitangi that the crown claimed illegally as long as it’s not land that has been on sold by them already. Let them charge their rightful rents for the leases up to NZ fair current rates but charge them the lands local council rates that the rest of New Zealanders that own land currently have to pay.

Aotearoa is a name first used to describe New Zealand by the colonial governor George Grey. Where he got the idea that this was the maori name for the whole of NZ is a mystery. However Grey was a romnticist, whose many writings about pre European NZ have largely been ignored by serious historians as bordering on fantasy.
and all archeological evidence and historical sites that has been found verifying this fact has been aggressively and violently suppressed and restricted from the public and anyone who mentions these facts is instantly labeled racist and threatened. cant have evidence of people here loooong before maori or it will make everything the claim and say make them look like ultimate hippocrates since the things done to and how they treated the prior inhabitants is leagues worse than what they claim pakeha has done to them
The value was totally to advantage the lease holders, business arrangement , Māori were left out of negotiations , only to reveal what costs they had to endure and adhere to regulations that disadvantage the legal owners , a no win situation , get back on the merry go round

A very clear view of the dark side of a paradise stolen. Rather telling that the occupiers of leased land threatened violence if they must abide by a fair settlement, but the owners, for hundreds of years, so obviously wronged, want a non violent legal resolution.

The system has given so much entitlement to Pakeha over 180 years that they have become entitled to the point if you take it away( entitlement) the will use violence like those farmers threatened to do, they don't have the intestinal fortitude to do the right thing or even better work alongside Māori in this controversial space. Māori will get justice, the system is crashing. Māori will be the paternal parent to the Pakeha soon, but we won't be treating them like how they treated our tūpuna, were not mean-spirited like they are which is were entitlement stems from.
And parties like ACT are just making it worse
True there's a lot of entitlement and unnecessary paranoia among some Pakeha people, particularly in the older generations. People will profess not to be racist, but if certain subjects come up like land rights or Maori language something dismissive will come out. A lot of it is ignorance and a lack of self awareness.
Without the lands from indigenous people, Pakeha or white settlers would have nothing to build on, to prosper with. Every country you hear about the white people/govt stealing from these people for centuries. Really heartbreaking to hear and watch 😢😢

Kia ora whanau. My partner Peter was interviewed for the Maori leasehold land doco. We purchased Café 35 in Tuatini/Tokomaru Bay three years ago. I have always respected Mihingarangi Forbes body of work however feel her editing of this show and splicing of the context as being unfairly detrimental to both him and myself which was disappointing. When we discovered the factual history of the area we were appalled & motivated to do whatever we could to mitigate the situation. We were the only leaseholders who spoke up & supported a petition against this injustice. We do not have the wherewithal to change Government wrongdoing, but legislation & compensation is required. Let's fight for that!
I appreciate his honesty and that you both seem to be reasonable, considerate and thoughtful people that are obviously just trying to run a business. It's very admirable that you were in support of the petition which is clearly at odds with your own financial interests but did it anyway so I commend you both for courage to speak out against this ongoing injustice. I feel sorry for any backlash Peter has received from this interview personally I felt that I understood his motivation for supporting the petition came from wanting to do the right thing and it was unfair to leave in some of the more awkward questions and answers around allowing the iwi to have the land back which was a pretty loaded gotcha line of questioning. Unfortunately despite it being one of the points that is repeated throughout the episode this shouldn't be blamed on the current lease holders so anyone with a brain should understand that this injustice was not of your making nor within your power to rectify and yet Peter and yourself chose to sign in support of change when you became informed of all the history and had to face the reality of what change could mean for you directly you choose what was right and not what was easy which stands you apart and in direct contrast from those lease holders in 1996 that actively protested and petitioned against the government's previous attempt to try changing/updating the Perpetual lease legislations stating how unfair and unjust any changings would be to them financially without any thought or empathy for Maori. We are the rightful owners of that land who have lost and continue to lose the enormous financial potential by that exact same legislation. Maori didn't just lose the land and the ability to control the land and its use but we lost our legal and human rights also having little to no way to legally take back the land except at extremely high costs despite already being the owner seems intentionally callous considering the lengths by which the legislation insures that the maori owners are blocked or extremely limited in extracting any meaningful financial benefit from the lease holder despite all this its fact that many Nzers think maori need to just let it go and move on already but these are the same ones that also look down their nose at us in our own country because they believe Maori get special or preferential treatment, many of whom make up the National and Act base currently railing against Te Treaty spouting one law for all and yet the specific laws they want to change are those that will reduce or diminish maori right right even further.
So thanks for being an ally you deserve recognition for standing up in support when so few would do the same in your position. All the best.

Very, very sad..!!! this sort of thing has happened globally..ie, the American Indian were put into reservations and delivered, food , only not all of it made it's way and many starved,.... the Wounded Knee history is also disgusting........ . Romans, enslaved the English, Saxons, too... Many injustices have been done , Greed, is so very evil, far too many innocent suffer from others demise. I've worked in government especially the Land Office. Leases in NZ were never mentioned in the TOW. They were introduced twenty years afterwards, at a time when the UK was getting rid of them. It isn't possible that the 21 year leases became perpetual leases 'by mistake.' Instead that action smacks of bribery or fraud.
Was the land sold? Or government compensation pay out?
Same thing done to my nannyma the orchard taken from her, I'm gonna try my hardest to get it back. She was the sole owner but somehow those that leased it now own it

Don't forget that Maori colonised each other in conquest. The Central Plateau is a good example. Many who call the Maunga their own originally came from the sea. Should they give whenua taken in conquest back to the original inhabitants?

The difference is a treaty was signed and this happened after the treaty was signed, not even that long ago in the big scheme of things.
Maori have been in Aotearoa for nearly 600 years, likely longer after archeological findings of a Maori Shrine dating back to 1200AD. Moriori were primarily on the Chatham Islands. A land of which was left mainly untouched until European colonizers went and drove the remaining full blooded Moriori to extinction in 1933.
The argument you make with Maori taking land and property from other Maori in this day in age is essentially stealing from your cousin and having to give what you stole back.
Your ignorant oversight is that Maori are no longer separate tribes in our collective struggle against systematic oppression.
Other than that, there is no recorded history between Maori first setting foot on Aotearoa and the first Waka that left the Polynesian Islands. But I wouldn't expect you to know anything regarding this situation, except for what you type into your search bar and paste the first result that appeals to you.

Perpetual leases need sorted. Maori are impeded by it but it is a general fairness issue! It would go a long way to help things .while the problems being fixed , similar but not such extreme issues exist with glasgow leases and leasehold land where the lessees are denied capital gain . By rights, give the land back to Māori that is theirs by the treaty of Waitangi that the crown claimed illegally as long as it’s not land that has been on sold by them already.
