    RO's in NJ are given out like candy. According to many fathers rights groups this is true throughout this country. I mean no offense to anyone who truly is a victim of DV, but too many parents (primarily mothers) use RO's as leverage in divorce and custody battles. Our agencies allow mothers to file false RO's in order to gain leverage and become the primary custodial parent. I know too many fathers who have lost custody of their children based on false RO's. With all the technology available we have many ways to prove a violent act occurred. I know fathers who had multiple false orders filed against them where a final RO was then granted based on hearsay - not proof. This is a disgrace. An RO should not be granted until violence is proven. What is very interesting is that police officers are directed to arrest the man v. the women when the perpetrator of the DV act is not apparent. I work with police officers who have substantiated this statement.

      The problem men and women lie for leverage and the liar never gets punished. That's the problem. If they fail the lie detector test then they need prison time for lieing. Ruining a person's life by lieing is just evil . The other issue is the system. The prosecution attorneys dont care fir justice and truth the only care about a win. No Matter who s lives they destroy. Again all of them should be done away with. Loose the right to practice law if you prosecute innocent people and dont actually prosecute the liar.

      My x just filed on me. She has been the abusive one, and now she is flipping the scripts and has a 5000 dollar lawyer. I dont feel very confident going into this..

      @@principlemethods5281 they must have prove beyond any reasonable doubt for anything to stick she can claim all she want but no proof its gonna get dismiss just stupid to go through the court for them just to throw it out

      @@demetriustompkins8469 yeah I beat the case. My lawyer said they don't need proof for restraining orders though, it just boils down to who was more credible and had more evidence. She was surprised that the judge flat out denied my x her ro though. She said she's never seen that happen.

    I was granted a protection order due to domestic violence and a head wound requiring medical attention. There where times I had to leave my home to escape/avoid physical, emotional and phycological abuse and sleep in my truck with my dog. He is on parole after serving 8 years on a 40 year sentence of trafficing cocaine with 32 years (less now) on the shelf. He has been back to prison and served 15 months in Ohio then to Kentucky for 15 months for violating the conditions of his parole by being convicted of domestic violence. Yet in the protection order HE was granted exclusive rights to the residency. He is in jail,IN JAIL once again for DV and I was removed,from my home, by 3 deputies because HE has exclusive rights to the residence.

      Hi there Elisa. I'm not a lawyer or giving you legal advice, but I would like to answer your question from personal experience. Emotional abuse is about control and manipulation. To gain power over another. One does NOT have to be physically abusive to be determined as N abuser or domestic violence. Emotional abuse includes any time a person demeans you by name-calling, threats, financial control, digital control (controls aspects of phones, computers, personal messaging, etc.), frightening you with what they know will hurt or scare you, threats of hurting you/loved ones/themselves if you leave, Isolation from friends/family, and many, MANY other tactics people don't even realize. I would suggest you check out womenslaw.org, www.psychologytoday.com/us/basics/emotional-abuse, and 211 for help you may need. There are more resources if you need them.

    What about if U R being charged, the victim is on your side, & didnt call the cops, & ur innocent of the charges. There was a "witness" who called the police, & The witnesses statement isnt even close to what is seen on the video. What do you do & how do you beat it? Especially when all 3 of our stories are the same as the video, & the witnesses story doesnt come close to what happened on the video!
