    Exactly Ken, the Tower of the Americas, at the south end of San Antonio, is 750’ tall with a revolving restaurant, was built for the 1968 Hemisfair, and it is in “G” Airspsace, so no LAANC approval is required for fly up to 1150 feet for Part 107 Pilots. Looking forward to seeing you again at SpinUp.

    There is another "yah-but" to think about. If you launch from a cliff, the AGL limit is in contour to the floor. So, you are supposed to fly so that you fly with the contour (keeping within a 400' layer AGL). I know this is a strange concept to you folks who live in flatville, but it is something we here in the bumpy west know about. Be well!

      You're right but it's fun to think about the situation. If you are adjacent to a 500 ft drop off, the minute you go over the edge you're in violation. If you start from the bottom and fly up you can never get over the edge because it's more than 400 ft...

      @@jerseyshoredroneservices225 the contour rule gives you a 400 ' blanket. So you're not out of compliance right at the drop off. You have 400' to start matching the AGL

      You could be right about that. I think though that the rule for 400 ft above a structure doesn't apply to terrain.

      You can be 400 feet above the highest point with in your 400 feet radius. Flying off a cliff isn’t a problem unless you fly passed 400 feet.

    Probably a good idea for you to stress in the video the fact that you have an observer with you to keep you legal when you put on the FPV Goggles.
    Even then, not sure if an over eager FAA minion would agree that the observer can legally be a camera man whose duties include keeping you in the frame while simultaneously maintaining VLOS on the bird.

    This is the loophole I power loop through when I fly at the Viewpoint. Flying over a 🛣 in moderation (one trip in each direction is good for me) is also something that feels unnatural to me but at speed & altitude combined with feeling the wind speed, it wouldn't take much to land on either side of the road.

    I hang internet equipment on towers for a living.. And it'll most definitely mess with your drone signals. Internet equipment is mostly in 900mhz/2.4ghz/5.1-6.1ghz. So be careful

    There's 1 tower in a town where I live that if I get too close to it the drone basically loses all signal hahaha, no idea how it does that, even if I am right below the drone with the controller antennas going forward (so the signal will go up, down and to the sides)
    Crazy stuff, good thing there's RTH

      I know how.. Look up what we call signal jammers, you can use them inside your facility but outside it is quite illegal. Some of us use them , CDMA/GSM/GPS/DCS/PHS 😉

    Still blows my mind that paramotor pilots can fly to 18000 feet is class e airspace in the US. No registration or license required. Yet quadcopters, even with licensed pilots, have all these restrictions.

    I'm looking for a similar rule for here in Canada, but I don't think we have one..... transport Canada limits us to 121meters (400 feet) agl, and that's it.

    This is a nice explanation of the altitude rule. However, using fpv requires a spotter.

    I did some inspection video of my solar panels and well yupp got to close to them and interference caused me to have no control and it crashed onto the roof that I did not want to get on top of personally,but had to in order to get my drone......lol....oops ,personal note ( do not get to close to solar panels.)

    Wouldn't "a hill" itself be still "ground level" ? Therefore, if you fly over a hill, you are still limited to be 400 ft AGL? What am I missing?

      You are still limited to 400' AGL over a hill, but the ground level changes while over that hill you are allowed to be 400' above that hill.

      @@oh-noe Yes, 400' above ground level. The only limitation is that you must be in class G airspace. You can not do this in controlled airspace.

    Whoa, whoa, whoa Ken….@ around 1:10 you start going over the terms of the 400’ AGL exception and three in “hill” and “topography”. I was taught only “structure” applies. In other words, a man-made structure. Does topography count ALSO?!? Because one question I never satisfactorily had answered is can a drone film and fly up and down a cliff with a drop more than 400’. Please clarify.

      They can visit but they don't have the authority to interfere with you. They may do it anyway but that would make them the criminal. If they call the cops they're going to have to explain why they think you're committing some crime.

    Ken i noticed that you are using Fatshark goggles with your DJI drone. I'm new to this but i like the idea because I can't see the phone screen that well in our Texas sun. What cable are you using, are you plugged into the tablet or controller and what apps are needed to do this? Thanks

      You'll need a mini HDMI to mini HDMI mail on both ends and a special adapter on your Phantom controller.
      Or, you can just use DJI goggles. The big white ones wirelessly..

    I have a hotel in my area that is listed at around 500’ AGL but it is near an airport with a 200’ max agl grid. I submitted an altitude waiver request with pages upon pages of material the FAA requires and after two tries, no go.

    Hey Ken...got a question. There is a building I'd like to fly that is within a 100' LAANC approval area with a possibility permission to 400'. This building is 750' tall and I can get within 400' of the building. Aside any local issues, will the FAA let me fly the building? I am Part 107 and current. I am also a Part 91 pilot but not current. I know I can't fly through this area being it's Class B airspace...but I ain't a plane. If a plane, I need to be 1000' over this building. Sort of complicated...ain't it. Bottom line, If I'm at 1150' with my drone, I'm not hitting a plane at 1,750'. Thanks for all your help to solve this mystery.

      You must follow FAA rules for altitude.
      This 400+ exception only works in Class G airspace.

      @@KenHeron I wonder how this is done? There's big bucks knowing how and implementing. I'm watching this Netflix show called 'Designated Survivor'. Its location is DC. Every episode there is a drone clip pushed in. Who the hell has permissions to fly a drone all throughout Wash DC? That alone is a skill...getting the permissions. From a practical point, I bet all the footage was shot in one day.

    I would agree with being able to fly near radio/cell towers in general. However being that I am in the wireless internet business I do know that WISPs do locate equipment on radio/cell towers. If you go near one of those it is very likely you will lose your drone.

      WISPs? What's that? Is that the round microwave antenna? They've been known to cause some serious trouble. I've had my signal transmission totally knocked out while inspecting cell towers but I wasn't aware that there was anything unusual on the tower. Maybe there was and I just didn't recognize it because I only had this problem at one particular site.

      @@jerseyshoredroneservices225 WISP is a Wireless Internet Service Provider. They operate on the same frequencies as do drones and home routers.

      Over the summer I flew around a lot of those but only had trouble on one particular tower. I must have done thousands of orbits, 50 ft radius from center, from above it all the way to the compound below.
      The company that hired me and a lot of others to do these audits didn't provide any information about what was on the towers. Most of the time it didn't seem to matter and we all knew to stay a little offset from the microwave transmitters.
      Guys that had the V2 phantoms seem to have a lot less trouble than people with the V1. Apparently lightbridge 2.0 is much stronger.

      @@jerseyshoredroneservices225 The WISP antennas will not be right with the major cell phone providers equipment. And it will be smaller. Look up Cambium or Ubiquiti to get an idea of what the equipment looks like.

    Yes, you CAN fly 400' above the tallest obstacle, but consider that regular aircraft can also fly BELOW 500' ABOVE those same obstacles. So I see no real reason to fly that high. Anything I want to see on that tower or building should be within at the most 200' feet of the top.

    I have a tower next to home that's 237 feet with so I can go 637 feet ? He'll No !!! I'm in the flight path of an airport. I get authorization for 400ft. I see planes and helicopters flying over at 1000 feet, helicopters 600 feet so I would never risk going higher than 400feet unless in the mountains.

    Ken, I have a very dumb question that I would love an answer to. I would like to fly in an area that has clifs 1000s feet high. What happens if I'm at the top flying at 200 feet and fly over the cliff were it would become (in a split second ) 1200 feet. What can I expect?

      As long as you are in class G airspace it should be okay. Remember the height limit is 400 AGL, above ground level.

    Hi Ken I have a question. If Class E5 airspace starts at 700 ft AGL at the location of a 1000 ft tower, does this rule still apply? From what I understand, class E airspace is controlled but doesn't require authorization UNLESS it starts at ground level. There is a Jan 2018 memo from Scott Gardner at the FAA which clarifies that, and indicates that applications for authorization are not required for E1, E3-E8.

      No.
      If going 400 above takes you out of class G airspace, this allowance can't be used

Is there a rule that specifies that this allowance does not apply to *all* controlled airspace, including that which doesn't require authorization? What would be the point of clarifying that non-airport Class E airspace doesn't require authorization if you can never ascend to 700+ feet without the structure exception, at least without a waiver? Thanks.

    I find it interesting the DJI can just Make up a GEO fence, but let me Fly as high as I want...What??? Yeah, they Locked my Drones saying I was in a Temp. Restricted Zone [ I'm NOT ], so I had to hack the Fly app to fly...good thing I'm Smarter than DJI...but that being said, when they DON'T have a BS GEO zone going, they let you fly as High as you want...doesn't make sense....

      @@KenHeron YES Ken, I know that very well since I've been flying Drones for 10 years and RC's for 55+. I stay below 400ft, but DJI doesn't stop you from going 1500ft. What they DO do, is make up their Own No Fly Zones. They put up a GEO Fence in my Area and Locked my Mini 2's so I couldn't Fly. Well, I called the FAA Field Office in Long Beach, and THEY said I am NOWHERE NEAR a Restricted Zone, Temp or otherwise. I also Checked the FAA Website, which has a Very Nice Map Showing ALL of the Restricted Zones, Temp and otherwise, that show's ALL the area's and WHY they are Restricted. And AGAIN, I AM NOWHERE NEAR A RESTRICTED ZONE. And I am NOT Waiting a WEEK to fly MY drones that I PAID for because DJI starts Making up some BS Rules on they're OWN. So I hacked the Fly app and I fly anyway. ONLY the FAA will tell me when and where I can't fly. By the way, when I'm Eye to Gimbal with my Mini 2?? Yeah Ken, I know I feel like a big guy, but I am NOT 11ft 9.....so I don't have a lot of Faith in DJI...but I do Love my Mini 2's...both of them...

    I just took a class for Part 107 and it was emphasized and explained in detail. Not a secret or a loophole at all. Take the class you will learn a lot more.

    Will that still work with all the software updates there have been since you first shot this? I usually can't even get up to 400 ft. The drone will stop at about 392 ft with a message saying "maximum altitude reached"

      You should still be able to opt out of a height limit through the app. DJI allows this.

    Ken, @2:20 you're wearing goggles and BVLOS. And this is supposedly a tutorial on how to fly within the rules? Another video had you flying with a VO in communication with a radio and using binocs, both outside Part 107 regs. If your schtick is all about waggling it in the FAA's face, they're likely to get the last laugh
