Wells Fargo Loses an Appeal (Not Rewarded for Dirty Tricks)

  • I have written repeatedly about this case...it shows just how dirty and abusive and arrogant the banks can be when they are attacking homeowners. In this case, the good court (both appellate and trial courts) stood up to Wells Fargo, and protected the rights of the consumer. (And the rule of law)
    These cases show just how fortunate we are to live in this part of the state where there is such dignity and respect for courts and for the law.
    I was glad to sit second chair as Michael Fuino hit this one out of the park!

    It is very convenient that the original note is lost so the bank submits a copy, ( probably that copy was printed from any computer). And the original mortgage or trust of deed is recorded with the clerk.

    Wells Fargo foreclosed on my family's home without having the mortgage, the note, or even the date the mortgage was assigned to Wells Fargo. And according to a document I received after I was forced to short sell my home to avoid the foreclosure (just after my husband unexpectedly died at the age of 46 and at the bottom of the housing market in 2011), it was because my mortgage never was assigned to Wells Fargo. The company I had refinanced with a decade prior still had my valid mortgage.
    All the lawyers I talked to refused to help me, because "all the judges are bought out by the banks," according to those lawyers. Wells Fargo is a criminal organization who essentially stole $250,000 in home equity from a recently widowed woman with young children.

    This is NOT isolated, WELLS FARGO DID WORSE TO ME!
    I was offered a 6 month forberance after a car accident& told I would have the option to extend the loan at the end an extra 6 months or pay the monthly payments minus any interest at the end. 3 months later I received notification that not only had my house been placed in foreclosure but that a summary judgment had been given & my house placed on auction. I was never notified of any of this prior too the foreclosure & most assuredly not of any court date. I fought them for the last 8 years through the worst financial period selling my life off to pay attorneys. They would back off then wait & refile again making new filings as if the ones dismissed for unlawfully filing previous not applicable. Each time without notice to me or my attorney. They did this every year & a half hoping to catch me without an attorney or money to pay one. They had multiple conflicts of interest provided a jail address as the listed address for the filing attorneys, address. Then most recently snuck in a summary judgment within a commissioners review without notification. Stating that the commission couldn't speak to me because of the conflict.
    The Master commissioners husband works for the law firm representing WELLS FARGO. They notified me the sell was stopped due to this conflict and a special commissioner would be appointed who never contacted me. Then I start receiving weird notices implying my house was sold. I called & commissioner can't discuss details, and special master commissioner doesn't have the file to know how a summary judgment was ordered. Not providing me the legal 90 days notice to appeal & suggestions they had auctioned the Property off you guessed it to themselves, sister corporation. Kicker I paid every penny of the 6 months in full at the end of the 6 months. If ANYONE out there knows of a Social Justice Warrior working in the UNCOMMONWEALTH of KY who can help me save my home I would be very greatful. I am a single mom who saved for years put $15,000 downpayment & took a conventional no ARM fixed rate mortgage & was late on only 2 payments in the 6 years preceding this.
    I don't deserve to lose my children's future for corruption of this magnitude. Anyone who could help I would be greatful! If I could get a dismissal with damages I'd be happy to pay out of settlement or remortgage a small loan and donate it to any helping Social justice organazation of attorney's to help pay for others fees to do the same for another person on my position.

      Send a letter to your State's Attorney General. Specifying all that has happened, with a certified copy of all documents you have.. Send via UPS or FedEx signature required (this lets you know it was delivered). Ask them to look in to this for you.
      We had problems in California with our house that started to go into foreclosure. Over two years of trying to get them to modify the loan, borrowing money from friends and family to stay afloat. We finally asked the bank for proof they held title to the deed, under RESPA they are required, by law, to provide this to us (its either in 30 days or 60 I can't remember). Their response to that was to say there is no need for us to see that, so they are not providing it. We asked again, and again they refused to give it to us. So this was two violations of the law. We then went to the CA AG (who was Jerry Brown, now governor) and sent them all the files and the two refusals to comply under RESPA. Shortly after that we received a letter from the bank saying they had done nothing wrong and that they do not know why we sent this off to the AG. Two days after that we received a certified letter with a loan modification at 2% for the life of the 35 year term.

    I was screwed over by a bank myself, but I had a double wide. Anyone who gets screwed over and the bank commits fraud and they have a mobile home, if they don't have a title on the home then they can't touch it. In my case my lawyer found out they didn't get a title because the home was sitting on a foundation, and the wheels were removed. Yet that doesn't matter, it has a title so they had to put themselves on it. Because they didn't I was awarded my home free and clear, but the bank got the land, I just had to move my home. What brought this on was, I had went to refinance and the bank didn't pay off the original loan so I wound up with 2 loans in the amount totaling $500,000 for a freaking double wide!!

      Giovanni Pincoletti Place a oder of cease and desist. Seek some qualified consultation, like its retired lawyers you can find for advice. The courts have to give you remedy.

      Definition of BAR : In law, the bar is the legal profession as an institution. The term is a metonym for the line (or "bar") that separates the parts of a courtroom reserved for spectators and those reserved for participants in a trial such as lawyers.
      Not an acronym of any kind , your post is sovcit conspiracy theorizing , and is more than a bit silly.
      No , it is not a corporation, the Bar is half a millennium older than the first corporation, and is modeled on medieval holy orders, so is not meant to make any more money than it needs to operate, so it's an non-profit group, for all the greed of much of its membership.

    try to go into any bank with a copy of a note and see if they will cash it... NOT!further leave the "Pay to the Order of________ line blank and see if they will cash it even if it is an original and see if they will cash it without a date.. Not! so how is it possible that for a two dollar or twenty dollar note, the banks will not cash them but the courts can cash two three and more Hundred thousand dollar notes, it is perfectly acceptable?? If it is an affidavit by a banker or attorney then it is most assuredly a lie, false, fraud etc...Oh and lets not forget that the only reason for an "allonge" when there is no room for a signature on the original instrument... which I have yet to see any Note which does not have enough room for several signatures... so the allonge is a fraud and it is supposed to be a "slip of paper, permanently attached.. not found later on etc... only those engaged in fraud need to do such things so it is self evident.. Oh and lets not forget that there never was a "Loan" by definition. so no possible loss thus no standing... I could go on for hours of all the BS of the banks which actually generally are not the ones fraudclosing but criminal third party interloper, carpet baggers who represent no one and file lots of fraudulent documents... the fact that there is no letterhead of those documents allegedly written by vice presidents and other illustrious persons holding high positions... and I can almost guarantee that the alleged original if they pretend to have it is actually a forgery. I have a simple forensic techniques which will show they are forgeries, counterfeit.. 20 years, plus uttering and passing another 20 years.. (see 18 USC 471 through 474....anyone want to help put together a 42 USC 1983 and put an end to all this crap? truthmonger6@gmail.com

    To bad these videos DONT speak to how the court ruled. The Headlines Make it seem like Wells Fargo got caught speeding. Is it true?
