    The bottom line is that the Supreme Court is not delivering justice based on the law, but based on the judges' own inclinations, and with the connivance of forces outside the court.

      The bottom most line is that there is not one single institution that is not corrupt. Almost all of us are buyable, so why not the judiciary too? Those in the game of power need people / institutions who can be bought and be manipulated. And so the game goes on.
      And it will go on till all is lost and we have to rediscover our Self and learn to live by values that support it. Until then …… it’s going to get tougher Sir!

    We really owe thanks to The Wire for bringing up one of the most important issues on judiciaries. The judges are mostly seen bias not giving judgements in accordance with the Rules of Law. Some honest judges are immediately transferred when on the verge of giving honest judgements. People have started to lose faiths in lots of the judges with their amazing judgements. The Wire are humbly requested to continue with these kinds of Debates in future involving fomer & present competent & honest judges and advocates so the corrective messages reach to the House of Judiciaries and the Governments. Thanks.

    Respected Sibbal ji, I am ex Police Officer, having worked in Mumbai Police for over 36 yrs n have retired in 2004, being one of the most decorative officer. During my tenure, I have attended several courts right upto High Courts n have seen the Politician,s from close quaters. As far as my cases are concerned, I have not found any Politician interfering in a y of my cases, except one, which was between two industrialist, which I would like to maintain annonimity. I would have appreciated, if you would have asked direct question to Hon. Justices with regard to the judgements in the following cases. 1) Gujrat Court Judgements by all the Gujrat Courts, in giving verdict in Rahul Gandhi's case in awarding maximum punishment, probably for the first time after the Independence. 2)Was it proper for Justice Ranjan Gogoi, to hear a case in which allegations were made against him of sexual harrasment by the staff member of the Supreme Court. He not only hears his own case, but he dismisses the lady b her disabled brother in law . He goes to an extent to ensure, that her father and brother working in Delhi Police is also dismissed. He was one of the four Judges, who had the press conference in which Justice Lokur was present. It was then , one of the Judges has categorically stated that the Democracy was in danger n had also mentioned about the case of Judge Loya, which was assigned to a Junior Judge. We saw the outcome of the case n what, I observed, that the attitude of Justice Gogoi had changed, which led to the Judgement of Babri Mazid demolition case. He was awarded with the post of BJP Rajya Sabha member, within weeks, after he delivered the Judgement. This , therefore raised the eye brows of several persons, particularly those from minor community. 3) Was it proper for the Supreme Court to appoint Sr. Adv. Harish Salve as AMICUS CURRIE, in the case of the then C.M. Narendra Modi, being fully aware, that he was the Solicitor General during the Vajpayee Govt. n till date, he defends the present Govt. in imp. matters. Can a person in proper sense, believe, that he would present an unbiased report against any BJP leader. Let me make myself clear, that I am neither a Hindu or a Muslim n have no affiliation for any political party. If anybody is hurt, by the questions I have raised, I tender my unconditional apology, since I was only keen to know, whether the above Judgements were on the basis of facts/ Political pressure or emotions. JAI HIND.

      Not a single judgement of our SC/ HC has ever been beneficial. Why the judges take decades? Why contrary verdict, ? Trial court order, single bench HC , two bench HC, single bench SC, double bench SC, all r different which we have no law & judgement is as for a particular judges wishes.
      2nd How the low meritious llb judges r expert in military, finance, PM security,, medical etc.
      Who is judging the judges ? The judges r holding court in train couch if short of service which means there is no boundary of their power & they r not accountable to any one.
      The worst judiciary in the world.

      @@Harshit52627 it took 2 decades ,that is our judiciary. Had modi & jogi not at the helm it would have been till undecided. It's not the verdict but background negotiations.
      How the judges of Kolkata HC r fighting? , shame to our low meritious collegium judges.

      POINTS TO PONDER: JUDICIARY IS A CORRUPT ANTI NATIONAL OLIGARCHY
      IT IS TIME TO FIX JUDICIARY ( Unelected Opposition Party)
      1. There have been 50 Chief Justice of India since 1950 (in the last 74 years). IT IS A JOKE
      2. Sh. H.J. Kania was CJI for only 17 days (25.11.1991-12.12.1991). Sh. Patanjali Sastri was CJI for only 29 days (2.5.2004-31.5.2004)
      Other Statistics
      Number Of CJI-- For Less Than 2 months =4
      For Less Than 3 months =6
      For Less Than 6 months =11
      For Less Than 12 months=22
      For Less Than 18 months=35
      For Less Than 24 months=37
      It should be noted that once you retire as CJI even for a day , you get luxurious retirement benefits-big house, pension, servants, security etc. etc. costing a few crores every year.
      What was underlying intention to appoint anyone CJI when it was known that he was going to retire in a few days or months? IS IT FAIR TO SELFISHLY BURDEN THE POOR CITIZENS OF INDIA?
      Why CJI appointments are not made for only those e.g. with minimum 2 years’ service left and on merits? Not every judge is “equal” once he manages to enter the system, so why appointments are seniority based? Quality of past life-time judgments, no. of judgments over-turned, character, patriotism etc. must be factored in to select a competent CJI
      3. Sh.Y. V. Chandrachud was the 16th CJI and served for longest period of time (1978-1985, 7 years 5 months). His son (present CJI) Sh. D.Y.Chandrachud is the 50th Chief Justice of India in the last 74 years. Is this not nepotism. There are other cases of alleged nepotism-induced appointments to SC/HC and CJI post and that calls for transparent and better selection system. Remember poor public is feeding them without any accountability built in the system. Even God is accountable sometimes?
      4. Since selection to CJI /SC JUDGES posts are NOT TRANSPARENT , merit is ignored. Once they rise up in the system, they pretend they are above God ,omniscient intellectuals who can sermonise elected PM, President, ministers and of course, the abominable public. If they were so brilliant they would have become engineers, doctors,scientists etc. Right?
      They start running oligarchy-own masters without any accountability although rest of the citizens must be accountable. No one can touch these self-appointed Lords.
      Elected leaders created fraework of judiciary and now they are not willing to listen to them or the people of India. Outrageous,Nonsense.They must be crushed and pulverised
      There are grave risks of an incompetent person managing to manipulate the system and sabotage Hindu Rashtra by behaving as a paid anti-national or Unelected Leader of Opposition.
      As a first step, Supreme Court should be relocated to Galwan valley or Atari border -on the line of fire so that they face consequences of their anti-national judgments. They need to be dragged out of their ivory tower and made accountable to bring them to their senses. JUDICIARY NEEDS TO BE CRUSHED. India needs to be protected from ENEMY WITHIN.

    What a soul searching and illuminating discussion emerged with the three eminent former judges and Mr. Sibal. Of course it is another issue whether corrective steps will be taken by the apex court taking suo motu cognizance of the issues thrown up by these eminent persons.

    As an ordinary citizen of the country i am sorely disappointed with our judiciary for not being there for all those knocking on their doors for justice. I pray that there is a change in the attitude of our judges towards delivering justice. God help.

    Thanks so much to the Wire and Mr.Kapil Sibal for this excellent presentation. Judges come from different back grounds and will definetely have different views on their understanding of Laws. The Utmost and final understanding should be based on pure logic and impartial and should cater to the highest order of Truth and Righteousness. As one of the Hon. Judges spoke that like in the US, the Judges can group together and go for a discussion in private once or twice if necessary and come to a final decision. We look forward to hearing more of such great discussions. Thank you.

    It is very disappointing to see several cases of civil liberties getting adjourned by the SC. The current Collegium, Chief Justice and SC judges should take steps to restore the faith of citizens. There should be a quick hearing and resolution of the Electoral Bonds and CEC related cases, otherwise this country will become a complete autocracy.

    Everybody should be independent not only judges as they have not fallen from heaven. The pm , military , Parliament shall be independent & judiciary has no right / expertise to intervene.

    Judges these days give every thing except Justice & they sit on Judge Seat but Stare on Parliament Seat. It’s a brutal truth. Remember Babri Masjid, Godhra, Justice Loya, etc.

    If the Judges have ‘justice’ as their intent and motivation we would not have so many speed breakers in law ! And because we don’t have that , we can keep pounding our heads not much will be achieved!
    Sirs ! If you all the gods of justice are so fractured , we are living in the fantasy world of democracy . There is, realistically speaking , no solution !!
    Extremely grateful for opening the eyes of likes of me who has no idea of the manipulations taking place at THAT level!!

    Yes action is required when something wrong is done by the high court judge..very interesting discussion regarding transferring of judges.my view is judges should be more liberal for granting bail.

    Like Justice Patnaik said by constituting a larger bench immediately the divergent views were reconciled. What was done in case of Indore and Gwalior, same could be done in Supreme Court.
