    I think it would have been helpful to mention who is most at risk of a home break in and what signs are these burglars looking for.

      I think we're relatively safe. We're in a first floor flat, they'd need a long ladder to get to any of our windows, and the front door opens onto an internal lobby with another door to the outside, which has armoured glass. The drugs squad went to one of my upstairs neighbours once, after someone made a false report that he had drugs (he didn't) and I counted the hits from the big red key; it took 19 of them to get in..! It would have been funny had his two cats not been absolutely terrified.

    A friend of mine had a full body mannequin dressed up in a hoodie and pants, put it face down inside his hallway at home with a knife in the back and theater blood sprayed all about. He thought it was hilarious to have friends over for the first time but claimed it was to protect his home from burglars.

    In some states in the US (Texas springs to mind) it's perfectly legal to shoot someone if they come on to your property. I heard of a case where someone knocked on a front door to ask for directions. The homeowner opened the door and shot him. No case to answer, apparently. The US is a crazy place, I'm glad I don't live there.
    In my opinion, any injuries sustained by a criminal during commission of a crime should be deemed self-inflicted. If he hadn't broken in, he wouldn't have got hurt, would he..?

    The problem with the law is not allowing self defence tools so ex special forces guy may be able to defend him self against 1 man but he does not know whos coming through his door so what if its 3 big men but hes not allowed to have pepper spray or a bat because by having it for said reason its now a offensive weapon. Americas laws may bit a little to extreme for some but at least they protect their innocent over criminals. Would like to see harsher sentences for burglary and more money from council tax to go to the police so every town can have a dedicated team to put more resources into catching them.

    If someone breaks into your house, how does the law expect a risk assessment to have been carried out, how can I know what their intentions are and what they are concealing, they could be there to rape and murder, what would be deemed "reasonable" in that situation?
    I have to assume they are there for the worst of the worst and act in accordance to that. I have a family to protect and I would rather be sentenced to prison for using excessive force than have to live knowing I could have prevented someone I love being harmed.
    Genuinely looking for discourse, not just trying to say "I'll kill 'em"

      I think it is better explained by a lawyer. The from what I understand the law basically says if you believed were in imminent danger you can use that proportional force. So the test is not how much danger you were in after the fact the test is how you perceived that danger at the time.
      It is best not to say anything at all until you have talked to a lawyer. As you can incriminate yourself. Simply saying they deserved it could be enough ammunition to discredit you.

      I agree with this - to me (as a person who is very safety conscious and keeps all doors and windows locked at all times) someone intruding in my home is immediately a threat to my life and my family’s because I have done everything I can to keep them out. Even if that person is only there to steal and not cause me any harm, the trauma that I’d live with after that situation would do me a great deal of harm. I don’t know their intentions and they have violated my safety by being there. I would always interpret that as a threat to my safety and life. Like you’re saying, I’m not saying I’d kill anyone in that situation just because they were there - if they saw they were caught and scarpered I’d not try to stop them but I’d also react most likely by using something as a weapon immediately to protect myself.

    The law around what's reasonable in these circumstances was clarified a couple of years ago. It allows you to use force that may, with the benefit of hindsight, be disproportionate.
    So if you overreact due to the fear you felt in the heat of the moment, then that is still reasonable.
    It was sensible as it gives the defender the benefit of the doubt if their actions maybe went a bit too far.

    The best way to think about how you are "allowed" to deal with intruders, is think of it as proportional.
    You can match the threat that they pose, with equal force.
    If they have a knife, you can have a knife.
    If they try to stab you, you can stab them.
    If they fight you, you can fight back.
    But you are not strictly speaking allowed to overmatch the posed threat of the intruder.
    Such as stabbing them in the back as soon as they walk through the door for example.
    Verbal threats count as well it's worth noting.
    Even if they seem unarmed.
    If they say they are going to stab you and your kids.
    You can pick up a weapon and kill them.

      This is incorrect. You can use "disproportionate" force to defend yourself against intruders.

      If you wait to see if someone's gonna stab you or not, the moment you get to realize it is the moment that you're already stabbed a few times and are watching them doing whatever they wanted to do while bleeding to death. Either don't do anything or go at it with full force.

      @@mammadtori3964 this is my point! Unless the person immediately runs away when they see you, you don’t have time to wait around and see if they’re willing to hurt you or not. It’s kill or be killed - I wouldn’t wait around for someone to attack me before I protected myself. Them being in my home in the first place is a threat in my opinion. Obviously I wouldn’t stab someone and keep stabbing them once they were ‘down’ but I feel like I should be able to do what I need to do to get them ‘down’ without performing a risk assessment first. If they don’t want to be hurt, they shouldn’t intrude in people’s homes. That’s obviously a risk they were willing to take!

      You also have to take into account that they have already violated you massively by entering into your house with the intent to steal from or hurt you. Whereas you wished to do them no harm before the crime was committed.

    If your house gets broken into. The best thing you can do is tell the police you are filming outside with a camera. That way several cops will actually turn up, within seconds.

      No they won't. I reported an attempted break in to my house. I know exactly who it was. I even have video footage of the same person damaging my car. With regards to the car video, the police said they can't do anything and with regards trying to break in to my house, I was told I would get a call back. That was 2 weeks ago and still waiting. If they can't be arsed phoning you back, they defo ain't going to come out to your house. I have several recorded phone calls and been writing everything down because if the shit hits the fan, I can at least show how incompetent the police are and that I followed the right procedures. Fighting crime is not their job anymore.

    I watch a channel on youtube about lockpicking, (I wont say the name) because since I subscribed to it 3 years ago I havnt had a good nights sleep since, I went online and bought a lockpicking set and within an hour I had picked my front and back door Euro lock's and inner Yale lock multiple times, I bought high security padlocks off ebay with security pins (spools and serrated pins) and picked them also, granted the security pins take some practice but most common door locks dont have security pins.

      Whilst there are a few people out there picking locks for burglary, they are very few, and far between. There is a common phrase used with locks, about how they only keep honest people honest. The thing is picking or otherwise exploiting locks (bumping, raking etc) isn't discrete, and in the field isn't nearly as straight forward as a low pressure situation (picking a lock at a table for practice etc). It isn't even remotely commonly used to enter properties.
      Most burglaries in the UK tend to be crimes of opportunity. Now some burglars spend more time on reconnaissance than others, and methods of entry vary but by far the "favourites" are:
      - get somebody to let you in (generally targets elderly and physically vulnerable, often done by pretending to be a representative of some utility company)
      - distraction (two person method where one knocks at the door and distracts the occupant while their partner burgles the property. Often gaining access through an open door or window)
      - Unlocked door (this one is common. With would be burglars walking along a street just trying door handles to see if they open.
      - Open window
      Burglars want to be in and out, not messing about trying to pick or bump a lock. It's much like cars, a half decent lock is generally enough, because your primary aim is to make your property uninviting to a criminal.
      It's a bit weird to say the next bit after having just listed a bunch of ways burglars commonly used to access people's homes, but I hope this makes you feel a little better about locks. Of course, continue to buy good quality locks, and buy good quality exterior doors and frames, with multiple latching points. And don't use those "Yale" style front door locks that have the turning latch on the inside (so you don't need a key to unlock them from inside) which are still quite common on houses in the UK. They are never really locked, because breaking a small window in/near the door, or accessing it through the letter box will allow the thumb turner to be used from outside the house.

      @@jaimedeoliveira9216 absolutely, I didn't think to discuss the HMO situation. That is one of those trade off situations where it is important to put the accessibility to unlocking for each resident before ultimate security.
      Putting security caging over the internal thumb locks, so they can be easily used from the inside, but are significantly harder to operate from outside the door is probably the best available option. But as you rightly point out, locks like that must be used; but hopefully the landlord is putting in place other security options which ensure the building is not a particularly desirable target when compared to other properties in the area.
      As cold hearted as it sounds, a significant amount of preventing a property being burgled is about making it more difficult, and less attractive than other buildings in the street/immediate area.

But to me at least, I think an environment where everybody’s homes are secured like fortresses only gives the impression that such a society lives in fear, and the criminals are somehow in a position of power over the local population. In a way, it’s comparable to asking women to dress modestly in the streets so they don’t get assaulted.

    Homeowners' tips on what to do if you're getting burgled. Be proud of what you've earned and worked your whole adult life for, and kill for what you'd die for. In my house, there is no law. Anyone that attempts to take from me WILL be trading their already miserable life.

    It's alright people saying what's reasonable when they're sat around chatting, but in the heat of the moment, as you're fighting someone, reasonable becomes a very different thing.
    Personally, if I catch some twat in my house, he'll live, but he's getting kneecapped and having his fingers smashed to pieces.

    Okay, here is the situation you encounter a burglar and your allowed to use reasonable force to protect you or your property.
    In the middle of a stressful robbery how can you think what is reasonable. I not sure I could do anything to protect myself if I had young children that would be a different story altogether.

      That’s what I was thinking - if I was alone at home or just me and my child and someone broke into my house - especially if it was a man - I know I can’t use my fists and physically fight this intruder the way my husband could. So I would need to use a weapon. Obviously I wouldn’t want to kill someone ever but if I felt threatened in my own home I would definitely use a weapon of some sort. Providing that person didn’t just try to scarper as soon as they were discovered. I’d do anything I could to get them out of my house and away from me. How do you know what’s classed as reasonable in a situation like that? Would it be just the reasonable belief that your safety was threatened? Because even if someone was in my house but wasn’t necessarily threatening me in any way I’d feel like their presence there is threatening in itself - especially since I’m very safety conscious and always keep my doors and windows locked. It’s my biggest fear I think, finding someone in my home 😩

    Interested to know the law surrounding a dog protecting its home. I.e. if someone broke into my house, while I'm in bed upstairs and my dog bit them. Would my dog be siezed as a "dangerous dog" purely hypothetical, heaven forbid. Keep it up Ben 👌

      Depends I guess, if its trained as a guard dog then its fine because it will bite once and hold to detain, but dogs that are untrained might continue to maul which is above reasonable force, and unfortunately in law dogs dont really have much of a chance, theres loads of cases of peoples neighbours being bit because they go into peoples gates and the dogs get annoyed and start barking and then Ive seen vids of people like swiping at the dogs to get them to go away, the dog then bites because it thinks its being attacked and it still gets seized. Which is really unfair but they dont have the equality in law as people do obviously. Just guessing tho

    Yeah as a firearms owner the laws are very strict on self defence with a gun. Though i doubt if any criminal is going to hang around for you to open the gun cabinet then the ammo safe then let you load it they probably need their head testing!

    Ben, I'm currently a serving prison officer and I'm in the final stages of jumping over to the police. Do you have any tips for people starting out? I've dealt with quite a lot of "whoppers" already but I can imagine it's going to be vastly different on the street

      Best advice is to keep accurate records of everything you do, cover your arse and watch your back. Your biggest enemy is the management. Don’t trust any of them.

    So the lesson is, cripple, don't kill, and make sure he's found with some type of a weapon on him that doesn't have your fingerprints on it. If you don't have a backhoe and live in the country. They're also among the lowest form of scum on the inside where you don't have much to begin with but the penalty is swift and severe. This is where the two systems should see eye to eye instead of producing a class of rich lawyers and streets full of scumbags without fear.

    7:50 You are to use no more force than absolutely necessary. Weapons must be used only as a last resort. For example, you can’t shoot unless your or someone else’s life is in immediate danger and there’s no other way to prevent the danger.
    You can’t use more force than absolutely necessary and weapons can only be used as a last resort.
    You can only use force for the protection of human life and not to protect just property alone.
    A verbal warning must be given first unless this would increase the risk to you or others (an intruder sneaking up behind a victim) or you’re already under attack.
    If you could use a gun in self-defence. The law states you can only fire well aimed shots, you fire no more rounds than necessary and you take all precautions not injure anyone other than your target (you couldn’t blast away using a machine gun and as soon as the bad guy is no longer a risk, you can no longer fire).

      But the point I’m trying to make is, how restrictive or strict the law is when it comes to self defence. You can’t just shoot or stab an intruder.

The law says possessing any item with the intent of doing harm to another person with that item is illegal, there is no exception made for items possessed for the purpose of home/self defence.     I remember a guy who broke into a family home and he had a knife on him. He claimed that he wasn't going to use the knife.
    A family home remember.
    The dad woke up after this guy made noise down stairs, the dad went downstairs in his pyjamas to investigate what he assumed was probably nothing.
    The guy who broke in was laying on the floor next to the front of the living room sofa trying to hide.
    The dad only spotted him when he went to check the living room windows.
    Now imagine that scenario, you wake up in your own home at night while your wife and children sleep, you go to check it out most likely thinking it's nothing serious, you're wearing nothing but pyjamas - you find a man hiding on the floor with crazed eyes in your living room and he has a huge kitchen knife, he is inches away from you.
    The dad, just woken, in his pyjamas lunged at the man in his home, they scuffled.
    The man claimed that the dad fell on the knife.
    The dad died from his injuries.
    The man went on to tell his story, and laughed while he remembered the occasion.
    The dad was buried and his family were left to live a life without him and live in fear and nightmares.
    The man received a long time in prison, but not a life sentence.
    Now imagine if the dad lived in a country where we are ALLOWED to defend our home and family at ALL costs.

      Not sure what your point is but statistics show he'd be more likely to get burgled in the first place and more likely to end up dead during the course of the burgulary.

      I would say that a burglar has a knife and the only weapon that you have is a gun then it is "proportionate" to use it. I would argue that if it's all I have then my choice is between no weapon at all or the one that I have.
