If the motion to oust the President passes the National Assembly, it will be sent to the Constitutional Court.
Our Kim Do-yeon explains what might happen there, considering the court currently has three vacancies.
If the National Assembly votes to pass the impeachment motion on Saturday the Constitutional Court will review the motion to see if the impeachment is indeed constitutional.
The justices have up to 180 days to come to a conclusion, but the past two impeachments didn't take that long just two to three months.
Two thirds of the Constitutional Court justices need to approve the impeachment for President Yoon Suk Yeol to be officially relieved from his post and to kick off a presidential election campaign season.
Right now, there are only six justices on the bench with three vacancies yet to be filled.
This means if the Court's review starts with the current line-up of the bench without new appointments it only takes one justice to be against impeachment for President Yoon to keep his job.
If the three vacancies are filled in time, it would need four judges against to turn down the impeachment motion a totally different landscape for those looking to impeach the President.
The vacancies are from the three seats that need to be recommended by the National Assembly.
Originally, a minimum of seven justices were required to conduct hearings, but the enforcement of that regulation has recently been suspended.
This caused the justice recommendations to be not a top priority before, especially with the two main parties having a hard time reaching an agreement on which judges to recommend.
But with the current turmoil from the martial law declaration, lawmakers have moved quickly to make recommendations.
As of now, two have been recommended from the main opposition Democratic Party of Korea and one from the ruling People Power Party.
Should the hearings pick up speed and the three be formally recommended it will need presidential approval.
If the impeachment motion at the Parliament is passed then it'll be the acting president likely current Prime Minister Han Duck-soo who signs the appointment of the three justices.
