    Open Car parking builder ne bechi hai humare society me... land development charges kar ke paisa liya gaya... Aur society iske liye kuch nahi boli kyu ki society ke secretary and chairman or kuch member ye society ke employee hai

    I just signed a BBA but in the price breakout builder not mentioned parking..but the same is inclusive in booking form...but in BBA its mentioned in 3-4 paragraph like allottee applied for an apartment in builder with apartment with apartment number and carpet area number along with a garage/covered parking ____ and area 135 sqft..so does it look good?
    like this he mentioned below like promotion ready to sell and allotte ready to purchase the apartment along with car parking
    is it good or I need this in the breakup as well? The builder said as it's an inclusive with apartment no need to mention in price breakout

    Stilt parking selling by builder and FSI of the parking space. Explain
    * Builder has made agreement mentio ing only allot ment but not any parking cost is shown then ?
    *If Builder has sold out the stilt parking to members which is illegal and the Management comittee also not doing anything about it as they are also the party of allotted the parking place, then in this case what action, the members can take? To whom they should complain ?
    **Can you as Soc. Lawyer take this case to fight and teach them a lesson ?
    Please reply. I am too much interested in this matter to push further for corrective action

    Purchaser is given the exclusive right to use of open reserve car parking and allotment is made ex-gracia for beneficial enjoyment of the same. Eska kya matlab hai maam kya parking builder kr through allot hogi

    Can I purchase covered parking space from builder as my building have common parking space and i want my separate one. ( no society form yet)

      If builder is ready to make an agreement for purchase then you can purchase it.

      If your flat registration is already done (without parking space) then you cannot purchase a parking area.. however builder/society can allot you parking space by giving parking allotment letter...

    Thanks for this video, my society has 10 houses and our builder of the society also lives in 1 of the houses. He has 4 cars and parks his 2 cars in common area of the housing society. Whenever any other resident of society parks their car in that spot, he says “This is My spot, nobody should park this car in My spot”. I told him that it is not his permanent parking spot and any member of the society can park his car there on a first come first serve basis. But he still insists on parking only his car there and would send either someone or come himself to our house if we park the car in those 2 spots which are actually reserved for everyone and not just him. So what should I do in this situation?

      You may discuss this matter in AGM and if he has 4 cars then he cannot park the entire 4 cars in one building. Open car space can be allotted to members who are having car. That you can do.

      @@shivconsultancy thank you for your response. He told me that RERA Act related to Parking doesn’t apply to the state of Gujarat where I live and certainly not to housing societies. Is he right? Besides RERA, is there any legal act in India that I can show him that confirms that a builder doesn’t have exclusive parking right to car spots in the society just because he has built the society? He thinks as a builder he gets special powers from the government which I know and everyone knows is false but if there is any legal act that can help me in this situation then at least showing him that act will remove his doubt of his exclusive rights to common parking spot.

    Thank you Ma'am, very informative lesson. Ma'am kya builder hamari parking space unake construction material rakhane ke liye use kar sakate hain? That's why we can not able to park our car 😢 in our allocated parking lot. Please do the needful and reply. Thanks in advance 🙏

      Agar aapko car parking allot Kiya hai to builder usme kuchh rakh nahi sakte

      @@shivconsultancy Yes parking allot kiya gaya hain. Because construction ka saman hamari parking space par hone ki wajah se muze meri gadi dusare jagah par park karani pad rahi hain. Thank you Ma'am for your reply and help.

      @@shivconsultancy Yes, but they always reply ki CRM team will take care of it. Pata nahi kya chal raha hain. CRM team se baat karati hun to bolate hain by tomorrow will clean the space and again after two days wahan par construction material hota hain 😒. Ek month se yahi chal raha hain.

    Mam plz reply , mere bhai ko builder se open parking allot hua hai. Unhone society ko temp base per use covered karne ke liye Mail Kiya hai..now jinko stilt parking allotment hua hai wo open ko allotment karne ke liye rok rahe hai ..wo unke guest ke liye bol rahe hai ki open ko open rehne do...kya yeh leagl hai

      Actually open parking ko aap cover nahi kar sakte, ye illegal hai.

    Mam namastey meri car parking alloted n 1 laksh dekhe purchase kiya... Meri car nahi bike hai... But kuch saal se sablog apna bikes n cycles udar rakhrahai... My silent thee but ab rent me deneki soch rahi but kuch log against free me adadat hogaya.. Kya meri right hai rent me kisiko coownar ko 300 ya 400 rs me dasaktee? Khali nahi kiya abtak my kya action lesaktee hu.. My bahut req kiya mamji.. Ple reply iam widow nokids... Alone rahetee hu ji....

      Aap society ko letter dijiye aur aapne purchase Kiya tha uska document evidence attach kijiye. Lekin rent par Dene k pehle aapko society ki permission Leni padegi, kyoki aise member apne aap kisi ko rent par parking nahi de sakta. Agar garage hai to alag baat hai.

Oh tho permission nahi deta i kn bec unka bikes cycles rakha.... My akhele lady hu... Koi support nahi tha hus kareeda with parking ke saath oh hothey alag baath tab hamari khud ki car hotey ab nahi na islye oh sab mila tha.

    As per Supreme Court of India, builders cannot sell open or stilt parking to anyone. Your video is confusing as more focus is put on open parking only and half baked knowledge on stilt parking.

    Wrong advice. Even if it is written in agreement still it is illegal. What Law says is important than Agreement.
    Don't take advice from non lawyers on legal issues.

      @@shivconsultancy I had to point out because the point of agreement that if it's in agreement it can be legal is totally wrong and against Supreme Court judgments. Whether people have taken through allotment letter or whether it's in their agreement both are illegal. Byelaws and Act override contract.
