Republic Act 9048 as amended allows clerical or typographical errors to be corrected through a petition in affidavit form. This is filed with the local civil registrar or, for Filipinos abroad, the Philippine consul general. Know the documentary requirements, and sanctions for violation of the law. Hello po atty. If yung sa Mother's maiden name po ang mali (naka input po is Marriage name), need pa po ba i-file ng RA 9048? Ayaw po kasi tanggapin sa DFA need daw ipa correct. Salamat po sa.

Just saw your video. My question is, I am being required to submit my mother's records at the Civil Registrar of Manila to correct my middle name. It was an obvious misspelling as my mother's maiden last name is correct but mine was misspelled. Now, my mom passed away just less than 5 months from the date I was born. I don't have any of her records except for her birth, marriage and death certificate. And yet, LCR of Manila City Hall is still requiring her baptismal and school records. I live in Mandaluyong and she grew up and studied in Leyte. Plane ticket going to and from Leyte is much more expensive than the fee to just correct the misspelling of my middle name. Another is, copies of her school records may no longer available either if her records was not saved digitally at her school, knowing how Yolanda has devastated Leyte. Shall I need an affidavit regarding her records too or are my SSS, NBI and employment records be enough?
I just find this requests absurd as my Dad was never asked for either of his parents' record when correcting his BC details in the LCR in his hometown in Pangasinan.
Under the law, in case of typo errors, it is enough to present existing records that bear the correct spelling. If the birth, marriage and death certificates of your mother are authenticated, this should be enough, as a rule. There must be a reason why the LCR is requiring the other documents. Best to meet up and clarify why these other documents are needed.

Hi Shanice, kailangan mag file ng court case, under Rule 108 of the Rules of Court. Ano ibig mo sabihin ng PAO? Bakit sa PAO? Pulbic Attorney's Office? Hindi naman po dun sinasampa ang case or petition.

It is best that you yourself will sign the petition. Ang simpleng pag submit ng petition pwedeng gawin ng iba without your authorization, basta yung physical act of filing lang as long as you sign the petition itself.

Yung nature ng mga mali sa birth certificate ng nanay mo ay kailangan mag-sampa ka ng kaso sa korte. Ito ay petition for correction of entries in the civil registry sa ilalim ng Rule 108 ng Rules of Court. Isasampa ang kaso kung saan nana rehistro ang birth certificate ng mama mo. Since sa Camiling, Tarlac siya isinilang, malamang ay doon din nkarehistro ang birth certificate niya. Lumapit ka sa Integrated Bar of the Philippines (IBP) na pinakamalapit doon para makahingi ka ng referral sa mga lawyers na pwedeng humawak ng kaso.

Sa tingin ko, maaring hindi naman ito problema. Nasa pagkakasulat lang ng apelyido, kung may space o wala. Naging problema na ba ito sa yo dati?

Good day atty. May mali rin sa apelido ko ang apelido tlaga namin is Vergabera ang nkalagay po sa birth certificate ko po is Vergavera at sinunod ko po yun. Kaya lahat ng id ko diploma pati sss pag ibig at phil health ay Vergavera. Ngayon po kumuha ako ng baptismal para sa passport nkalagay doon Vergabera. Magiging problema po ba ito ? HI Mia. I would consider this as a clerical or typographical error, which can be corrected by filing a petition-affidavit with the Local Civil Registrar. But first, may I clarify that your mom is a single parent? Because you are using her middle name and surname.
Same po ito ng concern ko attorney, in my case gamit ko yung middle name at surname ng nanay ko kasi pinanganak ako ng di pa sila kasal ng tatay ko. Ano po ang gagawin attorney, need talaga for passport application attorney.

Ang Mali po Ay ginamit ang nameko at name ng asawako sa pagregister ng kanilang anak sa municipio noong 2002 without my knowledge!. So ngayon Ay anak ko daw yong anak nila! I don’t want to adopt nor acknowledge the boy as my son. I already have my own two sons.
Good day po Attorney, considered typological error po ba ang birth year ko na nadalawa ang pag type ng number Dec 1984 po dob ko, pero yong “4” nasapawan din ng “5” pero nasa birth certificate ko din nka indicate yong year of registration which is Mar 1985..Nakakuha na ako LCR form before pag apply ko ng passport, OFW po ako now..gusto ko sana kumuha uli ng LCR form kaso need ko daw e correct ang birth certificate ko…ano po need ko gawin? Hi Cinna. Ang error sa year of birth and considered substantial at hindi typographical or clerical lamang. Kailangan magsampa ka ng kaso sa korte.

Question lang - may nagtatanong ba kung bakit naka initial ang ang middle name nila? May na encounter ka bang problem dahil dito? If yes, ano ang mga problema na yon? Kasi kung wala naman, baka mas mabuti as is na lang.
