Hello ladies and gentlemen of the jury, and everyone else here in witness to the trial of the people versus Sweet tooth aka needles Kane aka Marcus Kane depending on the version. This is a man who has committed a lot of heinous acts in his time, and in this, the current year, we are going to be trying him for all of his crimes in accordance to American laws and regulation.

Wouldn't the creation/operating of Tower Tooth count as a weapon of mass destruction? Its a tower sized tank. Also if we are counting his crimes from every timeline we see ingame, he at least has a accessory to murder charge for any non-returning competitors, and accessory to attempted murder for any returning ones. Due to both being inside the tower its unclear which one actually committed the killings using it at what times. Also it technically is a building ontop of a vehicle, and I don't think Sweet Tooth or Marcus got building permits to build a tank tower under a active restaurant
I am enjoying this video but you forgot to mention that in Twisted Metal 2 Christa if I'm not mistaken was a replica android of calypsos daughter made to basically blow him up. Do robots count as people or would this be destruction of government property? Or because its an android of a person are we counting it as a person.

Here's a CORRECT crime to list. You forgot to mention that in Black, he had his ice cream truck turned into a convertible Transformers-esque robot. Isn't that another count of illegal vehicular modification? Because I'm pretty sure most GMC Frosty Treats trucks don't come with death-bot features built into the undercarriage. EDIT: Is this not also true of the truck in the 2012 game? I don't count the one in Lost, since it's technically the same truck, same universe, and charging him for that same truck again in that context could technically be double jeopardy.

Actually, This Juror would like to deposit a missed death for the record, His gunner, Killed in the battle against the "Brothers Grimm". He had his gunner sneak into one of the trucks to plant a bomb. And, In the moment, Decided to detonate the bomb without retrieving the gunner first, Killing him.
This juror acknowledges that this is but a drop in the bucket compared to the rest of the accused's crimes, But all crimes should be accounted for in this court of law.
My guess is this wasn't counted because it's optional. You CAN retrieve your gunner, and suffer a penalty if you don't. Though, I will say, it's very much in character (and probably the canon outcome) for Mr. Tooth to detonate without retrieving the gunner, and without a second thought.

@@netherwolf3012 So you can't. I dug out my copy of TM 2012 and tried it. Sweet Tooth REFUSES to pick up the gunner. You can hang out under Hammerhead/Slayer as long as you want, and you can see the gunner hanging down from the undercarriage, but he'll never climb back in.

@danieltaylor4185 Thought so. Still the most "Twisted Metal" of the boss fights and by far my favorite, plus the gimmick of the weapons becoming unusable is cool. Wish the rest of the bosses weren't so uh, different and brutally unfair and even unfun at times.

Since the defendant, Marcus Kane, exhibits symptoms of dissociative identity disorder (DID), it comes down to the question of whether or not his alter, in this case Needles Kane, is aware that what he is enacting are crimes, and if this alter is dominant in Marcus' life. The verdict would probably come down to an indefinite stay at an institution for the criminally insane, most likely with long stints in solitary.
That last one only if his right to recieve visitors is voided. Although technically Calypso's visit in black wasn't something certified by the Blackfield Asylum's crew, its a definite 'better safe than sorry' case here.
Plus in Black, Marcus Kane is aware that He & Needles Kane are sharing the same mind while in Head-On Marcus Kane discovers that he and Needles are one in the same despite KNOWING who Needles is and even that he Drives Sweet Tooth
I absolutely want to see Calypso get his day in court. The crimes of Captain Quark would also be interesting, though very loaded towards the first two games.

Something to note that I believe you missed. Most U.S. states have a law specifically for possession of a firearm (or deadly weapon) during the commission of a felony. This could very well apply to almost every single murder, attempted murder, and assault that Sweet Tooth would be charged with. Also, deliberately driving like the cliff like he did probbaly classafies as road rage.
Would that be one count per firearm used or one count per felony? Because I see a LOT of guns on that Sweet Tooth truck
All I CAN say is:
Adult Sweet tooth: His lawyers would ABSOLUTELY try to lesson his sentence through an insanity plead cause... I mean look at Sweet tooth, does this man SOUND sane?
Child Sweet tooth: Honestly? it might boil down to his parents/guardian(s), cause the main question would be "where, THE HELL, is this kids parents/guardian(s)?" He honest to god could be let off almost, if not entirely IF the jury decides it's the parents/guardian(s) fault for his behavior (it also helps his case that no one was murdered/possibly injured, at least from what I saw no one was injured)

Your honor, my client is a mentally ill person who has, at multiple times, has spent time in a mental institution. The fact that so many have died is an indictment of the system, and not of this one man who we, as a society, have had every possible method of helping through his trauma. This man, who at differing times, blamed his actions on aliens, the clown inside of his head, and the "player" holding the "controller", obviously feels unable to control himself. Yet, we, as an advanced society, cannot reach him? Cannot help him?

13:18 - the charge would be 'mayhem' in US law; even if the recipient consents (thus note assault), the partial amputation of the body or deprivation of senses is illegal. This law recently made the rounds when someone "identifying as deaf" paid a doctor to surgically deafen them.

I imagine that because it seems the wish doesn't seem to have injured or harmed any of the recipients of the wish in that matter, that ruling it as 'assault' is a bit muddy. If someone granted a wish that gave everyone a clubbed foot, but the foot itself was a formality to those having it, then I'm not sure if it's as easy to say he gave people a debilitating injury.
Because it's affecting the globe, it would fall under the international criminal court, which could constitute his actions (brutally maiming civilians) as a war crime, and he'd be judged as a war criminal
Twisted metal seriously needs its own TTRPG. Imagine the custom minis, backstories and paint jobs could be done. Not to mention it gives a new avenue to show lore in broken or incomplete ways with each edition

I think you could consider all the hospitol victims to be first degree murder becasue while he didnt plan them ahead of time he had time to consider what he was doing and stop as he went floor by floor methodically and I think first degree could be argued.
I'll remind you, Warhawk is/was a government agent, or at least a cop. So we can assume that Warhawk and the three tankers would qualify as murder of an on-duty police officer x4.

Insanity is more about the capacity to understand that it is wrong. Someone who fits under this would not hide the crime, being willing to do it on front of police, wouldn't run from Police, etc.
The idea is the person doesn't see the difference between the crime and just chewing gum,.etc. The trying to evade capture and hiding shows that Sweet Tooth understands society thinks it's wrong.
Therefore not insane.
There's also illegal useage and possession of fireworks in small brawl along with illegal usesage of explosives to breach the door in the opening of TM4 as well with 3 additional murders which were amd considering that the juggernaut in the story mode has 4 people 2 in the cab of the truck as we know of but the two as gunners for the mounted weapons on the top of the trucks cab and trailer as well with his assistant since he detonated the explosives to blow off the armor in the brothers grim fight resulting in the henchmens death
Small Brawl Sweet Tooth would probably get some form of correction or juvie, but one more charge can be attributed to him obviously not having a driving license since he's too young to get one under any circumstance
I would posit Quatro's ending as a count of Resisting Arrest since even if Quatro isn't an officer, he clearly HAS the support of the police due to the sounds of sirens when his backup arrives. As for the level, this is presumably on a felony level considering I can't see Sweet Tooth going quietly even if he is outnumbered, so that's an extra five to ten years at the very least. I would argue additional sentences for assaulting an officer but we don't actually SEE him doing it.
A drop in the bucket for him, I know, but if we're being comprehensive I figure it's worth mentioning.

1. the first crime would be escaping the asylum and I believe the woman was a nurse there 2. Sparks was basically a government robot sent to take down Calypso 3. Grim was either a skeleton or the Grim Reaper so those in the first 4 games don't count.
Uh, this juror would like to remind the court that canonically Sweet Tooth DID in fact kill Scott Campbell, the original driver of Spectre. He just did so BEFORE the tournament, in fact it's part of Spectre's backstory.
While it's far from the most reliable thing on the internet, there's probably a good reason as to why Sweet Tooth/Needles Kane (the game version at least) is classified as Pure Evil on the Villains Wiki.
Funny thing, when they gave him the chair in Black, he technically served his death sentence. He lived it but legally the sentence was performed thus he'd theoretically be free to go unless the judge had added a modifier during sentencing.
Your honor, a good amount of these crimes were not even committed in america! Thus, my client, Mr. Kane, cannot be tried for those crimes in an american court of law.

I would like to point out that he apparently had so many traffic violations when he ran the tourney it would bankrupt him despite having magic powers and resources on his scale which is definatley enough to warrant a stay in federal prison meaning you can commute the local sentence of dmv time
also worth noting he likley death penalty in addition to life on all these cause the judge should be physically incapable of being nice here
also on the grounds of insanity no he's not gonna get off on that he's completely aware of what he's doing only markus isn't and quite frankly he can just be written off as the ineffective personality/angel on his shoulder
Insanity doesn't mean innocence. It means hospitalized indefinitely until such time they are sane enough to stand trial again

To be honest I think each continuity should've had their own sentences and could've been formatted as "which Sweet Tooth would get the biggest sentence". Maybe once the Peacock series ends, that can give you an excuse to revisit the topic since there'd be new content to consider and giving different versions of the clown their sentences can make that follow up different from this video.
Your Honor! With a rap sheet this long, I believe in a Death Penalty Sentence for Marcus "Needles" Kane. As for the Insanity Plea, that is completely nonviable as his Blackfield Asylum Patient Profile states in his treatment section and I quote:
*"Warning: Meds have no effect; Lost cause."*
He is also categorized as *"Extremely Dangerous"* which is one of two Blackfield Patients to be labeled Dangerous which the second being Mr. Grimm. But Mr. Grimm is considered as *"Very Dangerous"* and unlike Sweet Tooth, Mr. Grimm is not considered a Lost Cause as Blackfield Asylum continued his treatment until Calypso set them all free to be part of his tournament. Also another patient labeled as a *"Lost Cause"* is Axel, but unlike Sweet Tooth that is proven to be Evil in your previous alignment video, Axel always falls either in the neutral to good category in my opinion. And he only wants to exact revenge on Sweet Tooth for killing his wife in TM Black. Still, my point stands: With his rap sheet as long as it is and taking the Blackfield Asylum Patient File into account, as a member of this jury, I believe Marcus "Needles" Kane AKA Sweet Tooth should receive the Death Penalty.
If we are going by the average lifetime of a human in 2022, which is 77.5 years, that would mean in total, Sweet Tooth would be serving a minimum total of 95,729.5 years in prison if he could serve it completely. GOD DAMN!
heads up. in twisted metal 2 Krista was a robot sent by the govt and looks exactly like Calypso's daughter who died in a car crash years prior to the series. so i think that murder charge would not stick

If you count Playstation Allstars, that adds another possession of fire arms, explosives, and deadly weapons, 16 counts of murder (the amount of other playable characters you fight in story), aggravated assault over ice cream, several counts of assault with a deadly weapon (chainsaw and his machete), and whatever type of murder you'd count that floating head and his minions as considering i think they are just pure energy but he did kill them

There are somethings you missed
For black there's +1 for stealing a gas tanker truck, +1 for stealing a dump truck, A lot of +'s for murder of each boss and characters killed (That includes sweet tooth's death as well), +1 for Identity thief, and +1 for working for Calypso since Calypso was a criminal and killer for Roadkill's ending (this was for the boss/secret character Minion since in the bio it did said that Minion was Kane which means it's also Sweettooth)
For Small Brawl (and you didn't count this) there's +1 for possession of explosives since those rockets in that game count thx to Outlaw's ending that shows the cop getting hit with the blast
For Twisted Metal (2012) +1 for killing his helper in the Grim Bros boss battle for killing Mr. Grim when switch on his armor, +1 for starting a gang (there more like a cult but there was no saying of how many years you can get for creating a cult), +2 for Weapons of mass destruction for his ice cream truck being a transformer weapon when playing as sweet tooth and the Carnival of Carnage you go against 3 times when playing as Dollface (was thinking of counting out the Carnival of Carnage since sweet tooth is dead during Dollface's story but I didn't since he was ok with one of the clowns helping him out to get his wish which means he was ok with the group)
This is the only thing I can point out since I didn't want to go through the whole game series to point out each crime you missed
Based on United Kingdom law (though I don't know if it works in the United States) the key defining factor in an insanity defense is "did the defendant know what they were doing, or, if so, that it was wrong?"
Did Needles Kane know what he was doing? Absolutely, he absolutely knew that he was murdering countless people.
Did Needles Kane know what he was doing was wrong?
That's the one that's gonna need the prosecution to work, but based on what we've seen, in a number of his more brutal crimes he knew what he was doing was indeed wrong, and thus a reasonable person can deduce he knew what he was doing was wrong.
In the United States, the supreme court stated that it's within a court's right to abolish the insanity defense even if the accused can't discern right from wrong (Kahler vs Kansas 2020)
Per the Durham/New Hampshire test, if his crimes could not be committed without his mental illness, he can plea insanity. But there are many sane people in Twisted Metal, so every crime committed during the contest isn't grounds for an insanity plea.
Per the more modern "Modern Penal Code Assessment", his attorney would need to be able to prove that, at the time of committing each of these crimes, he "lacked substantial capacity either to appreciate the criminality of their conduct or to conform their conduct to the requirements of the law".
With the burden of proof for insanity falling on the defendant, and Needles' clear and consistent disregard for human life, one could argue criminal psychopathy, but per legal precedent the Insanity Plea cannot be used in cases of criminal psychopathy
Considering how he remembers his murders, it means he was lucid when he committed them.
If he's lucky, he gets the consecutive life sentences, though I have no doubt that other charges will be added during the trial, which will lead to him being placed, yet again, on death row. If he's lucky, he gets injection again, though many states still legally allow the Electric Chair, Gas, and Firing Squad as methods of execution (and considering the level of his crimes, and that he committed identity fraud, he'd be charged federally)

He can only be tried once for each crime. He can't be charged multiple times for the same crime over an over again. It's not suppose to work that way.

Double jeopardy is the technical term that should be used but isn't used enough when someone is charged for the same thing multiple times.

Sentence to death. If the murder count wasnt so high, and it wasnt shown that he will kill again, then it would be an insanity plea, and while SeeetTooth does show signs of insanity, it's also obvious that he has enough control to decide whether or not he wants to kill someone.
