    Fernandez v. California | 134 S. Ct. 1126 (2014)
    In Fernandez versus California, the United States Supreme Court considered who can consent to a warrantless search of a home.
    Two police officers responding to a call reporting a gang-related assault and robbery were told that their guy was in a certain apartment. They heard screaming and fighting coming from inside. Roxanne Rojas answered the door. Her face was red, her nose was swollen, there was blood on her hand and shirt, and she was crying. She told the officers she’d been in a fight.
    Walter Fernandez then appeared the doorway. He told the officers, quote, “You don’t have any right to come in here. I know my rights,” unquote. Suspecting that Fernandez had assaulted Rojas, the officers arrested him and took him to the station.
    An hour later, the police returned to the apartment and asked Rojas if they could search the premises. She consented. The officers found gang paraphernalia, a butterfly knife, and ammunition. Rojas’s four-year-old son showed them where Fernandez had hidden his sawed-off shotgun.
    Before his trial, Fernandez asked the court to suppress the evidence found in the apartment on the ground that he’d objected to the search before he was taken away. The court denied the motion. The jury found Fernandez guilty. The California Court of Appeal affirmed, and the California Supreme Court denied Fernandez’s petition for review. The United States Supreme Court granted cert.
