GPOA (Notarized 1990 ki) hai. But Register nahi hai. Or Principal ने all property sale right holder को दे दिये है। Yeh condition hai. A प्रिंसिपल है और B होल्डर है और 1990 (GPOA) दी थी B को । और B ने C को 1997 में sale deed करदी थी। अब C पर्सन D पर्सन को sale deed कर रहा है । और D पर्सन में खुद हु। और यह right way है कि नहीं। ओर future में कोई case तोह नही होगा। legal है किया illegal ।Please solve Problem
Hi sir. Thanks for your query. In 1990 there was no requirement for compulsory registration of power of attorney. Post 2000, different states has made registration of power of attorney compulsory for sale of immovable properties like in Maharashtra. As per amendments made to registration act with effect from 1st April 2013, power of attorney for sale of immovable properties require compulsory registration. Prior to Maharashtra amendment act 2010, registration was optional . It was only required to be notarised before notary public. In your case, transfer of immovable property based on notarised POA would be valid as it was executed in 1990.

Is stamp paper mandatory for making POA
