You definitely don’t…..i didn’t really have evidence of service connection since I didn’t go to medical for anything. I decided to do my claim after I got out 10 years ago and just got my claim back. I submitted 5 lay statements as my evidence. I got connected for 10/15 things I claimed.

Would it be wise to include this CFR you mentioned at 9:03 within a personal statement when submitting evidence such as DBQ? I plan to submit DBQs for an increase and am planning to inform the VA I will not be partaking in any C&P exam shenanigans due to my actionable and sufficient DBQs.
When I rated, vets would submit there claim and have a personal statement with regulations listed to support their claims. It didn't offend me. I would look it up many times the vet was right. Dewayne i submitted sufficient evidence diagnosis treatment records nexus statements all claims were denied - Dewayne when i read the DAV brief to the BVA judge the Senior DAV stated that the veteran articulated his appeals well only thing that the DAV did was add case law to my brief that i wrote - In my cases i did everything right the law is on my side on every claim that i filed - va employee Examiners and the raters wasn't going to grant nothing for me no matter what - Good thing i was a warrior -

Recently separated, went to C&P exam and think I was lucky. She was outstanding, clearly advocated for veterans. Tons of evidence I’m surprised I even needed a C&P, but there are still “good ones” out there. Now anxiously anticipating my rating - long, anxiety inducing process. Hopefully they get it right the first time around. Question if you’ve read this far sir - another video recently stated that DBQs are evaluated by an automated software and the raters concur or non concur with suggested ratings. Is this true from your experience?
Yes, most times an exam is needed. Just having a "ton" of evidence is not always a lock. It may not show the residuals that are needed to grant maybe a higher percentage. Follow up, if you don’t mind… My C&P covered all of my submitted conditions, but the VA also included in their exam request “any additional conditions discovered upon examination” for my C&P. One example of something I didn’t initially claim, but am diagnosed with, is GERD. We covered this at my C&P due to the VA note of “any conditions”. Have you seen this? Would these conditions then be rated in addition to what I submitted? Also, re: automation software evaluating submissions/DBQs. I’m all for less potential for human error, especially on things as important as this.. wondering if you saw that in your time. Thanks for everything
Hey, Dewayne..great info! So, if you file for an presumptive which I did for Chronic Sinusitis. Gulf war vet, medical evidence, and a DX along with a Nexus letter even though you do not technically need one for a presumptive. First time claiming it I was denied. Decision letter stated I did not have a DX. Which I did have in my VA med rec. So, I filed a presumptive and uploaded my DX along with Nexus letter again. Went to C&P exam and was told by the PA that If my x-ray was negative I would be denied. I explained to the examiner that is not what the 38 CFR states, and again resistance. So, in my opinion I was set up for a denial from the get go. I am not sure If I will get my claim approved again. And it’s a presumptive and meet all criteria and have medical evidence. So, If denied again what should I do. Thanks in advance.
I'm curious if the C & P examiner put a DX on the DBQ they completed or stated you didn't have a DX. Get the claims file first before jumping in a HLR to confirm what's on the VA's DBQ. @@DewayneKimble well, the first time around the C&P examiner actually just stated Allergic Rhinitis, which I did get 10% But, nothing was in the DBQ about Chronic Sinusitis which was what the exam was for. There seems to be something about this x-Ray result. But, I have the symptoms, diagnosis from my PCP, and a strong Nexus letter. Thing is I am in the medical field, I work for the VA as a nurse. And an x-ray will rarely show chronic sinusitis because it’s an x-ray. CT scans are where they are at, and the PA said I needed a CT scan by examining my face and palpating the sinus areas in my face. She confirmed and agree I do probably have it. But, then went right back to the X-Ray has to show it. So, I am not sure what she put on my DBQ this time around. This should almost be automatic If I meet the criteria. But, I guess it’s not. I have 5 or 6 pages of headache complaints in my service treatment records, plus i still have them and get meds from the VA!! Would a nexus be needed or is the complaints enough??

Since, for example - heart disease , high blood pressure and strokes are all cardiovascular and or ceribrovascular in nature. Can I file for all 3 claims at the same time and submit A copy of the same nexus for each claim if the doctor stated that all 3 are a result of for example caused by obesity and sleep apnea ? Or must he write 3 separate nexus letters all saying the same thing except for disease ?
First, how are you claiming them under the five ways of service connection. If they are all listed in the diagnosis section of the DBQ, a nexus statement for each one could work better. I am a veteran who worked at the VBA as a Vocational Rehabilitation Counselor, and any type of medical evidence can help you case, but the VBA most likely is to deny and dismiss your claim 99.9% of the time!!!
@dwaynejones1555 most likely because VSO don't have any medical background to accurately record the disability using the correct medical terminology. So if you put in a claim for hypertension and the person who is putting in your claim and puts in cardiovascular disease and you got to QTC for cardiovascular disease and not hypertension that will be denied

@DewayneKimble Many components will determine their eligibility. For example, a veteran with those types of separations would have to be service connected at 10 percent with an employment handicap or 20 percent with a serious employment handicap. Ultimately, it is up to the VRC to make the determination for eligibility after all evidence has been considered after the orientation process. Having an SEH means your service-connected disability significantly limits your ability to prepare for, obtain, and maintain suitable employment (a job that doesn't make your disability worse; is stable; and matches your abilities, aptitudes, and interests). employment handicap means your service-connected disability limits your ability to prepare for, obtain, and maintain suitable employment (a job that doesn't make your disability worse, is. stable, and matches your abilities, aptitudes, and interests).
How long does the VA have to pay back pay on an increase. Still waiting on my back pay. Plus, I'm still waiting on back pay for VA Pack Act. I met all requirements. Will they wait till after appeal ? I can't fine anything on this when I research this . DAV ,I feel is not being truthful. VA messed up on my last C&P exam. I appreciate all you do . Have a blessed day
Grants a DBQ and exam schedule, I'm not following your question. I'm assuming you mean, if you are granted a C & P exam, does this increase you chances. Are you saying that if you have an IMO but not a DBQ you need to attend the C&P exam? Most independent MDs that I've known won't fill out the DBQ but will give a IMO with a diagnosis and nexus.
Yes, if the IMO has a positive opinion. What percentage would the rater know to assign without the DBQ which has the diagnostic code criteria for each percentage for the condition/s you are claiming. What if all you want is your medical record and are told you do not have enough time. I have the DD214 but am told my record does not exist. Any advice?

You can still get ser ice connected. Add your own statement with details of the incidents. Use buddy statements to help build your case. If you have seen private doctors, make sure you have your records with you for the examiner to review. The examiner reviewed mine, and I was granted an overall rating of 90%. Don't give up.
what if you get a letter denied 2002 Oct not in service only been released 6 months and see on line state grated July 2002 no letter! Supplemental claim grated 2023? Confused 😮

That sounds like it would fall under the 38CFR attitude of the rater. Some VA raters and/or raters think if you have a degree, you shouldn't be 100 percent but some of them are 100 percent with degrees. In your opinion, are VA raters incentivized to deny claims?
I think the VA is incentivized to make absolutely everything more difficult so people will just give up and go away. It's literally insane.

I am a veteran who worked at the VBA as a Vocational Rehabilitation Counselor, and any type of medical evidence can help you case, but the VBA most likely is to deny and dismiss your claim 99.9% of the time!!!

So if you put in a claim for hypertension and the person who is putting in your claim and puts in cardiovascular disease and you got to QTC for cardiovascular disease and not hypertension that will be denied

@DewayneKimble Many components will determine their eligibility. For example, a veteran with those types of separations would have to be service connected at 10 percent with an employment handicap or 20 percent with a serious employment handicap.
Ultimately, it is up to the VRC to make the determination for eligibility after all evidence has been considered after the orientation process.

How long does the VA have to pay back pay on an increase. Still waiting on my back pay. Plus, I'm still waiting on back pay for VA Pack Act. I met all requirements. Will they wait till after appeal ?
I can't fine anything on this when I research this . DAV ,I feel is not being truthful. VA messed up on my last C&P exam.

Are you saying that if you have an IMO but not a DBQ you need to attend the C&P exam? Most independent MDs that I've known won't fill out the DBQ but will give a IMO with a diagnosis and nexus.
Yes, if the IMO has a positive opinion. What percentage would the rater know to assign without the DBQ which has the diagnostic code criteria for each percentage for the condition/s you are claiming. Is there a way to request C&P exams? I did make an appointment for podiatry for flat feet and doctor confirmed it. Will that help my VA claim?

You can still get ser ice connected. Add your own statement with details of the incidents. Use buddy statements to help build your case. If you have seen private doctors, make sure you have your records with you for the examiner to review. The examiner reviewed mine, and I was granted an overall rating of 90%. Don't give up.

I've rated some claims with no evidence other than the STRs and C & P exam (which the veteran didn't submit). Due to the VA training today, everything and the kitchen sink due to the lack of VA training.

My buddy served three tours of Iraq with the 3/5 USMC Camp Pendleton and the VA denied him 100% because they noted he had a Bachelor’s degree!!!
That sounds like it would fall under the 38CFR attitude of the rater. Some VA raters and/or raters think if you have a degree, you shouldn't be 100 percent but some of them are 100 percent with degrees.
