You're right technically it's the fault of the person that turned but legally it was the person in the truck's fault b/c "you should always have enough time to stop". it's unfair and screwed up but that's the way it is.
ok I did some research and when an accident is caused by someone turning left the car turning left is always at fault even if the car going straight did something illegal or unsafe. so i was wrong but in the situation you gave me the driver is always at fault "because pedestrians always have the right of way". This is a law in all 50 U.S. states and a very inflexible one. there has never been a court case where the pedestrian was deemed at fault.
