I think it is need of the hour to set a definite creamy layer based on income for scheduled caste and do not give reservations like obc ncl. ST can be different. Because honestly what we practically see around is not what reservation made for.

I am from OBC our family income is more than 12 lakhs however it is very easy to obtain non creamy layer certificate. So it is a bogus judgement. Main purpose is politicizing reservation and divisive vote bank politics.
Main purpose should be to ban all reservation in the nation.
The center rejected the advice. I am ST, I support this advice but at the same time I understand the difficulty of NDA.
Like what happened in Bangladesh, Court unnecessarily advised govt. to give reservation then riots broke out, even after Govt. made it clear they accept their demand and has no participation in the whole thing, rioters still didn't listen.
I think this time "Sold out" Judiciary is trying to unstablise the govt. by trying to invoke insecurity among SC/STs.
Creamy layer is good idea but should be done when the govt. is strong & it will be done if USA has Trump in power. He didn't interfere with Bharat last time, hopefully he'll be the same this time too.
But if you earn from govt salary then you will not get reservation because govt will track it
But if you are earning from non govt job/business then all is at your hand to show how much you earn

Good step by Supreme Court. Further steps need to be taken
Criterion for creamy layer should be decided by Supreme Court Judge led commission, with some powers to State Govt to amend those criteria.
And After 10 years, Creamy layers to be disqualified from reservation.

OBC में बंटवारा से बहुत जातियों को फायदा हुआ है। इसी तरह से एससी एसटी जातियों को भी फायदा होगा।

I've said many times that Brahmins were never the main culprits behind the condition of our Dalit brothers, and logically, only 4.5% of people can never rule over 80% of people. In fact, some rich so-called Dalits never wanted to improve the condition of these poor people, and as proof of that, we can see now that those same people are opposing the SC judgment.
Brahmins also reject their Threads otherwise a layer of upper and lower is still there

OBC creamy layer एक बहुत बड़ा स्कैम है, कोर्ट ने नियम तो बना दिया लेकिन देखने वाला कोई भी नहीं है।
अगर आप सरकारी नौकरी मे है या IT sector मे काम कर रहे हो तो आसानी से पता लगाया जा सकता है लेकिन private shop retailers जो महीने का लाखो रुपए कमाते है वो अपने caste certificate मे income सिर्फ 40,000 लिखवाते है और वे creamy layer मे होते हुए भी रिजर्वेशन का फायदा उठाते है इसकी जांच करने वाला कोई नहीं होता है सब कुछ आसानी से हों जाता हैं, ऐसे लाखो case है जिनपर हमारे नियम कानून fail हो जाते हैं।

Abe yaar sc aur st ka cuttoff aur bhi low hone wala hai kyuki jyadatar ameer sc/st walo ke hi acche number aate hai. Gareeb waale toh nashedi hai puri tarah. Samjho agar general cut off 600 number hai toh ab sc ka cuttoff sirf 300 number hoga, pahele 450 thaa.
I read whole articles in the TOI. Justice Gavai, the lone Dalit Judge, argued that those SC/ST communities with top positions and risen high in socio-economic strata must be excluded. Other judges agreed with him except Justice Bela. CJI ordered the state to justify their data before making changes, politically motivated ones will be under Judicial review which eliminates the notion of the state gonna do the mishandling. All this while specific communities are taking the lone benefit of the reservation while communities like Madiga, Balmikis, Mangs, etc had not adequately benefitted from the quota.

If SC and ST who are not backward and not provided reservation then legally SC ST status must be removed and must be treated as general. And not discriminated against anymore . In this way people will be treated equal.
Economic condition is not ever lasting, it changes with time that's why scrapping of sc st status forever is not right, rather it must follow revision method on timely basis based on economic condition.

It's not that the child's generation will not be eligible to take advantage of reservation afterward if anyhow he could not provide the same uplifted condition to children. एक तरीका ये भी हो सकता है की अगर किसी दलित इंसान की शादी किस ब्राह्मण या क्षत्रिय इंसान से हो जाती है तो उसे भी क्रीमीलेयर में शामिल करना चाहिए। क्योंकि दलितों को आरक्षण सामाजिक आधार पर मिलता है अगर कोई जातिवाद नही तो कोई आरक्षण भी नही । इस तरीके से अगर सभी भारतीय अंतर्जातीय विवाह करे तो जातिवाद और आरक्षण साथ में खतम किए जा सकते है।
