ATF Loses AGAIN on Forced Reset Triggers and Judge Makes Fun of Them

  • Federal District Court Judge Reed O'Connor Eviscerated the ATF in the Rarebreed Triggers Case. In stunning support for the Constitution, Separation of Powers and the Second Amendment the Judge vacated the ATF's rule- Forced Reset Triggers are not machineguns. I expect the ATF will double down and appeal this case. Which, I hope they do, so they can further solidify this decision at a higher level of court.     ATF acts unreasonably, creating this whole CF, then tries to explain to the court what a “reasonable” approach is to rectifying this situation. 🙄

      Reasonable is the AFT gives back the stolen property immediately or if they don't have them any more then they cut a check for full retail value to the theft victims. Interest penalties should be assessed at 18% interest in full retail value for the full time the property was in AFT possession.
      The money for this monetary compensation will come directly out of AFT's payroll.

    The Judge should have told the ATF to return confiscated without prohibited person verification/background check which they argued. If FRT’s are not machine guns they are also not firearms so no background verification is necessary they are merely parts.

      ​@@marcush4741The "part" in question has to be defined by the BATFE as a firearm in and of itself in order to be prohibited. Machine Gun parts fall under this category. Prohibited persons are also banned from possessing self-contained cartridge ammunition. At least, to my limited knowledge. I may stand corrected.

    The problem isn't just that the ATF took triggers, but also entire firearms with the FRTs installed. That "prohibited persons" tossed in the ruling effectively ensures that the ATF can keep dragging their feet on this ruling. So thanks, judge O'Connor.
    Nobody is getting their stuff back.

    Funny how the ATF has the time to hunt down and find every individual that bought one to confiscate them but cannot seem to find the time to return. They should be forced to return the FRT's in person just like when they stole them.

    The ATF has a lot of confiscated items to return. FRTs and bump stocks. Letters have already gone out on the bump stocks and owners have to respond within 90 days.

    You are entirely correct. As FRTs are *not* "machineguns" according to the court final decision, they are *not* regulated items at all, and even a convicted felon illegal alien in a lunatic asylum is *legally* allowed to own one.
    So, even if someone is a "prohibited person" on any or all possible definitions, they are entitled to have their stolen property returned - as it isn't a "firearm" nor is it "ammunition". ATF should just return it without even bothering to conduct a background check. And as the class of covered persons is so broad (because it covers down stream secondary purchasers who obtained them - directly or indirectly - from a specifically covered person), ATF should simply return them immediately to *whoever* they got them from, outside of any who fall within the geographical jurisdiction of that stupid NY court case (since Judge Reed was careful to state he wasn't overriding a different federal court that reached a different conclusion).

    The court said give them all back to everyone. Not go through them all one by one and do background checks to see who can own a firearm. They are triggers, not weapons. Saying they are stored around the country is a poor excuse because all those places have workers who can put a stamp on a box in less than a week.

      @@VSO_Gun_Channel The aim is to have them not appeal to the appeal courts of the 5th circuits, which they will down the line, so this rule will stick and act as precedent along with the insanely large amount of people who own them.
      I want one, but can not locate one.
      So we wait until the courts decide....

    So much there to work on…
    First, I would say the atf uses lots of resources to take private property, they can use those resources to return it.
    Second, to the claim the atf made about not knowing who they stole from, I would say:
    “Then you will supply property to ANYONE who contacts the atf with a claim.
    The atf shall purchase items that the citizens claim that were stolen by the atf, no questions asked.
    Pretty sure the list of names would quickly be found.

    Wouldn’t M134’s be legal because it’s not technically fully automatic. A button instead of a trigger. Or at least a Forced Reset Button for the M134 would be legal.

      Forced reset button or button housing seems possible. Either mechanically by adding a cam to a push cable or electronically using a solenoid, a sensor, and a timer circuit. I don’t know if the human thumb moves fast enough for minigun speeds though.
      From what I remember, the button was determined to be a trigger when a FFL owner of a M134 got busted for something and had the gun at his house. He made the argument that the minigun was a Gatling gun and thus was not a machine gun.
      Really, semiautomatic browning beltfeds with spade grips should be a first target as the parts cost for a minigun is nuts.

      The button activates the solenoid, which in turn fires multiple rounds without any other action. A trigger doesn't just have to be a trigger shape. Otherwise, we could have full auto thumb triggers. That's a straight MG per the legal definition. If there was a hand crank, that's not a MG, that's a Gatling gun.

    As I understand the ATF's arguments, they are claiming that an FRT is a machinegun _not_ because it is a firearm, but because it is a component that transforms a firearm which is not a machinegun into a machinegun. At 5:51, the document shows "[...] And it would also `have to determine whether the owners are otherwise prohibited persons who cannot illegally own a firearm` before `having to contact the owners; and arrange for the return.`"
    Since an FRT isn't by ANY stretch of imagination a firearm, and the court made it clear that they are NOT machineguns, what makes the ATF believe they have any obligation or authority to delay (or deny) return based upon whether the individual is prohibited from possessing a firearm? They ARE NOT firearms, and ARE NOT machineguns. They aren't firearms any more than a screw or pin used to hold a firearm together is, which means the ATF has no authority to deny returning the item to the person from whom they took it.
    It is amazing how when an agency demands we act in a short period of time, our "inconvenience" is completely irrelevant, but when a court demands an agency clean up the mess they created, their "inconvenience" is upheld as reason to give them a reprieve and extension. If a judge demand we return the property to a person we stole from, about the only valid excuses for not making it happen in the time ordered by the court would be if we were in jail or the hospital. That we might lose sleep matters not.

    Wait a minute! @5:48 of the video about checking if a person is prohibited from owning a firearm before getting the trigger back...are triggers now legally classified as firearms? Not machine guns but is a general trigger now federally, under law, a firearm itself? If not, then why is a background check needed to see if a person is a prohibited person for "just" a trigger? Would that not mean EVERY modern day firearm is actually two in the eyes of the law. The frame/receiver would be a firearm and any trigger it uses would itself be a separate firearm. Why would a person want to own a trigger if they can't own a firearm? It doesn't matter, it is not a firearm and not regulated. It is metal. A paper weight. A fidget toy if is has moveable parts. If a trigger is NOT a firearm, do not allow it to be represented as if it is one.

      As of right now, it covers everything because of the vacatur. If the 5th circuit throws out the vacatur then it will only be products sold by rarebreed. Which includes any WOTs they sold. Anything sold by anyone else would not be covered.

    Imagine if: all the money and effort spent enabling BigGun to sell you 2A guys "toys" was instead put towards investing in the youth of this country. As it stands right now, firearms remain the leading cause of death for 18 and under.

    I'm not sure I follow the prohibited persons argument. Triggers are gun parts, as far as I can tell and please correct me if I'm wrong. The law preventing felons from owning guns doesn't apply to gun parts. There is no transfer here, its a gun part.

      It's because the ATF also took entire firearms that had the triggers installed, they didn't take just the triggers in some cases.
