I could be wrong but i would imagine it would take much longer to counter sue someone had he not been prepared.

They say the most safe response possible of following whatever anyone else has said. Believe the woman, dont think about anything guilty until proven innocent.
      The whole "Always believe women" bullshit is sexist in itself because it paints women as people who are perfect angels who never lie or have malicious intent. It puts women on a pedestal that ends up flipping in the opposite direction when they do something more visibly and mildly wrong so they end up getting even more backlash than they should in some instances.

      If he wins everyone will believe him. May take a much longer time for people who were on the girls side to forget of course just like with Johnny depp and everyone who believed the terrible rumors. Even after Depp won, none of the major companies backtracked what they said about him, however he still made movies and did concerts. If rich wins, he may not be allowed back into OTK yet or he may not come back to streaming right away if he even wants to go back. Like depp not wanting to ever go back to Disney despite winning his case which made Disney look worse than it already does.
      If anything, the girl would be treated like Amber heard was, wouldn’t be surprised if she tried countering with defamation over the loss like Amber tried to.
      However, the public already loved and treasured Johnny Depp a lot, so you may be right on the damage already being done.

    When talking about believing victims of SA, it comes from a place where women and girls were historically not believed and potentially berated for even reporting an assault. IMO believing women is more that we shouldn't just dismiss their case automatically. Some radfems may think differently, but the history of "believe all women" stems from historical mistreatment and judgement.

She just needs to convince a jury she's more believable than he is. The burden of proof in civil court, even in jury trials, is much lower than in criminal trials. A woman willing to lie about this can be just as confident she can convince a jury with her own words alone, and there's a reasonable chance she can.

      It's fine to take it seriously. And i don't think you should say that the victim is lying. But this does not mean that you should attack the accused without evidence. Things like this should not take place on Twitter or social media it should take place in court. There they will decide if the person is guilty or not.

      @@SomethingScotty He has actually been seen in pictures online since before he filed his lawsuit (his girlfriend's Instagram at Disneyland) and there were a decent amount of people glad to see him doing well in the comments. But yeah, it's unlikely that he'll ever fully recover due to the allegations even if he's correct. Kind of like ProJared who proved that he wasn't in the wrong, but majority had already moved on by then and wrote him off.

      Though Mizkif's situation was bad, apparently they ran a third party investigation by hiring one the best law firms in Texas which found no wrong doing. Mizkif's situation is also very gray because of all the drama, unreliable witnesses, agendas from the victim's supposed supporters (XQC and Train wanted to drag Pokimane and Hassan into the drama), and that the actual perpetrator of sexual assault was thrown under the bus faster than you can say lawsuit.
      Rich outright admitted everything to Asmon and OTK and declined to fight the accusations. But kicking Rich out of his ownership share, if Rich's story is true, is wrong without the correct legal mechanisms (especially in Texas) which Rich is alleging did not happen.

And the way all of OTK worded it by stating "we have requested Rich to resign" is very exact, unlike what Fumimation did with their statement regarding Vic's situation. Rich filing the suit after a year can probably be attributed to his lawyer finding enough evidence to file.
      No allegation should be overlooked, but with the ammount of false allegations in the news being exposed like Matt Araiza, Brian Banks, Johhny Depp, Nikki Yovino, Trevor Bauer, and Elenore Williams, there needs to be a HUGE overhaul on how these kinds of cases are handled in both courts of law and law enforcement.

Sure, you don't want to be super open about everything, and you probably aren't going to be showing off all your evidence prior to discovery, but once the case reaches discovery, which is before you actually hit the courtroom, the other side gets to see all of your evidence.     After the whole Depp/Heard debacle, people should know that relationship-related stuff is never as simple as it seems. The guys are almost always expected to be the aggressors and only to blame, so it's important for them to get help asap and allow the judge and courts to mediate, etc. Usually both parties are at fault to some extent (character failings or whatever), but it feels like the guys are often slammed pretty hard at first. It takes a while to sort out the falsehoods from the truth... and we may never know the truth of the situation... and perhaps it isn't our place to know anyways? But I won't lie. I'm curious AF.

    Know someone that went through something similar. They beat the case, but a lot of damage was done to them before and after. After because the women contacts people he knows and worked with. These situations are as simple as people on twitter like to make them out. To be honest, id argue they make it worse for the victim as well.

    Without taking either side, the only thing i found weird about her side was mentioning alcohol and inability to give consent. She said in the twit-longer that she said no to the sexual advances, but then the alcohol part mentions that she was unable to give consent? If she said no, isn't that showing an ability to give consent (and that she did NOT give it)? I don't know... to me that seems weird, like a conflict between the twit-longer and the court document. Why wouldn't the document just say that she refused consent? Maybe it's a legal thing which is why it doesn't make sense to me, but it just struck me as weird.

      Asmons judgement is irrelevant. His body language when talking about it is far more significant as well as how quick and severe the action taken was compared to mizkif and also the fact that he made it crystal clear he had more info than was public and the action they took was based on that. That is a lot of red flags to make your own mind up on the matter and thats before you even look into it personally.

      It's so stupid, a company I used to work at had a female file a SA claim to HR about a guy, and he was fired on the spot before the investigation. After the investigation was done, surprise surprise, bitch just didn't like the guy and wanted to get him fired. The company did come back and apologize and offer him his job back, but that shit's there forever, even though it was a lie, he was fired for SA 😮‍💨
      And it's rare for the woman who made up the stories to get attacked and screwed over the way the guy does, so we're just encouraging it to continue

    Trial by jury for defamation is rare because it is usually presided over by a judge. However, if the plaintiff elects for a jury trial, then there will be a jury trial.

    The reaction of Asmongold is understandable since how much he gave shit to blizzard for sexual misconduct allegations. Remember that it the allegations were not proved before a judge or a jury but settled on by both parties, and know that a settlment is not an admission of guilt very far from it, people who infur guilt from settling forget that the accusing party accepting payment for cancelling the legal proceeding should not reflect very well on their desire to see justice done. It would be quite hypocritical for asmon to defend Rich for being mob-justiced while having so vehemently participated in the mob-justice against Blizzard.

      Let's contrast the two scenarios here and why it's a bad comparison.
      You are comparing a large professional run corporation where several employees are forced to work together and the SA that went on in that professional setting, compared to a separate allegation concerning two people that had nothing to do with the company who were privately involved with each other where one made a twitlonger accusing his friend of SA.
      They are not remotely similar. I don't think Rich was employed to screw Lexi, nor did they work together under OTK, nor was OTK itself involved.
      Entirely different contexts.

I am saying that Asmongold as an OTK founder who was very critical of Blizzard for not taking immediate actions for unproven allegations could not afford to let Rich accusation slide or be supportive without losing the moral highground regarding sexual misconduct allegations.
      OTK is a large professionally run corporation, its not the size of Blizzard but it is a big media company with millions of dollars on the line, Asmongold and the OTK company line has been pretty much standard regarding sexual misconduct allegations. Cut ties with the accused before it damages the image of the company and move on.
      Asmongold couldn't have reasonably been supportive or calling for a legal proceeding before taking action without seriously compromising OTK and his image.

It's a bad comparison because it doesn't take into account the nuance in differences here.
      They need buildings and infrastructure for people to work at, which means people are forced to work together which is were a lot of the SA happened. It is obviously Blizzards responsibility when their employees are facing SA trying to do their job, which is the issue.
      This is a scenario involving an OTK member regarding his own private life and personal circumstances with a relationship with a girl he was casually seeing who wanted to turn it into a LTR.
      They are not remotely the same context. No, people should not be fired based on allegations. Innocent until proven guilty.
      If you can't understand the distinction or why it matters, I'll break it down. A colleague who works in an office building going around committing SA needs to be suspended, because they are a potential issue for the other workers there. So for the consideration of all other workers, that person needs to be suspended pending investigation.
      Lexi isn't a part of OTK. This was a private situation regarding. It had nothing to do with OTK.
      Essentially, Asmongold threw him under the bus. No, it's not understandable why he did so. The things he said concerning rich basically implied he was guilty.
      For a guy trying to sell his persona as just the average normal guy, most normal guys don't throw their friends under the bus for money or distance themselves in a friends time of need. They were supposed to be friends, not work buddies. That makes him look bad, frankly.

    What a lot of people don't seem to understand is that consent can be withdrawn at any time. A guy can be balls deep in a girl and they can be having a great time but if she suddenly wants him to stop for ANY REASON AT ALL and he doesn't stop, that's rape.

      While I understand the sentiment, rape is different.
      Rape is equal to murder in my opinion as a woman. It's having someone assault, invade, and damage you with real believe in the possibility of actually dying by the hands of the predator.
      The situation you described I would say is more close to a physical abuse, albeit on the minor side. I say this because there is also a different between having something you're already doing go uncontrolled or slightly bad than having someone beat you up.
      And quite frankly, having people use such examples to describe something as horrific as rape undermines it in my opinion.

    The OF thing is quite simple to explain. In court it’s very common to strike at the morals of the other party. To show them in a bad light. If this would be a trial by jury, many members of it might be mid to even older age folks. If one side would be successful to paint the other as a person of “loose morals” it would definitely be to their benefit.

    Huh, interesting. Despite me reading her side and believing rich would do something like that, his side of the story makes more sense. Why would he try to knock her up out of anger if he didn't want to be in a committed relationship? And them having an argument about a long term relationship makes a lot of sense as to why he would tell her "You need to leave". Then also ask later "You okay". Because otherwise, who the fuck would assault someone and ask "You okay" afterwards? Of course she wouldn't be okay if he did it out of malice.
    She has more reason to bring him down than he has a reason to assault her. On one hand it's saying he wanted to assault her for a fetish. On the other hand, she wanted to ruin him for not being with her. Somehow, it feels like the truth is somewhere down the middle. It still feels like either side is hiding something said to make the other look worse.
    That other allegation with friend's boyfriend turned husband is also interesting. You would think that a friend's boyfriend, who did something like that, wouldn't end up becoming a husband from something done that was that awful.

    Its hard because I firmly believe that we should support victims and make it easier for victims to speak up because the reason actual problems don't get reported is often because of public harassment and shame being a common result for victims who speak up --- all that being said, I've also had to sit by and watch my own husband be youtube slandered by claims of unsolicited d*ck pics despite me literally being there and seeing for myself the "victims" participating in a consensual and mutual exchange. we SHOULD be able to make it a safe environment for victims to speak up and be believed, but the problem is that it gets harder and harder to do that when vindictive assholes (of both genders) throw around severe accusations because they're feeling pissy about some grudge they've developed against the person.

    It shouldn't matter what she "should" have expected or not when going over to his place. She mentioned several times she didn't want anything sexual happening. It shouldn't matter what their previous relationship was. Spousal rape is also a thing; so obviously, having regular sex with a person doesn't mean rape isn't possible. If at any time one of the party doesn't want to keep going, their wish should be respected. No means no. Period.

      But then, some crazy person could just accuse you out of the blue, that you could've even never been in relationship with. And that's it, it would take a lot of time to clear your name, because a lot of people would instantly jump you with hate train.     How people reacted to Rich when he was accused is exactly how male soldiers in the military are treated. The military only cares about public perception so they immediately treat the male soldier as a criminal. This is why male soldiers especially guys in leadership positions, want nothing to do with being alone in a room with female soldiers. They actively request another male leader or a female leader they trust to be in the same room with female soldiers. I have seen more than a few male soldiers accused of things. And it turned out the guy didn't do anything. But by that point all the trust in that male soldier is already shit canned. Even if your proven innocent. You will always be surrounded by other peoples doubts no matter the facts. It's destroyed many careers and marriages. All because the military would rather save face than listen to both sides and take action accordingly.

      Well, that would mostly stem from the fact that initial lawsuits don't need a whole lot of paperwork. Most of the stuff gets presented throughout the case under the moderation of the judge, not initially. The page disparity is coming from the fact that the counter case is also partly a response to the initial filing, its not its own separate thing.
      (Also there is no defamation argument being made towards a man in this instance, its a sexual assault thing)

    I hope he's proven innocent, not just because it means nobody was raped, but also because it will be very amusing to watch Asmon and Tectone not react to this with all the shade they've been throwing his way for the last year in a, "yeah imagine knowing someone for years and then discovering they're a huge piece of shit" kind of way. Both have said damn near those exact words in a tongue in cheek way to refer to Rich throughout this past year in many of the videos on their react youtube channels. A lot of people are saying business decision this business decision that, staying away from bad PR, but that's no reason to antagonize and reference the situation like that throughout the year, especially if they had any idea that he could have been lawyering up.

      Asmon eluded to him asking rich about it and it seemed like they knew more about it than we did. Im not really sure how this will go. Personally I miss rich on the gameshows and he was a good host too. But obviously he will never go on OTK again. His streams were.. lacking with endless stalling, and I didn't enjoy watching the whole mia malkova arc but hey we will see what happens. I just wish people didn't give their take until we heard his side of the story and it makes no sense that this girl outed him on social media only after he was in a good position. People who attacked her are worse though, we dont know the full story yet.

If I were to pontificate based off recently acquired information in this video, I would say he had some knowledge that there would be others dog piling on to accuse Rich so better to assume multiple people weren't lying than his one friend is telling the truth. It may be obvious from the initial post, but to clarify, I don't particularly care for any of them as a person get infrequent enjoyment out of their react content (it's hit or miss for me) and the most best outcome would be that it didn't happen at all, because no physical infringement of ones person would have occurred and it would be funny to watch them wiggle out of the uncomfortable spot they had put themselves in. Especially in light of all the other videos the pair have reacted to about legal esque stuff where they've come off high and mighty like 'this is why you should wait for the courts to form a verdict before jumping on the bandwagon'. This is obviously the correct thing to do, but they don't do it at all. To cite a most recent example of Tectone doing this is him reacting to the Dream pedophile allegations, where he also does some of the above mentioned 'imagine knowing a pos and not knowing it' stuff multiple times in that react video. I am most definitely not saying that removing him from the company was a bad idea though, obviously very standard operating procedure stuff right there.

      Being proven innocent is also not a 100% truth that he didn't do it, just means he had better lawyers and many SA cases only have he said/she said as evidence. Truth is guilty or not, only those two will ever know because we do not have a time machine to see what actually happened.

We're all capable of nasty things and wicked schemes, regardless of sex/gender. So don't forsake the principle of "innocent until proven guilty" just because the accuser is a woman.

Destiny, for example, never condemned Rich, he just said the evidence that he had viewed was pretty compelling after going over everything that was released and discussing it

    USA is kinda weird. You can actually file a lawsuit against someone for defamation based on another on-going lawsuit's claims ? Like you can sue someone for accusations you're currently being investigated on ?

      I think it's the healthy way to see these situations. Nobody should take anything at face value and assume it was 100% true but I don't think people should go so far the other way to say the person was automatically lying. Judgement should be held until everyone has gotten out what they need to say and it is handled by the law.

      I learned my lesson as a teenager. A girl falsely accused me of groping her to a gym teacher and the teacher asked other students first before accusing me and all of them within my group said they saw nothing happening. This shit happens way more than people think.

    "There's nothing to gain" is a very bad take honestly, it's based in logic and reason sure.
    But not everything a person does is logical. There's a court case I remember where the guy was accused by multiple women of r*pe, but once it got to court there was contradictory statements, text messages that showed their true intents on lying due to not liking him, many of whom eventually came clean about them lying just because they didn't like the guy. One case the guy spent 100 days behind bars held behind a 500,000$ bond over and over because of false r*pe allegations.

    Why did they mark out the word "rape"? I'm sure it can be triggering but it's one of the primary topics of this discussion. Also marking it out and then verbally saying it aloud seems contradicting. The word itself is not meant to be malicious but to describe an act, however heinous it may be. There's a lot more to focus on here than just that, but it really stuck on me. Why do things have to be censored, and if they do why is it only half-way done?

    What asmon said seemed like he was pretty much ditching Rich for the wolves. Even during the stream he said he saw the evidence and it was bad or whatever was the actual wording. Instead of waiting for proof he just ditched his friend. I dunno, if i had a friend like that i would never speak to them again. That is assuming rich is innocent.
    But seriously, i hate people like him who are just hypocrites, sauing they do one thing but do the other. ie innocent before proven guilty, he just proved hes just like the rest

      ​@@andreamarques8328I had that exact situation happen to me. Except it turns out the girl drugged my friend so he couldn't remember anything of the night she alleged he raped her. It was a pretty crazy case, but that girl was a total sociopath. Law enforcement even got involved but she couldn't stop getting caught in lies, sadly it still ruined my friend's life because most people automatically believed her. Many even thought that law enforcement failed her and did a terrible job investigating even though she constantly lied to detectives.

      it sounded like Asmon wasn't especially surprised by the allegations and alluded to knowing "more information" when he commented on the situation. But, even if he is trying to help Rich, it's perfectly reasonable to create distance, business-wise, in these kind of situations. Just like it's in Rich's best interest to stay quiet until he can gather evidence and come up with a response, it's also in his best interest for Asmon to keep silent. He hasn't condemned Rich at any point either, he's waiting to hear more info like the rest of us.

    What is weard to me is that she is at a hotell, she could just walk out, there was personel at a call of a button. No saying. NO or pushing back, just that she had sex with him. Where was the push back before the act, i mean she wasnt passed out or not at her senses. I mean getting feeling of guilt after is a thing, but there is no really stop before the act. It sounds consentual until after the fact they had sex. She said NO 100 times but still follow him and got naked in the bed 🤔 but i know nothing.

    "She has nothing to gain". canceling him is not a gain for her in anyway. Money? she knows the chances of getting anything is .01% and she will most likely be out of money hiring a lawyer and filing fees etc. This is about principle
