The whole case will just fall apart again.

Firearms serial numbers are registered in CA. The serial number on the firearm used wouldn't have been registered to him. And btw; firearms serial registration has solved exactly 0 firearms related incidents in CA. Most it's done is imprisoned people for failing to notify the police of their firearms theft.
