    is it fair for a company to give an employee the 48hrs period to prepare for a hearing and still request them to report for work through out the investigation period and days leading to the disciplinary hearing

      No absolutely not!
      You can request a postponement if that time was not sufficient

      ​@Legal Leaders: South African Labour Law I think a better question is, should you still be actively reporting for work when you're waiting for your employer to get back to you on when the disciplinary date is? Or should this time be used to prepare for the hearing?

    Hey Mr Lawyer, do you think i could get fired for a miscounting error of stock that was later found all still in the warehouse, I've been charged with Fraud and dishonesty, Misconduct and Gross Niglegence. I just made a counting error and I was still in training for the job and was only 3 weeks

      It depends how serious the error was?
      Also on your seniority?
      Did the company also suffer any loss?
      These are mitigating and aggravating factors that affect your unfair dismissal claim at the CCMA

      @@legalleaderssouthafricanla7309 1. I didn't count 1 box of fluffy dolls which are 3 dolls inside
      2. The Company were gonna throw away the dolls since there were defacts.
      3. The Guy threatened me he knows everyone at CCMA so I'm gonna loose and yes I did record him saying that
