- Eyewitness News has reported on the growing squatter problem and now some lawmakers are taking action.
New York has a history of passing some of the country's toughest laws that protect honest tenants from greedy landlords. But some lawmakers say the laws have gone too far. They also allow dishonest tenants to take advantage of free housing for years.
A State Representative from Long Island filed a bill that would make it easier for a homeowner to remove a squatter from the property.
This comes after Eyewitness News exclusively reported on a homeowner in Queens who was arrested for changing the locks on men she says are squatting in her home: abc7ny.com/squatters-standoff...

They don't allow that in their neighborhoods. I've seen cases where the research the person, saw he had guns but he had felonies so they arrested him. Another the cops just came and told them to leave. Suddenly what wasn't enforceable becomes enforceable.

It's 20 years here in Alabama, but still a civil matter. Should be a criminal offense in every state.

The fact that there is such a thing as a "squatter loophole" in the first place is a failure on the part of legislators to enact laws to arrest and charge people who are TRESPASSERS. As far as I know, there is already a law on the books for such a thing and it should apply to squatters, too. The need to amend a law to get squatters out is a JOKE. I can't believe that homeowners are being arrested for kicking these people out of their properties. Since when should someone who legally owns a residence be arrested for removing someone from their property that is illegally residing there? Outrageous...

Calling it a loophole is just an agenda play, it's a clear-cut law. It wasn't a mistake how it's drafted.

Happened in my wife’s apartment. A tenant invited his friend to live with him who fell on hard times. The friend took advantage and he tried to kick him out. The owner tried to change the locks, and police said if he doesn’t change the back he will be arrested. He took him to court and it took almost a year to get him out.
I learned early not to have any friend or even family member come and live in my house. After just 30 days, they become legal tenants, and it's hell to get them out of your house.
I bet if you squatted in the cops house that chit wouldn't fly.

A woman walked into her property last week and was killed by the squatters. and it was an upscale apartment on 31st street.

There is A illegal alien on TikTok training people how to squatt and to file a legal filing to own the house. In this case you have to have squatted for 5 years. In some cases it could be at least 2 years or more before a home owner has their first court date before a judge.

It took us three years to get a girl out who ended up committing 8 misdemeanor and 2 felonies against our actual tenants and us. She even got money from go fund me to “move” but kept telling the court that she had no money.
NY should make it mandatory that all leases and subleases be notarized. If a tenant does not have one, then the police must remove them.
I feel sorry for the homeowner. On top of everything, now she got a criminal record.

This is currently going on on my block. The property was sold during a foreclosure and the squatters broke into the home. The owner has not been able to access his home and the main squatter is renting the place by rooms.

Why are there laws to PROTECT criminals? Someone who breaks into a house, and then LIVES there for free, and then is PROTECTED by the law. COMPLETELY unreal. Those people should be CHARGED with breaking and entering.

The house has to be empty before they can try and take it. Also this usually happens when there is some sort of transition happening, like the home is for sale or is about to be rented to someone else. These squatters will then take the names and forge a fake contract. I didn’t think they can just fake documents if someone has been living there for years. But any case this is just so wrong and I can’t believe they aren’t held responsible for the damages for what victims have had to go through.
They don't become owners, they just simply have 2be removed via court action. No big deal really.

Why not have a home alarm system, and engage it when you leave the house? If someone breaks in, the alarm is triggered, the alarm company alerts you, the police show up, and whoever broke in has to give the right passcode. If not, they get arrested.

That is what I am talking about, not just a "minute" or a few hours away from the home. An alarm system prevents anyone, whether it is a minute or a month, from simply breaking and entering.

Unbelievable. In Alabama, they have to live in the house for at least 20 consecutive years and paid property taxes for 10. There are other stipulations as well, but someone can't just come in while you're on vacation and say it's theirs. Can't believe any state would give someone the right to criminally trespass on another's property, especially after 30 days.
I was just thinking this today. I want to take an extended vacation. But I'm afraid that when I come back.There will be people living in my house and I can't kick then out.

Blast music or airhorns outside the windows at all hours of the night with enough time between intervals that calling cops would be useless. After about a week or so of low quality sleep they’ll leave willingly. If the house takes natural gas call the fire department and tell them you smell a leak. Swat the place by reporting a hostage situation so that the door gets broken down and you can get in at least. Psychological warfare

THIS is one of those situations where you must forget about relying on cops, courts, lawyers, marshals, formalities, process servers, & etc for help. You'll literally go broke and or mad if you do. You instead call upon your ex con or underhanded criminal minded friends, relatives, & acquaintances for assistance. Some refuse to have such people in their lives, even to a limited extent. But trust and believe that they too can serve a valuable purpose when all else fails.
Honestly I think Squatters just canvas neighborhoods purposely for this . I remember our neighbor sold his house and within weeks developers started with the renovation works . Early one morning I saw cops pulling up for this purpose cause another neighbor had seen someone loitering around and had called them . The owner came back and changed the locks smh

I have a squatter in my home for about 13 years, she does not pay rent, she walked into my home from the back yard sat down on our sofa demands to be fed and acts like she owns the place and she never left, she is still with us to this day. She is my cat her name is Dorothy.

If they had legal occupancy then they can become squatters
But if they just simply barged in without permission, then that’s just a trespass or burglary
If a State isn’t willing to enforce property law, they should not be allowed to maintain the status of “statehood” within the American Union.
Simple as that.
The other 49 should come together in convention, to abolish New York’s government, and remand its leadership to direct Federal management, until such a time a new State government can be formed which is able to uphold the rights of its citizens.
Otherwise, New York should be expelled from the Union.

Squatters should have no rights to property owners homes. That makes no sense. How can someone just come and take what u paid for. That's crazy. Is there not a gov't entity plus bank/financial records that you can obtain or show that proves you are the owner and just show it to the judge or gov't dept then the police can kick them out?

Home Owners should start recording when they bought their home,when they leave their home, when they will be back, along with the contract in hand. There is no way I would have some squatters in my home lol
SHIT, had this same situation here in baltimore city about 12 years ago when Mom died. When everything settled me and the family went to Mom's old house and a family had set up shop like they bought it. I asked them politely to be out of the house by next week, they informed me that they would see me in court. Called a few of my west baltimore Cousins, showed up on that Friday and threw them and all of their SHIT out in the back alley. Judge Police and jury, DON'T mess with some people, they DON'T call Police.

Should be a straight law that says TENANT MUST SHOW DEPOSIT FROM THE BANK (CHECK OR WIRE ONLY) being DEBITED FROM TENANT's ACCT AND A DEPOSIT INTO OWNERS OF THE DEEDS. USUALLY OFFICIAL CHECKS SHOWS WHO IS IT PAYABLE TO AND SO IS THE WIRE.

Two points from my own experience.
If you allow someone to stay with you (hard times, crisis, etc) very strictly keep to 28 days. Once it hits a calendar month they have ‘rights’. Additionally if they receive mail to your address also gives them ‘rights’.
Changed in Florida Recently by gov Desantis-Owner can remove people with Police, without a valid lease immediately.

It is crazy to see squatters fighting home owners and we see a lady was arrested and handcuffed by the police.
Seriously though, a database exists through the DMV for car registrations, licenses, insurances, etc and is accessible by the police anywhere. Why then can't there be something similar for landlords, properties, and rental properties in any county or state? Buying or moving? Well you have 30 days to register as the new owner and or tenant of said unit with said owner, documents and ID's on hand, or face fines till you do. Make it so when cops are called they can verify everything on the spot concerning that property, like a traffic stop. Trespassers removed by way of arrest and THEN get the courts involved. What we need here is deterrence. But no, just like our asinine bail reforms against criminals, housing laws in NYC & NYS have created a field day for the criminal element. Just saying.

How can a squatter be a tenant? They pay no rent, bills, etc. They should have no rights at all, just because you want a home doesn’t mean you can just take. Btw I live out west and this is also a major problem here.
Maybe there should be a registry of some kind that tenants and owners legally have to sign before moving in that says they have an agreement and have cops be able to look it up when called for squatters. If the squatter says they are tenants then cops can search records and if nothing comes up they can then arrest the person for trespassing.

And just a few hours ago, squatters killed the homeowner's daughter after she returned home... stuffed her into a duffel bag and then stole her car. Something needs to change.
