Thank you for this video. I just wish looking for a job while having a background wasn’t so embarrassing. You go interview to interview only to get denied once they complete their background check. That’s when the embarrassment starts because from there you have to explain it and prove you’re not that same person. And even then if you’re denied what are we supposed to do? Legally Fight and beg for a position from an employer who has no intention on hiring? I just need an opportunity to work 😮💨
I truly respect you as an employer for doing so. We all deserve a second chance to prove ourselves. It’s hard enough to be in this situation and feel so judged over and over for a mistake. Thank you! 🙏🏼
Question: California law says they can't go back further than 7 years on a criminal background check but "HireRight" is doing the background check for the company im applying for and HireRight is based in the Caribbean....since the criminal background check company is based outside of California are they free from the 7 year rule based in California.... I might also add that the parent company of the company ive applied for is headquartered outside of California as well

I had an arrest that did not lead to conviction. I had a free consultation with a labor law firm today and was told that an employer can perform a DOJ/FBI background check which would show that arrest. So here is where I'm confused about the information about this issue. Employers may not "ask or seek" info on arrests not leading to convictions but if they perform a DOJ/FBI background check, it shows up anyways so they can see the arrest. What's the difference between asking/seeking vs. doing a background check? Does the employer simply have to ignore this information they see and not discuss about it?
Quick question? My background shows no criminal history or vehicle history but it shows that I have 2 state points from a dui that happened after 7 years ago … do you think they’ll question why i have 2 points ?
So I expunged my record about 8 years ago it was a misdemeanor, I recently applied at a car dealership they're doing a back ground check and since it's expunged does that mean I'm good ? Or will they be able to see it ?
Matthew you said thay cant get the record history from you, then how is it that the state of califonia notary depatment said they require an applicant to list all criminal history when they are pulling back ground records any way? Are they legally suppose to request this? Please reply and very informational video thanks will pass the info along

@@allenlim5729 Hmm, it's hard to say. Police departments and courts can be very disorganized, so maybe it takes them a while to process the records and make them publicly available. Or maybe different background check companies come up with different results based on what they search for and how comprehensive they are.
What good is it if you can’t go past seven years and you’re telling us we got to tell him it was past seven years we gotta tell him I don’t think that’s right up and tell him nothing
With the labor shortage out there you never hear a word on how many employers find ways to violate the ban the box rule. It is estimated there are 70,000,000 Americans out there with some type of criminal notes on their record. While companies may say they are complying, as they have removed the question from their applications, the real violations come if you try to challenge that the record has nothing to do with the job duties, or other mitigating factors. You can’t even get a job at amazon packing boxes. Take employers to task for violating Ban the Box legislation, and you will find good employees.
I have a felony but it was 20 years ago but my employer is working for a base military and the base military makes a background check u think that i pass iam in texas
I don't know how it works in Texas, but if the felony was twenty years ago and you have a lot of work history since then, I think you have a good shot. I hope you get it!

If an arrest is made but there is no conviction, will it show up on a background check and can an employer deny you a job due to this?
Do I have to disclose a felony possession of a firearm I was convicted 20 years ago on a job application in CA?
Or Jobs don't hire because it's just a racist thing not so much the record it does happen alot.

An employer can never ask you about arrests with no conviction unless trial is pending. If a trial is pending, will it show up on a background check?
Yes, an arrest will probably show up on a background check if the trial is still pending.
