@@niggasgang8784 I agree I got so fed up of going to the E shop because every time I opened it I went to see any good deals. He had all those games for sale and I got so freaking mad because I couldn’t find any good games for sale unless I spent 20 to 30 minutes just looking through them.

I had the same question as they didn't used to be on the eshop. It turns out that nintendo used to keep it exclusive to Japan but more recently allowed them for everywhere. So nintendo did this on purpose.
Its pretty common at at end of life cycle, where all new games are put up to fill up space, no matter how weird they are. 3DS had this too during 2019-2022

Honestly at this point Im pretty sure what's "family friendly" in Japan is COMPLETELY DIFFERENT to what's Family Friendly in the West.
They also re release these "games" calling them Complete edition, Ultimate edition, Director's cut etc in order to always appear in the "new" tab of the eshop

Being flippant aside, Nintendo always gave me the impression they were more conscious about this. Maybe it generates too much money for them to ban. Maybe if it was Peach or Zelda images they’d soon remove them.

The only games that I own that even has similar suggestive qualities are the three sword art online games and those are published by Bandai Namco and rated T for teen.

Lots of people have this eye were they "Instantly" know if an image is AI generated or CGI. they do this with still art and movies. But I can never tell the difference. There is actual bad CGI out there but my eyes do not instantly tell in most cases.
I would classify games as any thing where you have to do a thing and its not just still images. Therefor puzzles and hidden pictures ARE games as are Visual Novels . I feel like you aren't even getting the full experience. there are a lot your not finding.

Nintendo oddly allows these on E-shop but also strait up bans Swap Note or other games that let you freely craw any thing you want or send and attach photos or type words that can be read publicly.
The short of it is Nintendo has NO human employees in the job of "look at things made by our customers and approve them going public" No company has such a job for humans. Not UA-cam, Not Facebook . Its all bots mindlessly looking for key words or the company will just strait up ban every thing under one subject on the off chance some one might use it wrong.
Im pretty shore e0-shop does have filters. Im not looking at it now and I don't use it a lot but I remember being able to sort results to at least some extent.
Also most "Adult" products are not as great as they advertise as. You would have to be willing to view and post uncensored content but a lot of things either 1. Never show sexual body parts or 2 don't treat nudity respectfully as an adult would but rather treats it as a child would, as a joke.
Like compare Mad Magazine to the sistine chapel that's how most video games, cartoons, anime and movies hold up vs REAL adult content
