Legally someone can't be on the scooter during transport, correct?

Legally someone can ride on a scooter in Public Transportation. Scooters fall under Other Power Driven Mobility Devices and are covered by the ADA. There are size limitations in the ADA of 30” X 48” and do not fit on to the ramp/lift. The issue comes down to not denying a trip based on someone's choice in mobility device. @Nebraska Public Transit I was told that 3 part scooters cannot have the rider on it during transport due to the risk of it breaking apart in an accident.
