    सरकार अगर ऐसा सर्कुलर जारी करे, की फर्जी सेल डीड मैं अगर कोई अधिकारी का सिग्नेचर मिला तो उसे नौकरी से बर्खास्त के साथ जेल किया जाएगा, तो ऐसा काम कोई नहीं करेगा😮

    4:03 jis person ka kisi property se koi lena dena nahi tha, woh kaise kisi ki bhi property ku SELL kar sakta hai woh bhi through proper Regd. Sale Deed se ? Kya Sub-Registrar / Magistrate ki office mein cross-check mein ye Unauthorised Sale Pakad mein nahi aayega ?

    Saleded is a concluded contract conferring valid title while Sale Agreement only confers a right to purchase a specific immovable property and thus confers a preemptory right. S.54 proviso is very clear. Apex court's judgement not a novel one.

    Buying a property not easy! In India!! Verifying the previous owner not sufficient! Before him the chain of unbroken title and also possesion upto 70 years is necessary. That's what I understand from this video

      Agreement to sale is just an agreement to mention the terms and condition of sale and it is never a proof of sale & whereas sale deed is a document that shows proof of transaction...

    I fully agree that sale deed can not be proof of title. It is only transaction between two parties. Similar situation is with me that my grand father and my father were tenant and in between consolidation

    Is a ownership flat required to be recorded on property card? Property card is only for land or flats too?

      property card is issued only for land properties and not for flats as of now. However government will in future incorporate property card for flats also.

    What about transfer of flats in co operative societies?
    They do not do registry.
    Then how ownership title is proved?

      Transfer Deed is to be registered with Registar of properties or sub-registrar. Ownership is transferred through transfer deed or sale agreement.

    Mere jamin pe partion suit ka case chal raha hai ....isi bich Mera ek bhai jamin ka kuchh hisa kisi ko sale kar diya .....usne possession lene ki kosis ki but Maine rok diya .
    Or Maine CO ko dakhil kharij na karne ka aavedn diya hai .
    Meri us jamin pe 3rd generation hai ...
    Kya wo aadmi mere jamin le sakta hai ??? Ya Mera hi rahega ??

      No without partition 3rd person dont have any right to get possession.. Aplly under order 39 rule 1&2 for injuntion order to stop them to get possession

      Cheque bounce hoga toh cheque bounce ka case karo,fraud ka case kr skte ho, civil me money suit kar sakte ho and cancellation of sale deed k liye b civil suit kr sakte ho.

    Hello sir mere mother ki property ko mere father aur brother ne partition suit banakr apne naam karliya tha begair mujhe inform kiye ab mere ladne par unhone uss partition suit ko cancel karwadiya... ab ye partition suit jo ek fraud tha iske baad bhi indono ka property mein hissa banta hai ya nahi... please bataye !

    The truth/ logic behind this is.. Registrar is not having any obligation to minutely scrutinize the title prior to registration and he is only concerned about state revenue (stamp)... Court can thus declare invalid sale to be void. Nothing new in this judgement..since without any challenge in sale deed it would definitely be treated as title deed for ever.
