Instead of giving him a fine, they should've had deported him without any hesitation...
Considering I'm struggling to be allowed to even enter for a holiday because of a 25 year old cannabis fine. So how the hell did he not get deported.
Joey missed a lot of the most up to date info on the story. They deported him, he can’t renter Japan for 5 years, and even after that if he visits he will be tagged as a convicted felon and monitored.
And banned him
@@Blake_C137 Hopefully by then he won't be such a prick.
@@Blake_C137 If true, that seems fair. Locking up a foreign citizen is always a dicey situation. If a tourist is acting up, getting deported and banned from reentry is the best way as long as no one is hurt.

People like him put UA-camrs like OnlyInJapan jobs at risk when businesses arent willing to allow streaming at their locations
And law abiding people will follow the rule, while people like jonny would just ignore it.
along with CDawgVA and PremierPete
I could be wrong but I don't recall OIJ livestreaming in an establishment or business, in regards to his videos, he doesn't really act out or is obnoxious. I'm sure he knows the culture or etiquette ie: respectfully asking permission, etc.
It's actually all the big streamers and video makers that gave him attention that are the cause of him blowing up so much.
Or Chris's. He has to go through sooo much to make a single video, especially hotels where he has to go through alot of legal paperwork.
Although the legal punishment is absolutely laughable, the fact that his trial was handled in a way that left him detained for months, rather than the 23 day limit, leads me to believe they wanted that to serve as their main warning against future offense.
A "minor inconvenience" should already stop a bunch without opening that can of worm of "Japanese law and prison is inhumane and unfair towards foreigners" which might make things worse afterwards.
The last thing anyone wants is getting people like Johnny Somali being an "activist" (whether in background or not) that hijacks (maybe) real issues within Japanese government and tries to "liberate Japan".
A lighter sentence saves Japan money, shows that they care about context (Johnny Somali had "first offense" as far as law is concerned), shows that they aren't cave in to random online backlashes, and also delivers the message outside prison time through the detention loops and that Johnny Somali had to declare "I was a PoS that harasses random people as a tourist" every single time he enter another country when he gets asked "have you ever committed a crime in or any other countries?".
@@voidmain7902 Oh shit yea, everytime he fills up the embarkation form, he can't even lie about that stuff. It's on the record.
@voidmain7902 dang, I think this is pretty much a perfect take on the situation. With all the context of the situation, I agree with ya.
@@voidmain7902 Yep. These are the best takes. I think everyone wanted a harsher sentence and deportation. But the fact that he was in jail for months and is gonna have to declare that he was convicted when visiting a country is awesome. I don't think Japan is going to allow him to enter again.
Japan looking like a joke and playground to IRL streamers after this case.
Don’t be shocked if more stories of these kinds of streamers pop up in 2024.
Exactly. If Japan is going to set this lenient precedent, then others will copy him.
It is insane.
To parts of the internet maybe. However Japan has to worry about how this will be covered by regular international news & media. How they treat foreign nationals in their legal system matters on a much larger scale then just dealing with clout chasers. Maximum sentences for technical first offence, to what many consider minor crime doesn't look good. Even though it's justly deserved, it's a PR nightmare either way.
@@ikillhaus he should be deported still.
I mean, there is only so much things they can do. It isnt like the crimes he did commit were super wild or anything, The punishment has to fit the crime and all that. He is super annoying but that doesnt mean you can just give him a heightened punishment.

To give them the benefit of the doubt, the judge probably considered his incarceration as the real punishment for the crime with the fine being symbolic.
Also I doubt that he will ever be allowed to reenter Japan and at this point he has vastly exceeded his visa if he entered as a tourist so he will have to leave soon or be arrested again.
I'm against slavery, but...
Japan being too nice is their own fault if the streamers dont hv respect towards japan. I only pity the people who had to suffer this clownery.
As much as I hate the 99% conviction rate system in Japan, this is the only time I was hoping for it to come in clutch ... But welp, that was disappointing.
That's clearly a lie. And I've heard this stat but I don't get it. There are SO many cases of people getting away with rape and stuff. I think they cherry pick cases to keep that 99% stat.
Hes still being deported so dont be too disheartened, joey just missed that update.
@@Kometheus Depends on if it gets to trial or not. If a case gets as far as the courtroom, the chance of getting an innocent ruling plummets (which is where the conviction rate stat comes from, I think). I imagine the cases where people get away with stuff didn't make it to the courtroom.

Only 5 years? Lifetime ban please
02:30 - No, he wasn't arrested in that restaurant in September 12th, he was arrested 9 days later with an arrest warrant due to a another infraction he made two weeks before the restaurant incident, he entered in a construction site of a hotel that was being under renovation, that was the reason why he got arrested in September 21th and he even recorded his own arrest because he started that day his live stream saying that he was followed by a police officer, and then after getting out of a combini he was intercepted by 5 police officers and then after, a little van arrived with more police... But this time it was police inspectors... And when I saw those inspectors showing their badge and I noticed the papers he had on his hand I realized: "he has a arrest warrant", Salami tried to show that he was in control but I noticed that he was becoming very nervous and he realized that he was in trouble to the point declare to the mods to call the embassy (the embassy will not give a damn for him!!!).
So Joey, you got the wrong info ,the restaurant accusation came 3 weeks later and it was also to prolong his detention until they had a solid case, but it seems that they didn't build that of a solid case, they could had accused him of a lot of sh*t he did during his streams...
But at least with this criminal record in Japan, he won't be able to come back to Japan because he will be registered in the border control services has someone that had criminal record, and it will be difficult for him to enter that easily again... Because if you lie on completing those forms that you give to the Japanese customs that you write before landing in Japan... You're forbid to enter in Japan...
Nice, maybe other countries would pre-ban him from coming to their countries to because of this.
He needs to face consequences in his home country. We need to hold people accountable even when they are abroad.
Lol consequences in somalia.
@@barrybb5409He is american, johnny somalia is not even his real name
I suspect, thinking about it, this might be a tactical play - I don't know if it's the case in Japan but there's examples in UK of judges having either an excessively light or excessively harsh touch in sentencing in order to promote a larger legal change. I've seen hints about a full ban on IRL streaming in Japan, one possible interpretation of this judgement could therefore be: "look, we're powerless to control these streamers, we need to push through this ban to have the powers we need!"
Weak punishment leads to a compromised deterrent effect, emboldening individuals to disregard consequences, fostering a culture of impunity and undermining the foundation of a just and orderly society.
Might SEEM like it, but the thing is: his conviction and prison time are on record.
He is lawfully obligated to state this every time he travels, including the reasons behind it. Omit at his own risk (i.e. good luck going places).
All eyes are on him now. And reactions may very well be as expected.
Months in a Japanese jail??? From what I've heard THAT IS PUNISHMENT.
Joey, I’m saying this as an American;
Yes, people have received harsher sentences for public nuisance, but at the same time, we’ve been having an upsurge in violent crime and repeat offenders getting no charges or even incarceration into local jails because of a number of reasons. Race, terrible attorneys, financial/capacity, it goes on. But this is a far greater punishment than he’d be likely to face in the US.
The very fact they actually decided fine Johnny is already an order of magnitude above what he would have received in the US, let alone deport and bar him from the country.
As a fellow American I can say that if he did what he did in america the authorities would be the least of his problems cus he would've been jumped on that train or soon after without doubt
He probably would’ve gotten shot before getting caught by authorities
he would of gotten his ass beat ig he did that shit here in the States man. our justice has been going down hill. because of stupid ass identity politics.
Yeah the public would have been a bigger problem for him than the court system or police. He’d probably be free and sitting around waiting for an initial court date still
@@georgeg.1307 you say that but you're also forgetting that American society is chaotic by nature. Everything he did would be considered normal in any city. Japan lives in harmony with each other.
Now lets see him try this in another country. Japan is a pretty safe country and he only got punched a few times. Lets see if other countries treat him that well.
Perhaps he should try going to Mexico and mocking the cartels....... He could just drive there.
He is bragging about going to Thailand. He could get hurt or killed there. We will see how long it takes for him to get his comeuppance.🤔🤨🙄
@@Keith-rk4tdhe will vanish. Chop chop
Crazy part is he blatantly lied in court saying he had no control over his system streaming, and had no way to turn it off (ummm, an IRL streamer who supposedly doesn't know how to start or start his 'donation' links speakers, or even how to turn off their stream?).... They also ignored where he threatened to hurt Japanese residents if they try stopping him, and even (right on his own stream) said he would physically retaliate and hurt the police if they tried stopping him or touching him... and they also ignored all his other recorded and streamed (evidence) where he repeatedly stated that he owned the Japanese and they can't stop him... and even more bizarrely, the court didn't even seem to take notice that even after his pretend Apology on stream [when some possibly 'Yakuza' members demanded; he then immediately (once they left) went right back to streaming, and saying the Japanese were stupid if they actually believed his apology, and that he's just using that as more "content" to get more views and clout...
They even ignored his other videos -- e.g. from Thailand, where he tried to interrupt the stoppage of some other criminal actions taking place (by another Nuisance Content Instigator IRL Streamer) and falsely tried representing himself as the defendants' Lawyer and legal representative (in order to get access to record and stream the Police investigation against them)... And he had months and months of evidence of his multiple offences through all his streams, so they should have at lease kept placing another charge upon each release [rather than only using that allowed tactic once]
Sadly, it's the legit live streamers (e.g. those promoting Japan itself) are the ones the citizens are now starting to look at suspiciously, and likewise for all foreigners visiting who many Japanese will automatically be thought of as 'more foreign troublemakers)... It's the legit streamers paying the consequences for the Nuisance IRL Streamers while they profit from destroying the reputation of legit streamers.
QUESTION: these Harmful IRL streamers [HIRL -- pronounced "hurl"-- in order to separate them from the legit IRL streamers] seem to go around under the pretense that they have full authority to break the laws of the various Countries and to do/say/record anything they want because that's their "job"... so the question is, do they even have authorized Work Visas [in which they would have to declare their supposed Employer that is responsible for their actions]; because otherwise they're "working" without a Work Visa.
Additionally, if Kick (for Example) is compensating them to provide these streams [and are technically their employer if the individual(s) are contracted and paid through that streaming service to provide that content; then legally the authorities could hold Kick and any of its paid HIRLs actionable with these intentional nuisance stream creations, working in the country without authorization, and criminal activities (which, in truth, are also being committed on behalf of their Kick employer]
Additionally: the "promise to never stream again" -- well, there have already been talks for him to join other HIRLs in Thailand, and you can bet he'll say something like: (1) that only applied to streaming in Japan, or (2) that only applied to streaming in Japan during that visit/stay, or (3) that only applied to my current streaming account and/or name, or (4) that doesn't mean I can't appear on other HIRL streams and have them financially compensate/pay me to participate on 'Their' live HIRL streams... and what stops him from just changing his real name to do it all again
As well, I can easily see him using his 'Japanese Prison Time' as HIRL Clout clickbait bragging

@@Pepe-dq2ib I've talked to someone who spent time in a Japanese prison and it is a pretty bleak situation. He started smoking so that he would get a break out of his cell. 3 months in those conditions is pretty fair for his crime, I would say.
@@XxZannexX For playing loud sounds in a restaurant? Really? 3 years for that? I get it, the guy is a really annoying little sh*t, but get some perspective.
Agree. During that time he could not "stream". Had to think if he does this again.. the same consequences... another 3 months for trial. To me 3 months of not being "free" easily surpasses $1500. Imagine being in a cell. 3 Times a day for meals. Regimented activities. No TV. No internet. No Phone. No communication to anyone other than your cell mates and guards.
This is why the criminal justice system needs to be educated on how streaming works.

It just aggravates me so fricking much man! Ruining not only locals days but also any foreign streamers and or tourists. Just leaving an exemplary impression for so much of Japan
I can understand why. They're people who judge and enforce the laws, so they have to follow it properly. They can't arbitrarily give out heavy sentences because of their feeling. When was the last time you hear someone getting jailed and deported over playing loud music and being a nuisance?
So probably what they did prolonging the case for as long as possible and keeping that pos detained for awhile was the best they could do.
You are absolutely right, a country that respects human dignity and human freedom does not give extensive jail time to essentially "non-violent" petty crime. Even if it is many cases, these are still non-violent petty crimes that I think he was appropriately punished for by having to wait in jail for months.
I would like to see his accomplices face punishment also. He would not have done this streak of criminal nuisance behavior if he could not have profited off of it so easily. The streaming corporations need to face penalties.
Man, that's unfair.
We all know EXACTLY what’s going to happen. He knows he can get away with it now, so he’s going to just go back out there and keep doing this shit, if not even worse. He can and will keep ramping things up until he’s ACTUALLY punished for this.
Love the videos, man. Keep it up!!!
Its so hard for some countries to even get a tourist visa approved for Japan yet they won't even consider deporting him. This is ridiculous.
My understanding was that the time he was in jail forced him to overstay his Visa.
And now he has to leave Japan.
And it is very hard to get back into a country with an overstay on your Visa.
It makes more sense for the Japanese Legal System to get rid of him forever.
I kind of understand that they don't want to throw him into jail over it, but yeah, the fine is so low that it doesn't really serve as much of a deterrent.
Then again, I guess he has been locked up a few months since he was arrested by now? That time might be a better deterrent than the fine.
Keep up the great work and videos Joey love the video

I have heard that Japan often arrest people once they've been let go if they have several charges they can take him for.
So far all we know, he might have been arrested once again on a different charge and will now have to go to court again for a different crime.
He might be stuck in a loop now with many fines coming his way. Maybe even take the most serious crimes at the end to give him a prison sentence.
He should never be given a platform on social media anymore. And if he doesn't stop, there's a chance someone may do something to him

The bigger issue is the precedent that you can do it at least once and still have profit.

I though I read that he was also getting deported/banned from entering the country unless he accept that he is coming in as a convicted felon.
Within the United States, there is this thing called an "amicus curiae" brief, which means "friend-of-the-court". It is legal brief created by individuals or groups that are not involved in a legal case, but have expertise that could be very beneficial to assist the court in making its decision. This is usually done in an appellate court and not a trial court.
I do not know how the Japanese legal system works. I do not know if there is a similar feature within Japanese courts. If there is, it may be VERY worthwhile to take advantage of it in the future. There are plenty of content creators living within or traveling to Japan that are respectful, and whose careers heavily rely on setting a legal precedent of harsh and severe punishment for future instances like what occurred with Johnny Somali. If those content creators formed a collective body and hired a legal representative to write something similar to an amicus brief (or provide expertise on the streaming space to ensure that the court is well informed on how much money someone like Johnny Somali made on the abuse of Japanese citizens and culture, as well as how much control a content creator has over what they are doing).
This will absolutely happen again, and people who stream and record videos IRL in Japan have a lot on the line. Making a solid effort to protect their own interests by lobbying, providing expertise, or whatever they can do is massively important in ensuring this doesn't destroy people's livelihoods and enable this behavior going forward.
Sigh. I was hoping for a more exciting update
Thanks for the vid
That's a big L for the Japanese justice system .
Ikr? Japanese schools don't even have surveillance cameras because Japanese society still has the "faith" or "family" mentality. It's asinine and frivolous.
To say he didn't get any jail time would be inaccurate as he spent like 3 or 4 months in jail as he was being charged with the crime so essentially it's more like 3 or 4 months plus a ~$1500 fine.

@@fuchris8617 detention is different from jail time
Hey Joey, does the figure of Recidivism exist in Japanese law? In which the penalty or punishment can be increased if you have a history of similar crimes.
Would be a real bummer, if they also could use this now as a precedential case for other future annoying IRL streamer.
I call BS on this verdict.
Lmao everyone going "Trust bro, Japan is gonna go hard on him!" and then nothing happened.
I'm curious if they're expecting Johnny to try everything he's been charged with again so they can then re-arrest him and make his punishment a lot harsher.
I thought I read somewhere that they withheld prosecuting the other crimes for now but could bring them about at a later time. I don’t think they were dismissed. I’m hoping that they go after him with those separately. I think he needs to be made an example of.
He is being deported from Japan for violating his tourist visa. On top of that, he has an arrest record. If he were to fly into Japan again, and he lies on the customs form about not being arrested, he's going to automatically get flown back out of Japan at his own expense. If he tells the truth about being arrested, there will be an investigation by the customs officers, and it will be up to customs if he will be allowed to visit Japan. They can make any decision they want, if they don't like him, they can send him back.
In the case of the presented crime, the fine is honestly enough. I 100% agree that the prosecutor should have brought forth past crimes. Even if no one charges him individually, there's definitely some possibility that prefectural entities would have pressed charges if presented with the available evidence. As someone who hates over criminalizing misdemeanors, this is the best way things could have gone.
this sets such a dangerous precedent
Everytime they release someone like him, 2 more show up because they know you can get away with anything these days. Such BS.
9:30 I'd disagree that the sentence would be any different in the US. Public nuisance laws do exist here and are considered a misdemeanor. A minor crime. Generally, the punishments range from a fine to at most a few month prison/probation.
Considering this crime of being a public nuisance and it is only THIS crime on trial, I am not surprised that it is only a fine. Had he been charged with all the other **** he did, then I would have expected either a larger fine or jail time. The court could only look at this crime in isolation, because the other activities have not been charged and there is no "legal" record of them.

The country of Japan has a level of tolerance that I will never understand.
I have lived in Japan for many years and I can tell you you are wrong. This guy spent months in jail for simply being an asshole. In America he wouldn't have even spent a day in jail
Did you really expect him to go to prison for years ? He is a nuisance but he didn't actually commit any serious crime. Chances are is he going to get punched in the face if he goes back to doing it since everyone in Japan knows him now.
Do you even know the laws in Japan? If a normal Japanese citizen were to do the same exact things Mr. Somali did, they'd go to prison for a long time. Trespassing is actually a pretty big deal in japan and it's a crime that could give you a couple years in prison.
Yes I definitely did so it’s disappointing
@@JustADudeDoingSomethingIt depends on the context and location. Johnny walked through an open entrance in broad daylight and was only on site for about 60 seconds, not really enough to convict someone of. A demented old Japanese lady could do the exact same thing and get no consequence despite it still being considered trespassing.
@@fuchris8617 There's a difference between intentionally committing a crime and accidentally committing a crime due to health complications. There's a reason why mentally deranged psychopaths get put into mental institutions and will eventually be free to roam society again instead being put in prison. Jonny literally has it on camera with presumably a healthy state of mind seeing as he was still aware of qhat he was doing, yet still got off free.
I highly doubt Japan is throwing people in jail for 2 years for a minor trespass in a hotel. @@JustADudeDoingSomething
I'm pretty sure he's now not active anymore ever since to actually being punched by few and finally got banned after harassing a vlog streamer
"I'm sorry sir I'm not wrong for this ringtone on my phone, I did not cause it, the one who called me did"
"Silent mode, what is that?"
How is he not locked up yet, this is so infuriating.
I mean... he was locked up for 90 days
@@frozencrow8735 That's 90 days.
@Xominus yes that's indeed 90 days, but what would you expect from non-violent crime. Keep in mind this is not US where people get 10 year sentences from random stuff.
Some commenters have said that it's been confirmed that he's getting deported and is going to be banned for 5 years from japan and after that period has ended if he visits japan he will be monitored during his visit, but none of these claims have been verified yet
@@frozencrow8735 It's a violent crime, it's unacceptable. No way you count 90 days as being locked up, it's 90 days were talking about here.
@Xominus 90 days is actually quite long time for 1st time offender in civilized country
If only UA-camrs and Streamers in Japan like you, Garnt , Chris Abroad , Connor, OnlyinJapan, and many others get together and sue him. And the government should create a new law separate for content creators hooligans- higher fines than regular normal people
In many countries you can't get with doing that anyway, so it's not a situation unique to Japan. I only wish they do more of those fines where it's a percentage of their earnings.
In many countries u have to get permission first before streaming and those streamers use some nasty audio alarm if they get subs or donations it's really annoying if ur a customer there and have to deal with that nonsense....
This is a good example of "if you punishment is just a fine, it's only a punishment for the poor". Fine crimes should be scaled to the income of the offender.
4 months jail time (basically a 4 months ban from streaming), 200000 yen fine, deportation, 5 year entry ban due to overstaying his visa, and a criminal record under his name (high chance of denied future entry) is pretty good as far as punishments go. He’s gonna be irrelevant by then so he’ll likely have to get back to working at MickeyDeezNuts.
The live streamer I watch seems to use an earphone so he can talk to chat and the streamer he may be hosting, but most can't unless he makes the changes to the settings
The courts need to start looking at the pattern of behavior. I'm not talking a "three strikes rule" or something like that, but every police report should be taken into account if he finally went to trial.
Getting held for 4 months and then fined on top of that isn't exactly what I'd call "getting away with it". Given the low severity of his offenses, people expecting him to get the maximum sentence were delusional.
This, and I also don’t believe that other streamers would feel encouraged by this incident to do the things he did and face this much of a punishment, on top of worldwide hate on the internet.
@@beige_projectionThat’s also fair enough.
@@beige_projection you've never been detained have you.
@@lo0ser555 I've not. Have you been detained in Japan?
i havn't, i was detained in a much better place than japan, and it still one of the worst experiences in my life. i do know people who have been detained in japan, and even been to prison there.
you do not realize the mental toll of having you freedom of movement taken away. the boredom of complete social isolation. and on top of that the horrifying uncertanty of what happens next, what punnishment will you get, how much longer will you be detained. you wont know anything. not what will happen tomorrow. not what will happen the next month.
you calling it a holiday is very ignorant.
He set up that audio, no excuse. Snowflakes always deflecting blame and avoiding consequences
that fine should have been 20% of his total all-time streaming earnings or $1 Million USD (which ever one is HIGHER) plus the costs for keeping him in jail.
I wonder why this guy's trespassing charge was dismissed. I saw a video ~2 weeks ago sharing the story of a regular exchange student (so not a streamer) who trespassed when he was drunk (he thought the building was abandoned), he was put through a fair amount of ordeal - and the only reason he could get away with a fine and an apology in the end was because he didn't know the building was still used (and because he was drunk). But this dude deliberately trespassed.
