My son was being bullied so bad, and i kept telling him to be the bigger person to talk to a teacher. They never did anything. It became a problem when i told my son to beat the breaks off their face. Thats when it was a no-no. I went to speak with the counselor, and she was more focused on my son fighting back and not getting a teacher. When i told her, "He's been talking to YOU, YOU SPECIFICALLY!" She said she didn't remember. I left that meeting so pissed, I made arrangements to have him do online schooling through a private school before i left the property. I made calls and got him enrolled in my car before i left the school. I semt my son 1 more day to school so he could get phone numbers of his friends and get his things. Schools only care when kids snap and go postal.
School is the one place our children should be safe. At your work if there’s an issue you’re fired. Why do we tolerate violence at school?
Home is the one place they should be safe. School is the 2nd.
School is very dangerous I got jumped by 4 big black dudes in high school although I did have it coming
School dont want to deal with anything. My nephew, who is a little slow, was beat up at night time by some kids from his school, which was a private high school. Lots of money there from out of the country kids. The school never did anything about it , but the mother luckily went after each and every kid who beat him.
She started it.
And so is church look what happens there?
They clearly said, “I blacked out”. A scan should’ve been done
When I was jumped as a teen, the first thing the ER did was a scan. I think that is protocol. My mom was still instructed to watch me through the night and to wake me periodically.
They couldn’t find any trauma above scratches.
Closing your eyes isn’t blacking out
Yet the M.E. stated there was no trauma, their initial findings plus the footage from the E R totally contradicts Nex and the family's version of events.
autopsy says no trauma. so a scan wouldnt have helped.
@@espenbjerke1905of course it would have! They would have been able to diagnose the issue early and treat her
So hard to watch them both knowing mom’s world soon to be irrevocably crushed forever. As a mom, unimaginable. Prayers for mom and family for a peace which passes all understanding. She finally stands up for yourself and gets punished eternally. 😢
Go tell the office. She has no right to assault anyone because someone says something. I get it though, you come to a breaking point but it doesn’t excuse the fact that she started the physical altercation. This LEO explains things so well. I hate it for all evolved
Throwing water, not the cup! No excuse for the outcome. Breaks my heart😢
@@denisevulgaris276 the officer explained it very well. Doesn’t matter it was just water could’ve been acid the crime is she assaulted the girls first. There is no evidence that the fight is why she passed away at this time. It’s definitely a sad situation. Children should be taught you don’t assault anyone based on mere words. I believe she may have only aimed at one but she may have hit 3. There’s just not enough information released yet.
I’ve seen countless sudden deaths from simple head trauma.
When a person ( after initial head trauma) is alert, coherent & orientation to time person & place their likelihood of survival is 85%.
It’s the first 72 hours most swelling to the brain happens then causes death without medical care.
She’s so alert here, it’s more than probably, regardless of brain swelling and deterioration, she would of survived if she was medically supervised.

Head trauma is very serious, need to go hospital for head scan.
A cerebral hemorrhage would show up in an autopsy if this played a part in Nex's death. Which the medical examiner ruled out.
Yes I know it was ruled out, just stating an example of what can happen
One cannot say a trauma related death can be ruled out unless one has full access to autopsy and other ancillary medical reports from their initial admittance. In 5th grade i had a kid on the bus who from day 1 would bully me and tease the whole 45 minute bus ride. It was so bad for me i talked my dad into letting me ride my bike to school which was 10 miles one way. Finally I told parents and they called the school and school said they would handle it. It got worse for me after that. It took my dad going over to his house and having a talk with them. I was so scared when i had to face him. It worked though. He never picked on me again. He called bullying " banter" smh
Why? It’s a cops job to be impartial. For the cop to call it “bullying” without investigating both sides and the history of the two parties then it would be inappropriate. Just because Nex says it’s bullying-and from their perspective it could feel that way- but it doesn’t necessarily make it true. The other girl(s) may have a different story or feelings about the situation. The other girl(s) may feel that Nex has “bullied” them or slighted them in some way(s) in the past. Teens are notorious for misunderstanding how to read people as they are young and just trying to navigate their world.
You, however, taking sides and calling it “bulling” after just hearing one side leave me smh
@@scrumps101you are brainwashed by trumpist media.
They killed a child that is insane and must lead to severe consequences!
Here’s what I will say police deal with this kind of fighting every single day, I don’t know that I am that upset about this police officer, not taking this fight as serious, looking at this teenager who does not look on the outside like what is happening on the inside. That said, the hospital once it was said that she blacked out, the hospital absolutely had an obligation to run a CT scan, that would’ve caught any brain, bleed or damage that can happen in a simple fall. I think this video shows the main culprit is the hospital. as for the police, I do think they minimize these fighting things because they see it so much. And that’s unfortunate. Parents need to teach their children that even unintentionally, you can end someone’s life if they hit their head. There is no reason to ever have a fight. But they’re teenagers.🤷
This is how systemic bullying is continuing in schools. Shifting blame to victim.
@@scrumps101 I think that we need to get out of the political narrative of this story, this child is dead. It’s not the officer’s fault that this child dead, and quite frankly, even if he would’ve been like you’re right, you’re a victim, this child would still be dead because the hospital failed to do a CT scan. And it doesn’t matter that this child identifies as LGBTQ, or not, because if this would’ve happened to the other kids, and they would’ve died, it would be equally upsetting. Teenager dying after what appears to be a small fight is unacceptable. And I don’t understand why anyone is coming down on this child, as if she did something bad to deserve to die. Because that’s what it comes across as. I actually have compassion for this officer who probably now regrets parts of his conversation because he didn’t know what was going on inside the child’s head. And I am sure that he wishes that he could’ve changed the trajectory of this, ultimately, the blame lies with the medical field.
"Hopefully it doesn't happen again." Brings me to tears bc no way could she know her child would die

Non binary! Don't misgender! Conserv's like you disgust me!
What's crazy is a person can have a head injury and seem so normal, but then suddenly as the brain swells, take a sudden turn for the worse and die. This is why they say you should ALWAYS watch for signs for a few days after. The fact Nex looks fine and coherent doesn't mean they are not suffering from head trauma. It's just the head trauma got worse from mild to severe over the next 24 hours which can and does happen, leading to sudden death or disability. Throwing water isn't an excuse for beating someone this way. Assault vs assault and battery one is not inherently deady, one can be.
EDIT SINCE YALL CANT READ VUT KEEP REPLYING "iT wAsNt TrAuMa ThE aUtOpSy SaId So"
First the autopsy didnt day shit. There hasnt been a finalization of it and likely wont have one for a bit. The Police were irresponsible reporting that fact before it was finalized. You all need to stop being sooooo sure in your incorrect views. In death certificates and cause of death, it may not say trauma in a case like this. For example, in the horrible case of Savana Greywind it didnt say she died from trauma despite the violence she endured being a type of trauma. It was listed as homicidal violence. There may be a secondary as blood loss due to trauma, or something else after, but I didnt read the entire report because it was horrible.
Just because the cause of death isn't ruled YET as trauma means nothing. All it means was they did not die at the time of a traumatic injury. It was the next day so it wouldnt be listed as death from trauma. There will likely be a determination of accidental, homicidal violence, or something else, followed by for example brain bleed secondary to trauma. Etc etc. learn how shit works before spewing stupidly. Thank you.

Kudos to this officer. He handled this well. The school and the HOSPITAL did NOT. Whenever a patient says they lost conciseness, they get a CT Scan and X-rays. Death can occur days, weeks after a blow to the head. The ‘bruise’ on the brain can bleed slowly. It also can come from mild head trauma, depending upon several factors. The patient may not have symptoms until it’s too late. I don’t know if that is what occurred with Nex, but let this be an opportunity for us to learn about traumatic brain injury. Godspeed to Nex and others bullied. The school dropped the ball.
They should have drug the girls into the office. Suspended them until they did a thorough investigation. This would include brining in the parents to discuss the incident. They should have contacted the police to deal with any criminal charges. Furthermore, the police would help the school investigate.
The police officer explained all points of law as it applies in this case. If you touch someone, with anything they don’t want to be touched with, it’s assault. That includes water, ribbons, paper towels etc. He also explained that the person that makes the first move is held accountable by the law. He explained these laws are not always fair, but that’s what they were up against due to them. He wanted them to have as much information as possible. It helps a victim to know what they are up against. He could have simply taken the report and walked out. Instead, he chose to spend his time helping them understand and hold the school accountable for not initiating contact.
Except they’ve already ruled out trauma. That part of the autopsy is done. It’s toxicology we’re waiting on.
They’ve already ruled out trauma so where are you getting “traumatic brain injury” from? This is how misinformation gets spread.
I didn’t think he did a great job. Some of it maybe. But equating water with a beating by three girls after these girls had bullied and bullied and bullied Nex.

7:37 Officer Thompson “I will also tell you though…” This is where the officer starts placing blame on the victim. He has glossed over the statements of harassment and bullying - which are against OK law.
7:44 Officer Thompson seems to be giving legal advice as he starts speaking for the courts.
7:48 Thompson calls this a mutual fight but doesn’t address three attacking one.
7:48 Officer, “Both parties are victims, but both parties are suspects in this YOU GET WHAT I’M SAYING” This is said to deter the family from making an official report.
Officer does not advise how a court may also view
Proportionate Response to the water being poured.
Did the water cause fear of harm? Was a beating by three a proportionate response to the water?
Provocative - a court may look at days of bullying as provocation for the water.
Reasonable person - would a reasonable person be in fear because of the water
History of bullying - the court may review the records or witness statements to see if the three had previously been involved with bullying other students
Just to name a few things that may be considered. The officer oversimplifies the incident to the shift blame to the victim and what I think is gaslighting and manipulation. Basically he’s telling them Nex will be the suspect if this is pursued.
7:56 He reiterates “You’re the offender as well” but again, this over simplifies the incident and what led up to the incident
8:09 “She was the one who initiated it” but completely omits the unwanted comments, making fun of their attire, throwing things in the class - bullying.
8:11 Officer Thompson begins his spiel about “Freedom of Speech” which is erroneous because students have limits on what they can say in a school setting. This is also covered in state law about bullying and school policy. Students have limits on their freedom of speech but Officer Thompson says this to lessen the culpability of the bullies. He’s basically saying verbal harassment is ok “all day long”
8:31 Officer states both parties had equal opportunity to separate. True. The bullies still had the opportunity to separate after the water. The bullies then went for Nex and grabbed Nex by the hair, at this point Nex did not have the opportunity to separate.
8:35 Again, the officer shift blame to Nex “ it’s not going to be in the best light for you” but this is unbalanced when events are dissected. Officer comes across as goal is to ensure family does not file a report.
8:36 Officer states “I can absolutely do that. If that’s what you like I’m just telling you it may not go the direction you want it to go.” More emphasizing what can go wrong to deter the family.
8:44 The officer states, he is not the judge and he is not the jury. He is just here to say this is the facts. This is what’s presented. However, he’s already spoken for the judge, the jury, and the court.
8:51 Officer, informs mom that the juvenile cannot make the legal decision she wants to proceed with it he will write out a statement and document it.
9:03 The officer states “by her own admittance on camera, as well as whenever else she essentially started it, you see what I’m saying.”
Again, officer over simplified to frame this as the victim is at fault and officer dismisses bullying which reflects the systemic bullying issues. In the initial interview Nex stated they didn’t see the point in reporting the bullying. Within the nine minute conversation, the officer never makes a statement which would indicate holding bullies accountable. Had the three females not been bullying Nex, it is unlikely Nex would have thrown water on anyone.
The officer gets an F in my book for job performance as a school resource officer or liaison, whatever his actual position is. He is part of the problem emboldening bullies by lack of accountability and putting students such as Nex in danger.

This is defined as bullying by Oklahoma state law and Owasso schools board policy.

Officer does not ask what was being thrown at Nex or mention this could be considered assault.
2:02 Officer minimizes the fact Nex was being bullied by referring to this as “banter going back and forth.”
2:21 Officer has asked if Nex reported this behavior and why not. Nex responds
“I didn’t really see the point.” This likely indicates the previous bullying experiences Nex endured were not addressed, identifying a systemic issue of bullying. Officer does not address this.
2:37 Officer again refers to bullying as “banter” to minimize and downplay the issue.

4:32 “My friends tried to jump in and help” It is not distinguished if the friends were trying to break up the fight and help Nex up or join in the fight
4:32 Nex states “I’m not sure I blacked out”

4:50 Officer states he will follow up with school tomorrow
4:52 Officer states “any criminal type action the school is supposed to give us a call”
5:00 Officer states he’s not making any excuses for the school but then proceeds to make excuses for the school

First, blacking out doesn't just 'casually' happen. ANY head trauma that has an episode of loss of consciousness should be taken seriously. What's not said is how long the LOC was but it was long enough that Nex missed the finality of the fight.
We know now that they had a loss of consciousness. We know that the next day they were unwell and fell unconscious. And then they died. If the fight was not that traumatic, a person isn't going to "just die" after an assault. Something happened after being released from hospital.
I do not think that the fight can be ruled out as the cause of Nex's death. That it is certainly makes me suspect and I hope the family gets a second opinion.

“In legal terms, a “proportionate response” refers to a reaction or counteraction that is reasonable and not excessive in relation to an initial action or provocation. The concept of proportionality is often applied in contexts ranging from self-defense in criminal law to international warfare under international law. In the context of personal or physical conflicts, a proportionate response would be one that is necessary to defend oneself or others from harm, without exceeding the bounds of what is necessary to neutralize the threat or stop the aggression.
Scenario Analysis:
1. Splashing Water as a Response to Bullying: If a student splashes water on others in response to verbal bullying, this action can generally be seen as a non-violent and relatively harmless way to express displeasure or attempt to stop the bullying behavior. Legally, this is likely to be viewed as a minimal, non-aggressive response to provocation.
2. Physical Attack Resulting in TBI and Death: If the students who were splashed with water respond by physically attacking the other student, causing serious injury or death, this response is disproportionate to the initial act of being splashed with water. The use of physical violence in response to a non-violent act can be seen as excessive and not justified by the initial provocation.
3. Culpability of the Attackers: The students who responded with violence could be held legally responsible for the consequences of their actions, including any injuries or the death of the student. Depending on the jurisdiction and the specific circumstances, they could face charges ranging from assault to manslaughter or even murder if it is determined that their actions led directly to the victim’s death.”
1) Nex and her friends (at least one was a biological male) outnumbered the three girls
2) Nex and her friend went after the girls and she filled up her waterbottle before entering, which could imply premeditation
3) Nex instigated the fight in response to harmless comments not even made to her and her friends and also admitted to throwing one of the girls into a towl dispenser
So not looking good for her..
Splashing water Is assault under oklahoma's definition of assault. I agree with the disproportionate response, but if Nex survived both would have been charged. Obviously they didn't and that's sad but Nex didn't know these kids and decided to pick a fight. Either way she assaulted and then got assaulted and battered because of provoking a response. “The assertion by a School Resource Officer (RSO) that students engaged in bullying have a First Amendment right to say what they want is a misinterpretation of the First Amendment's protections, especially in the context of bullying in schools. While the First Amendment to the United States Constitution does protect the right to free speech, this right is not absolute, especially when it comes to speech that constitutes harassment, bullying, or threats, which can create a hostile environment that interferes with a student's ability to learn.
### First Amendment and Bullying:
1. **Limits of Free Speech:** The First Amendment protects freedom of speech but does not protect all forms of speech unconditionally. Speech that constitutes bullying or harassment, particularly when it targets specific individuals with the intent to demean, intimidate, or harm, can be subject to limitations and disciplinary actions in a school setting. The Supreme Court has acknowledged that schools have a duty to provide a safe learning environment, which can include regulating speech that violates anti-bullying policies.
2. **School Policies and the Law:** Schools are required to enforce anti-bullying policies that comply with state and federal laws. These policies often define bullying in a way that includes verbal harassment, physical violence, and other forms of intimidation or harassment. Schools have the authority and responsibility to address behavior that disrupts the educational environment, including speech that crosses the line into bullying or harassment.
3. **Misuse of the First Amendment Argument:** Telling a victim of bullying that the aggressors have a right to free speech as a way to dissuade them from pressing assault charges is not only legally inaccurate but also ethically troubling. It misrepresents the balance between protecting free speech and ensuring the safety and well-being of students. Furthermore, if bullying escalates to physical violence, as described, this clearly moves beyond protected speech into criminal conduct.
### Legal and Ethical Considerations:
- **Duty to Protect:** Schools and their staff, including RSOs, have a legal and ethical duty to protect students from harm, including bullying and physical assaults. Attempting to dissuade a victim from pressing charges by inaccurately citing the First Amendment fails to uphold this duty.
- **Consequences of Misinforming Victims:** Misinforming victims about their rights or the legal protections against bullying can have severe consequences, potentially discouraging them from seeking help or justice. In cases where the victim suffers serious harm or death, the failure to act appropriately can lead to legal liability for the school or individual staff members.
- **Pressing Charges:** The decision to press charges in cases of assault is a serious matter and should be guided by accurate legal advice and a thorough investigation. Victims and their families should be supported in seeking justice through the appropriate legal channels.
In summary, while free speech is a foundational right, it is not an unlimited right to bully or harm others. Schools must navigate the delicate balance between protecting free speech and ensuring a safe, non-hostile educational environment for all students. Misrepresenting the First Amendment to dissuade a victim from pressing charges is not only inaccurate but undermines the legal and ethical responsibilities schools have to protect their students.”
Seems like he was trying to talk them out of pressing charges. This is pathetic, and the reason so many people hate cops.
This is not something the officer can chase after. As you said, it's on the school to enforce this, not the officer. While he may not understand the exemption of the first amendment on school grounds, he does understand the original basis of the first amendment. That's what he's trying to apply here because he's not aware of this exemption in schools. Cops are not lawyers. They can't know every law they enforce sadly, but we hope they get the proper training.

It's been confirmed that there were drugs in her system and that was the cause of death, I agree it's horrible, a young person's life is gone but facts are facts, she admits to the cop she started it with pouring the water on them, even the cop tries to convince her not to press the charges because it wouldn't go the way she wanted it to. She WAS a bully It all came out within the last week of how she would treat people and speak to them, she started the fight, she lost and went home after this interview and done a load of drugs...
She doesn’t look like anyone beat her face.
But her jaw clenching is an indication of drug use. And mom sure talks fast. I'm going with meth laced with fentanyl. I would not be surprised if mom was too busy flushing the dope and denying any drug use to get her daughter a lifesaving dose of Narcan.

“Law Enforcement Guidance:
• Advice on Filing Charges: Law enforcement officers should provide factual information about the legal process and the options available to the victim or the victim’s family, including the filing of assault charges. It is not the role of law enforcement to advise against filing charges based on speculative outcomes of judicial proceedings. Victims have the right to seek justice through the legal system, and decisions on the merits of the case are to be made by a prosecutor or a judge.
• Recommendations: Law enforcement may recommend seeking medical attention for any injuries, documenting the incident, and providing any evidence that could support a case if charges are filed. They might also refer the case to the school’s administration for further action according to the school’s policies on bullying and violence.
Law enforcement should remain neutral and provide guidance based on the law and the protection of individuals’ rights. Advising against filing charges based on speculation about how a judge might view the incident is inappropriate. Instead, their role includes investigating the incident, gathering evidence, and possibly referring the case to the prosecutor’s office to decide on filing charges based on the evidence and applicable laws.”
He told her she could press charges just warned her that because Dagney was the aggressor she would end up being charged also and was more culpable.
@@Kimwed2b That would be up to a prosecutor or judge, not a cop. They don’t always bring charges.
The officer should not give definitive terms - he doesn’t know what the judge will do and I doubt he is authorized to speak on their behalf.

Rest in Peace

I’ve got a lot to say about this but unfortunately you can’t really pick a side here until you know why they actually died. To die a day after a fight in which you blacked out does not bring a good look to the ones who jumped you.
Thank you for being logical and not jumping the gun.
Why doesn't matter in the courts
@inamerican so people who recognize a hate crime aren't logical? What? Got it.
Jumped her?
She started the fight by her own admission
@@miguelito2361 yes, jumped. Nex, was jumped by 3 girls. If you heard what they said at the ER they said they were jumped by three girls. Were they wrong for opening their mouth to make someone wanna push them? Yes.does someone mocking you warrant a physical response? No. We don’t know exactly why they died yet…but as I said previously in my original comment, it’s pretty sus to die the day after you “black out” from getting..jumped.
It has been determined that her death was not a result of sustained injuries from the confrontation.
That has not been confirmed- they died a day after blacking out. Full autopsy is not out. People die all the time after a head injury. They blacked out!

Astounding how after weeks of bullying her throwing water at them is “starting it” and makes it acceptable for them to beat her up. Unreal.

Those 3 POS’ should be charged for assault. If the beating had ANYTHING TO DO WITH THE DEATH, THEY SHOULD BE CHARGED WITH MURDER.

And the girls also committed assault when they beat the shit out of this girl. The law draws a line between self-defense to subdue the threat vs beating the shit out of someone. Water thrown at you, does not equate beating the sh*t out of someone to get rid of a damn water threat. Also if it was 1 vs 3 the girls are also cowards OVER water being thrown.

It's has been said that Nex preferred He/Him pronouns. Pls be respectful
There is no marks on her at all.. but they ganged up on her huh.. I think the girl is very confused way before the problem at school happened.. she also was the aggressor.. I do find a very very alarming that mysteriously she's not with us no more.. and I think that part goes deeper with something to do with the hospital
Everyone is saying "they". How many girls died???
Nex was non binary they used they/them pronouns
There were multiple Nex's, I suppose????
she is nonbinary which means she goes by them/they as her pronouns.
She went by boy and now sh goes by ☠️
@@plsstop284 "Non-binary"? She failed math? That's irrelevant. Yes I know she went by them and started a fight with them, but why are they saying more than one girl died?
So basically she started a fight with 3 people , got her ass kicked and wants to play victim 😂 smh .. next time don’t throw shit at people
So wait... she was already suspended prior to the fight? ISP refers to In School Suspension.
For vaping or something with a vape
In school suspension is different from regular suspension. I looked it up and it seems to be that she can still be in the school just resitricted from some spaces
In my school, it was called ISS. In School Suspension. It was a small room where we would spend all day if we got in trouble but not enough trouble to be suspended or kicked out. It was usually for 3 days. Sometimes during that day we would have to go clean trash from the parking lot or something like that. It was embarrassing because the room was right across from the lunchroom where everyone could see us lol We had to eat lunch in there too. Anyway, that was over 30 years ago but sounds like that's what she was in for having a vape at school
I wondered why these students were stacking chairs. Is that like "community service" for school discipline cases?
No, it stands for Individualized Education Plan. It's usually the private school version of an IEP for public schools. Basically, it's a education plan that is specific to a student with a diagnosed disability.
This officer is wrong. The girl who threw the water, it would only be simple assault. The other girls should have been arrested for assault bodily injury. Those girls that jumped her who she did not throw the water on, should absolutely be arrested and charged with BI assault.
And yes, school should have absolutely called the parents. The school is liable because if she blacked out, she should have been seen by EMS and parent could have take her to the hospital right away. School is liable. This officer is also wrong. He doesnt know the law and school procedures and laws.
Agree. But she put the wheels in motion.
I feel so bad for this undisciplined misguided girl. Look at her giggle and smile at 16:39 over being suspended. No sense of shame, no sense of right and wrong, just random fights for no reason. She seems to think it's cool. Too many adults failed her.
Bingo!
she was being harassed about her gender, why is she to blame for this. it wasn’t a fight for no reason
