I’ve been involved with 1000s of acres of farmland leases and hunting rights are never included - maybe years ago (30 plus) that was a common practice, but now it’s a minority
You did have permission. Unless it's written in the lease that the renter has a say over who hunts his land. If it's not you guys were dead in your rights to be there. We had to on our farm. It comes down to a liability issue.
If it was my land I would have talked to the person leasing the ground. The issue is between the owner and the tenant. You are not at fault at all I would have never even talked to you. Did you give them permission to hunt? Yes. Ok in the future let me know if you would. Is it ok then? Yes I don’t really care as long as I know. Most farmers I know have no use for geese.
Why is this man worried about shooting geese the population is up and the land need the population managed. But let the loose crop and then they come out to get help ! Sad. Most states have hunter harassment ! 🙏🏼 keep doing the right thong boys. We hunters need that 2 help long term !!👨🏻🚒👍
I hunt in MT and SD usually the main person you need permission from is the person who farms the field. Idk what the legal rights are but I’ve never run into this issue. Usually if you have permission from one or the other everything is fine….. That being said you guys are extremely cringe and your hide was horrible. That’s why they weren’t working your spread very well.
If he leased it to the farmer for crop he doesn’t not have right to tell you what to do. He has a contract that is giving up his rights for the year for the field. Look into the agreement I’m not wrong
Leasing for hunting and leasing for farming is two different agreements. If the farmer doesn’t have hunting rights then he can’t hunt or allow hunting on the property he only has rights to farm that land. There are many land owners that lease farm land but reserve the hunting rights to the land. I hunt land that has two different hunt agreements the land owner reserves the right to deer hunt it but he leases it to a quail hunting outfitter for quail hunting. In the agreement the landowner can’t quail hunt or allow guests to do so and vise versa. All land lease agreements must be in writing.
The issue is it all depends on what was agreed on. If the lease only states farming and farming only. But if the lease doesn't say anything about keeping hunting rights or anything like that. The farmer or lessor retains all the rights. But this also goes state by state. But guess what....if things go haywire....you might not get the farm lease or other lease the next year
