Exceptions can be made to return home when you get permanent residency based on asylum. I had to attend a funeral service of a significant close relative. Of course, always consult a lawyer before doing this. The journey to my COP and back to the US was relatively smooth. I of course applied for an RTD and had to expedite (that meant being on the phone with USCIS for 2 hours at work). Also, I don't recommend traveling to the COP with a RTD, it can actually be offensive. Luckily, my country of persecution passport was still valid. I used my RTD when I returned to US at immigration along with GC. Now please, don't use this as a joy ride, its for circumstances where a relative is dying or something extreme. We'll see in a few years when I apply for citizenship if this all holds up. But I was told by my lawyer my situation happens all the time. As long as you are not returning for fun, it is ok. But at a minimum, get the RTD and have your green card and keep your stays very short. Left Thursday, got there Friday, left Saturday kinda situation. Also, if you can have a relative meet you in the US or a third country, its always preferable.

My relative is from Afghanistan but he has been born and raised in Dubai and currently stays on 2 years residential permit. Now he received B1/B2 visa and entered the USA. Though he is born and raised in Dubai but he is not a resident (passport holder) and Dubai government does not guarantee him to stay in Dubai and he also cant return to Afghanistan as the situation is very worse in Afghanistan. He Would like to stay in the USA and seek asylum. Is it a better alternative?

If you were truly requiring asylum, wouldn't the government of your country be ready to arrest you when you showed up?

This could be a hard case. They'd have to show that their home country would not protect them from the family members. Jim
