- The International Court of Justice (ICJ), the principal judicial organ of the United Nations, is holding public hearings from 19 to 26 February 2024 on the request for an advisory opinion regarding the Legal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalem. These hearings are taking place at the Peace Palace in The Hague, the seat of the Court, under the presidency of Judge Nawaf Salam, President of the Court. In this last session, we heard from Spain, Fiji, and Maldives.

Fiji is talking about Oct.7, 2023 where the attack was carried out on illegal settlers of occupied lands by HAMAS who are not recognized by the internation bodies as representative authority of Palestinians. So they can be considered as a resistance force which is legal as China mentioned against prolonged occupation.

I am feeling a little anxious after listening to these good and learned people state their legal view on the inlawful occupation of Palestine and Israel's crimes of genocide. what exactly is the power of the ICJ? Will they be in a position to ENFORCE anything at all? Is it yet another pantomime?

I am 80 years old - have empathy. Have determined when "nodding off" is likely & insure room vonditions not warm/stuffy, sip water constantly, do deep breathing excercise quietly in chair, rise from chair & walk behind the seated judges to improve blood circulation. Elder judges' requirements to assist alertness for the whole of presentations needs to be accommodated by the Court.

Fiji makes the intelligent remark of mutual respect. There seems to be disagreement on whether the Oslo Accords are legal or legally binding. The ICJ could provide clarity on that. I think the ICJ can provide clarity on some of the interpretations of different parties to give a clearer path to a solution, like the Arab's claim of illegal conduct on the Treaty of Versailles. At least there should be clarity on how to move forward and not just ignoring the long lasting issue. If need be the ICJ could request additional information, possibly directly from the League of Arab Nations to back up their claim. The ICJ cannot give absolute rulings without hearing all sides to the conflict, but they could provide guidance.

Fiji representative's reasons are completely nonsense. If his points are to be taken, i ask should Palestine have a military occupation in Israel because of how unsafe Palestine is because of Israel? Is this a proper way to deal with this situation? Is this the proper way to peace process? Absolutely not. Fiji's representative reasons are counterintuitive.
Furthermore, Russia felt threatened by NATO moving troops along the Ukraine-Russian border. Does this justify Russia putting siege on Ukraine and killing Ukrainian civilians on the grounds of security and safety? Absolutely not.
It's appalling to hear him support a military occupation in Palestine that has already costed hundreds of thousands of Palestinian lives and hundreds of Israeli lives. And it is not only the dead who suffered, the living will continue to suffer because of this military occupation. How is this a mean to peace? A military occupation will only lead to more senseless bloodshed for both sides.
When there is injustice, expect rebellion to follow.
The world needs to decide which standard the want to hold Israel to. On the one hand, they want a free independent Palestinian state, then they complain when Israel is treating Palestinians as one. Here's a few examples. Israel is not governing the west bank or Gaza. That's the PA and Hamas respectively. They are empowered to provide education, health, security and legal framework. By the way, the Spanish guy accidentally mentioned that according to international law, Israel cannot interfere with self governed initiatives (I'm paraphrasing). For example, Israel does not apply Israeli laws on Palestine because it did not annexed it. Instead they have their own legal system, courts etc. Israel is applying military laws because that's where the encounter are, in a military setting. Israeli arabs live by Israeli laws. Let's talk about 2005 withdrawal from Gaza. Israel did not start the blockade right away. There were elections in Gaza, Hamas won, then the US and Israel claimed there was intimidation and cheating, they asked for another round of voting, with international inspectors. PLO won which prompted a civil war in Gaza. After Hamas won, Israel closed its borders with Gaza and prevents goods from entering uninspected. Imagine if Gaza WAS a state, and as a state it threated Israel. Would Israel be prohibited from monitoring if sophisticated weapons are going in? I think its called an ambargo, and while usually we don't enforce it this way, this is not a usual conflict and Israel is not going to leave the responsibility of it's safety and existence to countries that proven to not care, let alone hate Israel and Jews. A lot of criticism of Israel is legitimate. It needs some tough love. But Palestinians need tough love too... we must acknowledge that Hamas and the likes-of are not a fringe extreme group. They are the government. If we had elections in the west bank they would win. Palestinians support the violent resistance. It is by far the greatest reason why we can't end the occupation.
