I’m not a lawyer or a legal scholar, however, by listening to the experts and doing some research on Nigerian electoral laws since the appeal court’s ruling, it appears that INEC has too much power, including discretionary ones which they can apply as it suits them. When this happens, no one can challenge them and win. Until the law changes, INEC will continue to play MAGIC on Nigerians.

You are very correct. The INEC deputy director couldn't explain how the glitch managed to avoid other results and only affect president results....
He also confirmed that they also did not report the issue to Amazon not during the elections and not after.
But 4 months afterwards they couldn't tell the nature of the glitch.

The question is, why did INEC trasmitted the Senatorial and House of Representative election results successfully, and there was a clitch when transmiting the Presidential election results? I do not believe that there was a clitch. Simply, INEC turned the server off.
Probably so. They may have turned it off deliberately.. That’s my earlier point. With all the DISCRETIONARY POWER granted to INEC by law, they can do whatever pleases them and get away with it. That’s where we are right now.
INEC is protected by existing law. That's why some of us advised that the LP/Obedient should have concentrated more on National Assembly and States election than the Presidency. But they didn't see wisdom.
And that is the question I would have expected Seun Okibaloye to ask. No nation can move forward with all these deceits going around and that is the problem we have when we elevate law over morality. In one breathe, the guest said that the law is final but when it comes to the issue of 25%, morality and common sense was then introduced into the argument/equation. We aren't going anywhere this way. Section 299 of the constitution is now being confused with the section that says for anybody to win a presidential elections, he/she must score 25% of votes cast in Abuja.

The root of the electoral problems is INEC, we should stop chasing symptoms and face the root cause which is INEC. The architecture of INEC is faulty and the results of elections can never reflect the reality of the elections. INEC should be dismantled and re-engineered from the scratch , distribute some of the pre-election matters to the legislature and the judiciary, for instance the judiciary should be involved in clearing candidates for positons for the offices of governors, senators and president before being adopted by their parties as candidates for such positions, then the national assembly should be involved in verifying results and the judiciary should be the arm announcing the results and affirming a winner after the legislative arm has verified INEC submitted results.
When the constitution or electoral laws are amended to reflect this changes then INEC will stop being the apha and omega of electoral systems and outcomes.

Why are arguments always hinged on scoring mandatory 25% votes in FCT Abuja as per section 134 of the Nigeria constitution 1999 as absurd before one can be declared a president and then seeking refuge in section 299 to equate FCT Abuja to a State. Meanwhile, this same constitution clearly state that FCT Abuja should be referred to "as if it were a state". Now, if I say, regard John as if he was a Lion; does this mean that John is a Lion? No.
Now, why did the constitution made provisions for first, second and third ballot respectively in section 134 subsection 1 - 5? Simple! For the purpose of election and declaration of president elect.
Understandably, the 1999 constitution has a fatal error but amending the constitution by the judiciary to suit one man / group interest without a recourse to the appropriate provisions amounts to desperation, state capture and a recipe to the death of this democracy. More days of drama ahead... Time Will tell.

The preponderance or presumption argument is weak. The law there is correct. In many situations where such presumption are in place parties disagreeing should prove or be provoked by evidence to rebut the presumption. If the burden shifts and causes iNEC to prove this presumption such case would be tedious and cumbersome for such agency, thus grinds the country or polity to a halt.

Guy u need to be informed go back to the Judgement of Atiku VA Buhari in 2019 Atiku's case was thrown out on technicality bases because he produced Party Agent result sheet and the agents, Court ruled that he should have presented a CTC ( Certified True Copy) obtained from Inec. That is the main reason why Obi's Lawyer relied on CTC from Inec to prove their case. 16 days was the deadline for them to file petition, Inec failed to release document and material needed. Have you forgotten or u only Listen to Jedi Joint and Beer parlour talks cos LP counsels came out in public and say after paying INEC, Inec refused to give them the CTC requested for, few days again Inec said they need to update Bivas and also Upgrade the software. I wonder what is wrong with you people. Inec was summoned to show up in court they did not. Proceedings can't be televised live but after succeeding their fraudulent act they televised Judgement. So what are u Insinuating.
