      It's not that she doesn't know the Constitution - it's that the Constitution is just an impediment to what she wants to do, and it doesn't really bind her in any event.

    Sotomayor demonstrated her unfitness for the court when, after her nomination, she said that the court could benefit from the perspective of a "wise Latina". Right there, she was saying that she would decide cases based on her own beliefs rather than on the Constitution. The words of the document don't change based on your ethnic, religious, or other background. Those words must be the basis of a Supreme Court justice's opinion no matter who they are. Her performance on the court provides conclusive evidence that her nomination should never have been confirmed.

    Thank you professor. As a retired appellate lawyer, when I lost a case, I always appreciated a judge fairly discussing my argument and explaining to me, why I hadn't prevailed. Most of the time, I still thought that I was right, but at least I respected the court for considering and responding to my argument.

    You are always right on. Really appreciate this professors knowledge of The Constitution which is what I care about the most. One does have to wonder about Sotomayor. She rarely follows the Constitution & I think that is why Obama picked her. She goes on emotion.

    All politicians and judicial appointees must be given basic tests on the Constitution and Bill or Rights. How can you take an OATH to uphold the Constitution if you don't know what's in it.

    SCOTUS needs desperately reform to prohibit justices from voting based upon Democrat or Republican Party values, beliefs, or principles. Moreover, the reform needs a constitutional amendment to set forth SCOTUS powers, whether strict construction or legislating from the bench is the ultimate standard. For decades many justices have adopted the principle that they can interpret constitutional and statutory issues based upon wide discretion and what is politically expedient or necessary.
    Sotomayor represents this awful judicial philosophy that decisions can be based upon the political preferences and what is desirable for American society. This keeps getting worse and worse. The court creates decisiveness rather than create unity.

    That Professor Dershowitz has chosen to go public with his comments on current affairs, IS a chance to listen to a great legal mind, ONE that, like ALL professors should make the student think, instead of just blindly accepting the professor's words as anything other than an opinion.
