      CNN consistently gets stories wrong and refuses to admit that. They intentionally hold back or pull stories if it has a negative impact on the narrative they and MSNBC are pushing. I'm not saying Fox can't be or may not already be guilty but CNN does it constantly and constantly gets it wrong.

    The Waukesha Christmas Parade Attack was done by someone released on bail reform from a DA that stated he didn't care if his criminal justice reform resulted in innocent deaths.
    Here is DA John Chisholm in his own words:
    'Is there going to be an individual I divert, or I put into treatment program, who's going to go out and kill somebody? You bet. Guaranteed. It's guaranteed to happen.
    'It does not invalidate the overall approach.'
    This shows his general attitude towards violent criminals.

      Funny thing is that nobody from the uk really knows about him. I was in the British isle a few years back and the funniest thing was that nobody new who John Oliver was. Literally I went from London to the country and I would ask if anybody new about him and not a single one did be it business man or local farmer.

      An algorithm isn't mathematics, or data.
      An algorithm is simply a set of instructions and it can easily be deeply flawed. In any situation where 'computer says no' alarm bells should ring. As for 'data', the US already one of the largest prison populations with black men over represented. While this may not be racist it has a strong racial element.

    Even after several chances she never took the hint that he just wanted her to address him with some respect. People like that not learning lessons is a big part of the problem!

      Indeed. If you demonstrate your contempt for a legal process by refusing to understand and follow directions, why should any leniency be granted when your presence before the judge is precisely because you allegedly committed a crime (aka not following the rules).

      It's honestly less of a respect issue and more of an issue of having a clear record. "Yes" and "no" are clear phrases that show up neatly on a transcript "yeah, ya, eh, uh-huh, nuh-uh" and the like aren't as clear, and can be argued by enterprising defense attorneys to be inadequate affirmations. The judge gave that defendant three opportunities to clarify for the record, upon not receiving the needed clarification, changed his ruling accordingly.

Where I am working now, before the customer service people can charge a client money or anythin, they require the clients to, on the phone, answer to the questions with either a "Yes" or "No" for recording purposes and considering when you are in court, everything you or whoever is in the court at the time say is recorded, a "Yes" or "No" leaves zero ambiguity as to what was said and understood.

    The only good thing John Oliver ever did was be part of Community. His character on the show was actually funny, who was originally supposed to play a big part in the show. I can't help but speculate that the show runners found out he was an ass and wrote him off the show/decreased his role on purpose

      @@eriklarsson6622 yeah, we're too easy on criminals here. Not as bad as someplace like Sweden but it's definitely gotten out of hand. Our prisons aren't exactly nice places to be, but it seems like our "justice" system is bound and determined that criminals never see the inside of a prison.

    Oliver is apparently quite the propaganda tool; I listened to that show and was pretty distressed over that guy sitting in jail for 11 months. Thanks for clearing up that his example happened over 20 years ago.
    Reform needs to happen on the speedy trial side.

      He's not only making a list. He's checking it.... not once but twice.
      Also, Oliver's show runs for only 30 weeks a year. He gets 22 weeks off per year. It's not exactly 11 months like his Santa claim but he's not the guy to call out someone not working year round.

      It didn't even happen two years ago and most of them weren't arrested until weeks or months later. Also, federal crimes are prosecuted on a federal level, so bail reform wouldn't effect them.

      They are accused. They have yet to be found guilty (or otherwise). And such they should be treated with the same respect as regular citizens until the trial. Unless the court sees fit to place them on remand.

      So, on that theme - why do we use bail - to ensure attendance at court, nothing more. So the measure is - are people who are having their bail waived attending court?

    Ah yes, one of the many British political commentators who talks down to Americans for not agreeing with his opinion on a nation he has no connection to, no investment in, and no education concerning laws or advanced history. Nor does he possess even the slightest idea of what the average American experience is, given the fact he was born and raised in Britain and didn't come to America until he was already at some level of success and adulthood in his life... Why are these people even humored when it comes to American politics, economics, or social structure? Wouldn't you feel weird going to the UK and looking down your nose at people who spent their whole lives as citizens of the UK, because they don't agree with your opinion of the country you have no connection to whatsoever? What a weird concept, especially considering one of the main arguments against the Iraq War for Democrats was always "We shouldn't get involved with the politics or social structures of other countries that do not involve us"... I guess they forgot they felt that way. This is why I myself left the Democratic Party in recent years. I believe woke British comedians have no place spewing actual political rhetoric as mainstream media when ultimately America is a horse they didn't bet on to begin with. Say what you want about John Stuart, but he was always quick to remind us that he was just a comedian. That why I found the Colbert Report genuinely hilarious, but cringe when watching the Late Show in 2022. These guys forgot that they aren't actually qualified to preach social commentary as an absolute science, nor does their line of work call for them to attack citizens or other journalists who question or simply disagree with their outlooks. What started out as a source of entertainment in the early 2000's on the Daily Show has led to some of the most hateful, tribalistic, and prejudice woke garbage media commentators on television today. Sure Fox News, MSNBC, and CNN are all guilty of the same actions, but they aren't spewing ridiculous absurd narratives with no sources whatsoever and then hiding behind the "I'm a comedian, not a real journalist" excuse when they get called out for it. I can't believe I used to actually enjoy watching these guys. When they used to make these jokes, it seemed light hearted and on several occasions John Stuart and Steven Colbert even showed respect to people on the other side after mocking them, but those days are long gone now and what started as comedy has become a leading source of woke hate fuel in the United States... the country John Oliver has no connection to whatsoever.

      Either way, most of the staff on the show are US, and Oliver is just the presenter.

He had his social and political opinions made up long before his wife/children/ or adopted citizenship were even factors in his life. If you think someone can't choose a side and delusionally stick to it the rest of their life, then you haven't been paying attention to how American politics works. John Oliver was talking down to non-Liberal Americans even in his earliest days of citizenship, again while knowing next to nothing about American law or anything past basic American history. Meaning his opinions on subjects such as law, social commentary in the United States, and any sort of history past a 5th grade level is compromised and skewed at best. If you wanna ride his d**k just say you wanna ride his d**k, but don't sit here and waste my time by telling me he has the same knowledge or investment in the United States as the average citizen when this man came here knowing damn well he already had the money and the ties to his home country to fall back on if the ideals he's out here hustling blow up in his face..     In 2000 crooked detectives put made up/trumped up charges on me with no evidence because I would not go to the station with them. I sat in jail for a year with a 150k bond while they offered 30 years then 15 years, So I planned to go to trial. This year was with a Public defender which was saying I should accept the 15. When I actually got a paid lawyer the very next court appearance they offered time served with one of the lesser charges which was still a felony (I still wanted to go to trial but my lawyer advised me to take the deal even though I was innocent). I was 18, this basically ruined my chances at getting a decent job and still I have a felony on my record to this day. Courts are not about finding the truth and people without lots of money are at a huge disadvantage. I know a system is needed but changes are needed.

    I worked in a county jail for a few months after I got out of the military and I was shocked by the number of people who were in jail for 1 or 2 years still waiting on a trial. We literally have a constitutional right to a speedy trial, and nothing about 12+ months is speedy. I've tried to argue this same point with people before and so many are quick to defend the legal system, saying "well, it takes a while to build a strong case, that's just how it is". No. You can be tough on crime and still believe that people shouldn't be held for literal years without trial in the country. Like AJW said, they had enough evidence to arrest the person and hold them in a county jail, why don't they have enough to go to trial?

I think anyone who has ever gone to court knows the first thing a judge asks you is do you want a speedy trial but anyone that probably is guilty waves that right thinking they can get out of the crime or delay it till it goes away. OJ Simpson had a trial start really fast after he was arrested because he was one of the few that went with the "constitutional right to a speedy trial"

    My local judges made a good point. Bail is solely about whether or not the person is likely to not appear - looking at history, type of crime (and therefore incentive to not appear), connections to the community, etc.
    When it comes to violence or chance of re-offending on bond that’s when you look to see what will it take to prevent that; check-ins with jail staff, GPS monitoring, ankle bracelet, total house arrest, or confinement.
    Bail should not be used as a substitute for the other tools to keep people from endangering the community.

    If a rate goes up from 7% to 20% it's not up by 20% because you're not comparing the number to the total, you have to compare the two percentages to EACH OTHER. So is actually up by a little over 50%...

    This is what I want to see: Any indictment must be tried within 3 months of arrest or the case is automatically dismissed with prejudice. Plea bargains are abolished.

      @@petrie911 They might, they might not. Too many people that aren't guilty are being rammed through systems and spit out with plea "deals." If they have a solid case, they need to present it immediately. If they can't produce complete discovery in a timely manner then they deserve to have the case shut down. If they can't present the case in a timely manner then they deserve to have the case shut down. A solid criminal case doesn't need three years post-arrest to be tried.

    Bail jumping, that is to say, getting bail but not showing up for trial, will get you put on a Flight Risk list. Also remember that after a revolution the revolutionaries who are not part of the new regime are the first against the wall because they have run a successful revolution. So when you combine these two if a revolution comes the new regime will look at the Flight Risk list and make them disappear.

    I don't think there should be holding exceptions for weekends or holidays. If a judge doesn't want to work on a Saturday, that is not my problem. You don't just get to take away someone's rights because nobody feels like working today.
    If the crime isn't bad enough to make a judge come in on a Saturday, then it isn't bad enough to hold the person. The government doesn't have the right to have a day off. The people do have a right to due process.

    The only bail reform that should happen is if judges are setting bail too high or too low. Too high, they may not understand the economic conditions. You don't need a million dollar bail on a steel worker. But their home value as bail is decent. Judges should get a full picture of your finances before setting bail that's all that really has to happen

    The argument against anecdotal evidence has always bothered me anyway.
    After all, what is empirical data other than a collection of anecdotal circumstances?
    How many personal incidents have to happen before it actually becomes data?
    If you do a study of 10,000 people, isn't that just 10,000 anecdotal situations grouped together?
    In the end, all a person can 100% rely on are things that they see or hear or that happened to them ie. anecdotes. Unless I see, hear, or experience something it might as well be hypothetical numbers anyway, especially with tests, polls, or focus groups I am not a part of nor have any way of verifying for myself.
    If I see crime getting worse near where I live each day (which I do,) I am going to call it crime getting worse.

      Isn't one argument against anecdotal evidence the implication that the sample size is too small to be reliable. Like how Oliver points to a study saying bail reform produced no statistical rise in [crime?], but AJW had to point out the sample size only covered 3 months or so.
      If you have 10,000 samples, I'd say you got a good data set to start with. But 10 or so anecdotes wouldn't carry the same weight. At least, this is what I suspect Oliver is insinuating when we makes that argument.

If i as one person gets robbed, then crime (for me) just went up 100% and if that one person is out on "bail reform" then it means one crime could have been prevented, meaning, no matter which way you cut it, bail reform is a bad thing, anecdotal or not.

      And the point you're missing is that *without* bail reform, the accused *may* have been in prison, or may not. The judge, currently, can choose remand, bail or a very low bail/RoR. It doesn't follow that the best solution is abolish/delay bail reform. In the final analysis it's a question of targeting and managing the likelihood of offending.
