Note, if you are a micro entity, you can file a full patent for $500, the process is basically the same except in that case you'll need to have claims, professionally done sketches and you'll want to make sure to get feedback on it from a lawyer first.

My attorney told me about provisional patents and the year to file.
But it was pretty much understood that I was hiring him to NOT MAKE MISTAKES
as writing a patent is a lot like writing code, but your coding language is "legalese".
To make things worse, the compiler ( patent examiner ) costs a few hundred dollars to run and it takes a year to get back your syntax errors.
If your main concern is just being allowed to use your OWN idea without someone patenting YOUR idea, it would make sense to write it yourself. If the patent isn't granted, or the patent is granted but poorly written, it still might prevent someone else from preventing you
from creating whatever you are trying to create.
A registered patent attorney MIGHT file a provisional patent application for you and only charge $800 to $1,000, depending upon how familiar he or she is with that field. It's often considered a complete waste of their time if you don't already have the information you need for filing an actual application that could get you a patent, unlike a provisional.
wilfred, you hit the nail on the head. I recently interviewed 3 lawyers.........to sum it up its a business for them, they do not care about you nor your invention/idea

"protecting ideas"? You mean "reserving the right to file a non-provisional patent application within a year"? A provisional application, by itself, does not "protect" anything.

That's very true unfortunately, as I thought of one good idea to submit for a patent in 1996 but didn't have the opportunity to search for it till 2003 and then found nothing near to my idea, but couldn't file for a patent due to money transfer restrictions, I searched again a year later and found many patents, and one of them was exactly like mine and the rest were improvements to it.
Conclusion, never search for exact function of your idea, but try to do it indirectly if possible, if you could not, then submit your patent without search.

Correction: "provisional patent APPLICATION". It does not become a patent until several years later, if you file a non-provisional that meets the requirements and pay the necessary filing/search/examination and issuance fees along the way, not to mention the patent attorney legal fees you'll need to pay at some point.

Saving this just for reference, but the whole thing made me lol… Working on a provisional right now, using a service that walks me through it… it’s still taking MONTHS, and just keeps getting more complicated. Amazing to me that anyone thinks filing a provisional is easy. You miss ANYTHING important, in your text, and anyone else can build on it and essentially steal your idea. This is helpful, showing the process, but doesn’t even chip away at how hard it is to not miss so many potentially fatal mistakes.

The incompetence of the team that put together the USPTO website is amazing. Nowhere on the page where you upload the documents does it tell you which documents you should be uploading. After searching their site for 30 minutes I still don't know where I was supposed to get that information. Thanks for putting this together. My only concern now if that this video is almost two years old and they could have changed the requirements by now.

Also, if you have a patent attorney, ask them to help give you access
to "private pair" so that you can see what transactions are happening with
your stuff without having to go through them.
I have a patent that went into abandonment because I didn't pay the ISSUE FEE.
The fucking issue fee! All the thousands of dollars of hard work was done and I
missed a 200 dollar fee so now I lose my patent if they don't accept my 500 dollar
petition.
If I had "private pair" access. I would have known that I had missed something that
came in the mail. Not receiving mail is not an excuse to miss an office action.

Cliff Weitzman I actually have my provisional patent! I had your video open in another tab the whole time I was on the USPTO site filing out the application. Just watched this and was fairly impressed by the detail you include as you don't see that often anymore. Are the dropbox docs you've included up to date and currently usable in to the new 2020 year? What has been your best resource for actually writing the provisional patents? I personally have studied non-provisional patents, subtracting the claims, as I want it to be a quality application. Have you had success with any of the provisional patents you have submitted (aka being bought by a company and utilized in a non-provisional on which you gain royalties)? Let me know, thanks!

Unfortunately, much of what he says is simply wrong from the get-go: there is no such thing as a provisional patent. It's a provisional APPLICATION for a patent that you intend to file within a year. A provisional is not a patent of any sort. Ever.

Great video. FYI - the criteria for micro entity changes year by year, this video is a few years old, but as of today in 2019 the limit is $189k gross income (3x the median income)
I plan to use this method. I am working on a small idea that I dont think is going to be a blockbuster, not sure its 'worth' filing a full patent yet, but this will give me a year to test the market and decide if its worth going deeper into.
I filed my provisional today - I am proudly "Patent Pending". I definitely pulled this video back up a few times for some guidance. Thank you. It takes some time to write the specifications, you want to do a pretty good job at it, and be thorough - leaving out details can hurt you later. That said, specifications and drawings can be in a plain language, so you don't have to get tripped up on patent lingo.
anyone know if they allow images of prototypes in these fillings? or am I going to have to hire and artist to make drawing?
Drawings are required in a specific stylized form.

If it's been a year since you filed your PPA and have yet to file a non0-provisional application, then you wasted your time and money on the provisional application.

You have up to a year in which to file for a patent. A provisional patent application is NOT an application for a patent and does not become a patent. After a year it expires and gets automatically shredded without ever being examined for patentability.
I am having trouble downloading adobe reader is there another way to view the file?

Provisional patents are not published by the USPTO and remain secret until cited in a non-provisional application for an actual patent.

A provisional application doesn't need any claims. An "abstract" is clearly defined within the instructions from the USPTO.

".. only a registered patent agent or patent attorney can file a patent application on behalf of a company (even if its your own company) so please consider that."

As a general rule, a "corporation" is a legal person that can only be represented in legal proceedings by an attorney, which in this case would be a registered patent attorney.

What are the advantages to a patent over just going straight to building and marketing your product?
Little or nothing, in many cases. If it takes three years or more to get a patent and your market it only going to last for a year or two, you have to decide whether to get actual legal advice on losing your patent rights.

There are no claims required in a provisional application for a patent. This makes sense because nobody is EVER going to examine your provisional application until it's waay too late to make any difference to your patent.

I was stuck with the fear of patent vendor scams. can you please tell me how long it takes for our application to be processed or come into power once the application is uploaded? and nobody else can use the same idea for 12 months even if they file for a full patent on the same is that correct?!
No, you're completely wrong. There is nothing in this video about filing a patent application -- it's only about a provisional application. You have no enforceable patent rights (if ever) until after you REFERENCE your provisional in a non-provisional, have your application examined (including the search they do of all previous inventions), reply to their inevitable rejections and objections and then (possibly) issue an actual patent in a couple of years. Until then absolutely ANYONE anywhere is free to rip you off anywhere i the world. "Patent pending" is only a hollow warning until your invention is actually patented in the country where you want to enforce it.

A provisional is not required to contain any claims. However, the more concise you can make your specification, drawings and claims, the more valuable it will be for your foreign filing license and your upcoming non-provisional patent applications.
