What if the husband who wants to keep the home intentionally missed payments for revenge after the wife and kids were forced to leave due to husband’s violent behavior and now the mortgage is 14 months behind and the home is on the foreclosure list just waiting for a sale date which could be announced in the next 90 days…and husband recently after 14 months is asking the courts to have the wife sell…even under these circumstances? Husband can’t refinance he due to bad credit. Would the court honor husband’s request to have the wife cooperate to sell? Wouldn’t the bank’s right to proceed with the foreclosure take precedence over what the husband wants
What happens if there wasn't an actual decision about who gets the house. In the divorce it was just written out for the payment to be made in liu of child support. We are trying to figure out if we need to refinance or not. The ex Spouse was not listed as a coborrower and her credit was not ran when the mortgage was considered. But she is listed on the Deed. Does that matter? Should We refinance to have her removed or is it needed at all?

The best way is cash, the other way is a cash out refinance if you have enough equity in the home to do that.
So if somebody refinances do you have to come up with the money right there to pay the other spouse there share or is it over the length of term or when the house is sold it goes to there share thanks 👍

If I have been a homemaker for 18 years, entirely dependent on my spouse and she now wants a divorce/separation and wishes to "buy me out" in terms of the equity in our house, what is my tax liability for a lump sum payment to me (~ $150,000) ? i am not a tax expert, but for primary residences you often do not have to pay tax on $150k. Check with an accountant.
She wants to stay in the home with our 15 year old son.
Her father/step mother and mother/step father are very wealthy.
Her lawyer is not responding to my offer where she cosigns with them or borrows directly from them and then buys me out.
What should I do? (i.e. about her or her lawyer not responding) I am thinking she is too afraid to ask them for some stupid reason.
Should I ask her two sets of parents myself?
it really does not matter if her parents are wealthy. That has no bearing in your divorce settlement. She needs to refinance to get you off of the mortgage. We can help her with that. You speak to the court about this and have the court force her to refinance or sell the home.

A week ago, she suddenly has said she wants to sell the home.
I don't beleive it. I don't believe that she thinks it would be better for our son to move out.
So, I offered that she does a partial buyouy now, then the remainder when he turns 18.
Her and her lawyer are STILL not responding.
@@basicprogrammer6147 go to the judge. The longer you wait, the worse it will be. Also do not worry about your son. Kids adapt. Just think about all of the kids who constantly move because of a parent having a traveling job or the military. Those kids actually have better social skills in the end.
my ex-spouse name is still on my mortgage, if the home is paid off, can his children claim this paid off home?
only if his name is also in the deed. Check with a lawyer
