TTA should go to the DOJ Civil Rights Complaint form and submit this to them. 18US241 and 18US242 need to be enforced NOW, not after lives are lost. People are screaming for police reform. But the laws to accomplish that are already on the books. The DOJ is not enforcing them. Less then 1% of civil rights violations are ever investigated by the DOJ. Even less then that survive to face any sort of prosecution.

      @@TTA42800 So here's why you must now file a lawsuit: They admitted to violating your rights regardless intentional or not. You clearly cautioned the Sgt. numerous times that he would be violating your rights. The Sgt. did not seek council from any higher ups or the City Attorney even after you had cautioned him, would he be more inclined to believe your knowledge if you look differently ??? It is very important for this incident to have a win in the courts so that case law can be set. Also, you have strong arguments why Sarge should lose is Qualified Immunity, which would hit him in his wallet where it hurts!!$$$

      Ás retired LEO, they cover the constitution during the 1st week of academy. There are no excuses as for law enforcement officers as well as citizens who break the law. But I'm glad they took the time to speak to him. And why dude holding camera like it's gonna fall off his uniform. You ain't gonna hold it on the streets like that.     It used to be "we investigated ourselves and found no wrongdoing". Now it's "we investigated ourselves, found wrongdoing, but it wasn't our fault because we didn't know the law so no one's to blame".
    What do the cops and judges always say when citizens don't know the laws that they're accused of breaking?
    "Ignorance to the law is no excuse".
    Apparently it IS when you're a cop.
    They are NOT being professional and helpful. They are withholding body cam evidence and they conducted a bogus investigation in which they cleared themselves even though they know they're guilty. Stop showing them respect when they don't show you ANY.
    The SECOND you walk out the door they're talking shit about you.

      James goes out and educates, but you need some edumacation too. Ignorance of the law is often an exempting excuse in terms of the severity of the punishment in law, from none to very little punishment. The Supreme Court has ruled: While “ignorance of the law” is not an excuse, in some cases, it may be a mitigating circumstance when considering sentencing in a criminal case, or reduced damages in a civil case. QED

      In criminal cases if the law hasn't been published, or if the defendant relied on a law that was later overturned or deemed unconstitutional... None of that applies here.

    I called and spoke with Sgt Engelke. He asserted that police can’t be expected to know all laws. I agreed but asked whether an expectation of knowledge of the first amendment and the freedom its provides should be something that is within an officer’s understanding. He expressed that they don’t receive training on the first amendment and he wouldn’t expect his officers to know that, suggesting it isn’t important like things that involve life or death situations.
    I was shocked that they legitimately don’t think knowledge of the constitution is important.

      This police department EARNED a lawsuit for clearly violating your rights, not ONCE that day, but at least TWICE, after you told them and explained it to them and gave examples and asked them to check to see if they were going to do something WRONG! That IS IN FACT 100% TRUE! As an auditor you GOT IT IN WRITING from the City Attorney that, "OOPSY...our cops messed up and violated your rights Sir, but they didn't do it intentionally." First of all, how the hell does the City Attorney KNOW for sure whether the Sergeant (who SHOULD have known as an experienced Sergeant and Supervisor) DID or DIDN'T know he was going to be violating James' rights?! AND, what about James TELLING THE SERGEANT (with wax buildup in his ear canals and a titanium capsule with a lead shield surrounding his brain?) several times, "YOU ARE ABOUT TO VIOLATE MY RIGHTS, SERGEANT!" and explaining that TO HIM?! You wanna talk about A COP OUT...these assh_le cops make more COP OUT excuses, give explanations, reasons and make justifications FOR WHAT THEY HAVE DONE than anybody else in America! Enough is enough, lawsuits and settlements speak loudly, and the outcomes of them get around online, to the command staff at the departments and to the PUBLIC who AREN'T HAPPY about them!

      James did James stuff. But I strongly disagree with you as do the MAJORITY of the commenters below this video that the "leadership" of this police department are even CLOSE to being "great"! This Chief, the Deputy Chief, Commanders and Captains ALL BLEW IT BIG TIME! They didn't do their JOBS properly and TRAIN the officers (some of whom became Sergeants as we see here) on the actual LAWS (state and federal and high court rulings) and the enumerated RIGHTS spelled out in the protected First, Fourth and Fifth Amendment, rights everyone has legally! So essentially the top brass blew it, and they didn't APOLOGIZE sincerely, they didn't directly OWN their MISTAKES or the MISTAKES of their officers, all the Chief did was copsplain to James how they are FIXING what should have ALREADY BEEN ADDRESSED AND TAUGHT! The "leadership" basically investigate THEMSELVES and didn't OWN UP TO THE FACT THAT THEY are the ones who CAUSED the whole situation by not doing the proper training OF ALL NEW HIRES!

      @@moparman1962 So they did the investigation (a ploy from the police handbook) found they were wrong (tried to weasel out of it with their layer but found no way out) dished out no punishment to themselves and added another training course that none of their officers will even look at. let's be honest they joined the police force because they like the feeling of having authority, they could care less about someone else's rights.

    The Chief and commander were both very professional and explained the officers short commings and they obviously implemented corrective measures it seems evident because the second encounter they did not violate your rights

    If law enforcement breaks the law, they have qualified Immunity. If a citizen breaks a law, the full extent of the law is applied, often times maliciously.

    Thank you so much for doing an often-overlooked part of making America great again.
    We've been distracted by all things shiny to the point that we're allowing (dependent on, actually) group-thubk to dictate to us what we are "supposed to" be afraid of, and what we're supposed to do to alleviate that fear.
    In order to be able to continue down that path toward personal freedom, we must regain and then retain the levels of self awareness that can allow us to genuinely ask ourselves how we feel and determine why we feel that way. As soon as that ability is lost in the individual, it becomes determined for us by any groups of us that we seek to be a part of.
    And that shit ain't healthy.
    Thank you again, sir. Your method of being is one of the most rock solid of all the auditors I watch.

      And yet, right out of the other side of her mouth, she talks about how training academies have training on the Constitution, WHICH THE HECK IS IT??? I'm far over their alphabet soup double speak. It's called DISHONESTY! I will give them credit for acknowledging right off the bat this was a very bad look for their department when Law Enforcement doesn't know the supreme LAW of our land!

    James, this police department EARNED a lawsuit for clearly violating your rights, not ONCE that day, but at least TWICE, after you told them and explained it to them and gave examples and asked them to check to see if they were going to do something WRONG! That IS IN FACT 100% TRUE! As an auditor you GOT IT IN WRITING from the City Attorney that, "OOPSY...our cops messed up and violated your rights Sir, but they didn't do it intentionally."     Again thank you for what you do , I believe you should continue auditing Elgin just to make sure that the training has worked in full effect. Also I still do not understand why they send the entire police department for a man with a camera . It puzzles me to this day .

SHE is in ultimate charge of the whole department! Where is the TRUE accountability for the FAILURES and SHORTCOMINGS in the department SHE oversees and runs?!

    Also, keep in mind that some of us watching are very passionate about what you are doing and feel strongly that it should be done. So sometimes we're gonna have a knee-jerk. Reaction and say you should or you shouldn't file complaints or you should or shouldn't file lawsuit right away. Sometimes it's just an emotional response from what we are witnessing.       YES! And Part 2 is that a rights violation lawsuit MUST be filed in federal court to fully make the point, show the seriousness of what was done ILLEGALLY to someone, to get the word out to the public AND saturating the command staff at these departments, city councils, etc.
