This one of the first Christian Rap songs I jammed back in 2008. There's alot of great Christian Rap now, even back then, it just wasn't as popular/promoted as it is now. Lecrae and Flame broke alot of ground for more artists to get exposure. I know afew that I feel should be more famous than they are, but maybe because of the lack of marketing/promotion they aren't known to the masses/mainstream. Artists like Von Won and Tre9 for example. But as time goes on, with cross pollination of different artist features, I'm sure people will eventually find Von Won, he did have a song with Lecrae on Church Clothes mixtape called Welcome To HTown, but for some reason I guess people didn't think to acknowledge him or check him out beyond that one song to see the rest of his albums.

Katy Perry won yet again in a copyright infringement case over "Dark Horse". The three judges ruled that the authors of the hip-hop song "Joyful Noise" had not provided sufficient evidence against Katy Perry's music.
That's a relief. The world would feel a bit too ridiculous if they could claim her song ripped off this one which sounds nothing like it and win that copywrite claim. Maybe a 5 percent similarity I don't know the right music words to describe, but the melody and lyrics have very clearly not been stolen. It's ironic that the musician I'm listening to sing about God and his faith right now is also trying to be a scammer. There's no way those guys genuinely believe their song was ripped.

Also just because a few quick effects are added doesn't clear them of copyright infringement. Lawyers and experts clearly told them they had the rights to sue before the would go ahead and risk losing this.
I'm not a Katy Perry or Flame fan. However, I have followed these cases and read some of the judgements. A judge recently determined that even though a jury agreed the songs sounded similar, the 8-note sequence in question did not meet the burden to be covered by copyright. It literally doesn't matter if they sound similar because it's basically 8 quarter notes in a common descending minor scale with some notes repeated. You can't copyright scales or common chord progressions. They're the basic building blocks of music. And this is too small and common in origin to meet the standards of uniqueness to warrant protection. If something like this can be copyrighted, music would die.

For anyone confused in the line that reads "God knew as much as A+E did not know." I am saying that God already knew to the extent and more of which Adam and Eve did not know.
Similarities include: the syncopated bass drum rhythm, the high pitched staccato eighth notes and the "hey, hey" chant on the upbeat at the start of the chorus. Those are very specific similarities. Those are very distinctive traits of the beat. If you took those things out of Dark Horse, there would be almost no "beat" left. We certainly would have a hard time recognizing a Dark Horse instrumental without those things. And a judge might agree that makes a copyright infringement.
That's not the way the law tests copyright at all, very fortunately. In a recent appeal judgment that went to a jury trial, the jury did determine that the songs are similar, however, in applying the actual law the judge determined that the 8- note sequence in question does not meet the standards to be covered by copyright. It is a simple and common progression and to allow it to be copyrighted would be a slippery slope to having other basic musical building blocks declared creatively off limits. Both are original works. No direct copying occurred. And even though they sound similar, one cannot have ownership of such a small, common, and simple musical progression of notes. Music would die if that happened.

Katy Perry won yet again in a copyright infringement case over "Dark Horse".
The three judges ruled that the authors of the hip-hop song "Joyful Noise" had not provided sufficient evidence against Katy Perry's music.
That's a relief. The world would feel a bit too ridiculous if they could claim her song ripped off this one which sounds nothing like it and win that copywrite claim. Maybe a 5 percent similarity I don't know the right music words to describe, but the melody and lyrics have very clearly not been stolen.
It's ironic that the musician I'm listening to sing about God and his faith right now is also trying to be a scammer. There's no way those guys genuinely believe their song was ripped.

-To all Christians and flame supporters, be respectful and take the high road, katy perry fans are going to be looking to be Internet tough guys.
-To people who say this way for publicity. Why would flame be trying to get negative publicity for a song that is 6 years old? Katy Perry's audience is not the type of fan he is trying to attract.
-The beats are similar if you go to about 20 seconds into each song and play them you will notice it. Also just because a few quick effects are added doesn't clear them of copyright infringement. Lawyers and experts clearly told them they had the rights to sue before the would go ahead and risk losing this.
I'm not a Katy Perry or Flame fan. However, I have followed these cases and read some of the judgements. A judge recently determined that even though a jury agreed the songs sounded similar, the 8-note sequence in question did not meet the burden to be covered by copyright. It literally doesn't matter if they sound similar because it's basically 8 quarter notes in a common descending minor scale with some notes repeated. You can't copyright scales or common chord progressions. They're the basic building blocks of music. And this is too small and common in origin to meet the standards of uniqueness to warrant protection. If something like this can be copyrighted, music would die.

Similarities include: the syncopated bass drum rhythm, the high pitched staccato eighth notes and the "hey, hey" chant on the upbeat at the start of the chorus. Those are very specific similarities. Those are very distinctive traits of the beat. If you took those things out of Dark Horse, there would be almost no "beat" left. We certainly would have a hard time recognizing a Dark Horse instrumental without those things. And a judge might agree that makes a copyright infringement.

That's not the way the law tests copyright at all, very fortunately. In a recent appeal judgment that went to a jury trial, the jury did determine that the songs are similar, however, in applying the actual law the judge determined that the 8- note sequence in question does not meet the standards to be covered by copyright. It is a simple and common progression and to allow it to be copyrighted would be a slippery slope to having other basic musical building blocks declared creatively off limits. Both are original works. No direct copying occurred. And even though they sound similar, one cannot have ownership of such a small, common, and simple musical progression of notes. Music would die if that happened.

The similarity in question is in the synth rhythms, not the vocals. The synth rhythm in "Dark Horse" sounds just like the synth rhythm in "Joyful Noise," only slower. But again, that's just the opinion of myself, the jury, Flame, and many of his fans. Music is inherently subjective anyway.
