    Hi.. full severance applies to South African employees...as well

      Hi Shakeel. We are not up to speed on South African employment law (our firm currently practices employment and disability law in Canada, as of July 2021), so we'll take your word for it!

    Sale of a Business - employer wants me to sign a contract with only 8 weeks severance (I've been there 15 years) Is that reason for me to not sign/accept & would I then be entitled to full severance - last person that left prior to Sale of company got 2 years severance after being there for 25 years. I love working there but...And thank you for all the great info you provide 💝

    Sorry another question - my title is "Supervisor" & I already work overtime. I just keep track & take it as lieu time. (I don't do time & a half just straight overtime) New employer says I'm salary so not entitled to overtime at all. Is that true? Also as employess are leaving they aren't replacing them so I'm doing even more overtime...

      Salaried employees are most certainly owed overtime pay. It is not just an option for hourly employees. And if an employee works overtime in order to get their work done, the employer can't refuse to pay the overtime wages.
      Also, keep in mind that if an employee's title or duties change/increase significantly without their full permission or acceptance, they can choose to pursue a constructive dismissal and leave the job with full severance pay.
