CLASSIFICATIONS OF FELONIES || Grave, Less Grave, Light!!! Importance of knowing them ||
There are three classifications of felonies: grave felonies, less grave felonies and light felonie.
Grave felonies are those to which the law attaches the capital punishment or penalties which in any of their periods are afflictive, in accordance with Art. 25 of the Revised Penal Code. So the penalties here are reclusion perpetua, reclusion temporal, disqualification, prision mayor or a fine exceeding 1.2 million pesos.
Less grave felonies are those which the law punishes with penalties which in their maximum period are correctional. Here, the penalties are Prision correccional, Arresto mayor, Suspension, Destierro or a fine of not less than 40 thousand pesos but bot exceeding 1.2 million pesos.
Light felonies are those infractions of law for the commission of which a penalty of arresto menor or a fine not exceeding 40 thousand pesos or both.
The importance of knowing these classifications of felonies has something to do with determining the following:
1. If the felony is punishable under Article 7;
2. Whether the accessory of the crime is liable under Article 16;
3. Whether a complex crime was committed under Article 48;
4. The duration of subsidiary penalty under Article 39, no. 2;
5. The duration of the detention in case of failure to post bond to keep the peace under Article 35;
6. Whether the crime has prescribed under Article 90; and
7. The proper penalty for quasi-offenses under Article 365.
