I was listening to a Romanian lawyer and things work differently there. I think it's 3 or 4 judges that overlook the case and Andrew has posted many videos on UA-cam mocking the Romanian legal system / corruption. It's like laughing at your dentist before getting a root canal.
A Romanian lawyer explained why they haven’t been charged yet. In Romania if they find new evidence for a new additional charge, they wait to gather evidence on that new charge. They also gather as much evidence as possible to decide if they have enough to proceed with a trial. This is how Romanian law works. If you want more cushy rights for when you commit a crime, commit them in a different country.

Everything he admitted to is completely legal in Romania. Cam girls are one of the top industries there. He has admitted to nothing illegal. Case documents are public record, it has been shown that the business he ran has no bearing on these charges. This is the problem with only paying attention to one perspective of something. If you don't like how things work outside the US, I suggest you burn your passport as US constitutional protections are not extraterritorially applicable. As a point of note, Romania is part of the EU and thus if there is an issue where Romanian law or criminal procedure itself (or the application of the law and rules in this case) violates the European Convention on Human Rights, there is a clear appeal mechanism to the European Court of Human Rights in Strasbourg. Since there is no appeal that we know of to this court, can we assume that the Tates' lawyers don't believe that filing such an action would be successful? As a side note, it is entirely possible that the Tates' new lawyer is making things worse for the Tates. Also, Tate is apparently a US citizen/UK subject. Tate has admitted to bribing Romanian officials on video. Who wants to bet that DOJ is investigating with the help of the Romanian Ministry of Justice as to whether charges can be brought in the US for violation of the Foreign Corrupt Practices Act of 1977? I believe that there is an equivalent statute in the UK.
They've said they specifically moved to Romania because that legal system wouldn't give their victims the same rights as in the U.S. So I have trouble feeling bad for them now that they've gotten scooped up by that legal system and are complaining about their rights. 🤷♀️ Seems like justice to me, in a karmic sense.

The point stands. Their "laws" (or in this case, judges being paid off and/or ordered by people they must obey) are a violation of human rights, period.
A judge is signing off on the extensions, so there must be something brewing in the background. One huge factor must be the fact that the Tate Brothers are not a flight risk, but a flight guarantee as soon as they have 5 minutes outside of their prison cells.
Not only that, but the strong risk of witness tampering/intimidation. The judge knows what kind of pull/power these guys wield in the streets of Romania. And I'm sure the 4 women that have come forth (other 2 have spoken favorably of andrew) probably don't feel safe until things are settled.

Apparently that lady can't practice law in Romania, she can only be a consultant, but she's in a world tour with the interviews. Theirs a Romania lawyer by the name Stefan Loredanthat (also has a youtube channel ) whom has already explained on another channel how the law and process works in Romania and even explained why they didn't get bail or charged yet. And they do have Bail hearings in Romania is just the nature of crime that they involved and being investigated by Romania’s Directorate for Investigating Organized Crime and Terrorism.

Bruce, pre-trial arrest is allowed by Romanian law only in a very few specific cases. Proof that the defendant might tamper with evidence or influence/threaten the witnesses or the victims, the defendant is a major flight risk, or the defendant has committed other crimes after the prosecutors have started their criminal investigation. Guess which of those very specific cases apply to the Tate brothers.

What is happening here is they presented him with "potential uncovering of evidence". The judge and the system there are playing a political game to win political points. The evidence must show that they're building the case and they asked for detention and not allow house arrest or bail because they are a flight risk, or they can influence the witnesses or tamper with the collection of evidence. If it's in the Romanian law, what nonsense is this to complain that the prosecutors are using it? They DON'T HAVE TO show what evidence they have so far to the defense lawyers ( they'll get to study the complete case file when a trial is set), but they have to show the judges in order for the extensions to be approved. In the unlikely scenario that the Tates were held in detention and there's no evidence, they have the right to sue the state and the state will pay compensations for the financial losses incurred ( the prosecutors can't risk paying 5-10 millions for every month they keep them in detention ).

As a beginner lawyer from Europe, I'm curious what do you guys in the US do when somebody is deemed a flight - risk and the prosecution needs time to build a case against them? In Poland, we can temporarily detain them for up to 3 months before presenting charges. Of course, it sometimes leads to the prosecutors abusing their power to detain somebody when some other measure would suffice, but that's another story. If I were to prosecute this case I would 100% ask the court to detain Mr. Tate, since he has multiple nationalities, vast amounts of wealth and the alegations againts him are serious, thus making him a text-book example of a flight risk.
Not to mention putting pressure on potential witnesses. Besides the US also keeps people in prison without the right to bail out if accused of terrorism (let alone the Guantanamo). What drives me mad, is their ignorance and patronizing attitude towards the east European countries. It's a fact that firearms were discovered when the police searched his house. So even if everything else drops, he's still guilty of possessing a firearm, given guns are illegal in Romania for civilian use except hunting licenses (which are difficult to obtain anyway and which only allow specific firearms, not handguns or smgs or anything that's not a hunting weapon) or working for a company that transports valuables.

Again, I disagree. They do not detain the suspects and throw the key. They are not allow to detain somebody without a court decision more than 24h (and the arrest must be approved!). Then the prosecutors go with SOME evidence in front of a court for 30 days extension. The suspects can APPEAL in front of a court - the Tates did appeal every single time. At every extension request prosecutors must have new evidence - again , the investigation is still in progress , but some evidence is presented every time. The 180 days is an OPTION, the MAXIMUM, pending on the gravity of the claims and mostly because they are DANGEROUS AND FLIGHT RISK. They have been OFFICIALLY ACCUSED (I think this is what you mean by Charged - English is not my language) since day ONE , the accusations are stated in the arrest mandate and than in every court decision at detention extensions the accusations are stated; so far they are: human trafficking, organized crime and rape. They will add more (if not already), definitely something related to the money: money laundry, tax evasion etc. Regarding the conditions in detentions and human rights: they were visited by both US and UK Embassies representatives exactly for this : to make sure their rights are respected, AND THEY ARE. I am no lawyer but from what I heard from a Romanian attorney, it seems it works pretty similar like my country so here’s the situation. In Chile, after arresting someone, you have something called “ control of detention audience”. Both parties present the current evidence and the judge decides if there is enough probable cause to order a detention order for 30 days (or more) to investigate and see if said probable cause is something like a fluke or serious allegations. They do this to make sure the arrest is legal. They also can decide where the person can spend this time. It can be at home or jail depending the circumstances. The lawyer is downplaying this by making it seem that Romanian law and American law are the same, since this practice would be illegal in the USA but completely normal there. Also, I am sure they did not order jail time just because. Probably the evidence against him is too substantial to ignore and he is also a flight risk. Edit to add more info for clarity

US jails have prisoners sitting without trial for 2-3 years and all americans seem to have problems with laws in other countries that hold the accused if they're dangerous and can influence the case.

15:30 I live in Denmark and I think here you can be held under arrest for months without a charge. As long as a judge have ruled that the evidence is clear enough, to lead to a sentence that is longer than the time held under arrest.
Yeah in Sweden they can hold you for up to 9 months (usually less, more in some circumstances) before charging, and there is no bail and no jury. Tate at least got to choose which legal system he wanted to be subject to, most people don't do that.

American law and protections don't apply to everybody. Ask Guantanamo detainees if the US finds detention (in this case without a deadline) wrong. Again, detention is allowed under European Law of Human Rights and is common in many European countries. Romania is doing nothing wrong.

From what I understand, when the prosecutors were requesting to extend the Tates' detainment, they provided the judge with an argument and a minimal amount of evidence and basically the judge could either agree or disagree and in this case he agreed, and then denied the appeal. What no one seems to get is that prosecution doesn't need to show anyone anything except for the judge, they can build up all the evidence they want until they have a case against the brothers innocence, and clearly they've got enough to prove that the brothers must remain detained. I just can't wait to see what else is coming up for the world to watch. Very very interesting indeed

Btw, as to the "know what he's accused of" part, the court order warranting Tates' detention would specify the Penal Code sections being investigated. This bears some functional similarities to 'charges' under Common Law, only without the prosecutor formally alleging that the subject of the investigation committed a crime; in a Civil Law criminal procedure, the formal allegation of crimes comes at the end of the investigation. In long-standing continental European practice (and now codified in the GDPR, an EU-wide binding privacy regulation), such a warrant is not a public record before conviction, but Tate's lawyers would have a copy, and could release it if it was beneficial to them by, say, clearly showing that Tates have not been informed about what they're being suspected of. News from 01.02.23 DIICOT found 3 new victims who went to the police station in romania to file complaints against the Tates because of assault and deprivation of liberty in the last 2 years. I don't think Romania has "shitty law". They are part of the EU and thus have to respect the principles of the European convention on human rights, which includes the basic rights of defendants in a criminal procedure. Being "charged" might mean different stages of the procedure depending on the country and its procedural laws. I think the Tate brothers probably knowing the outlines of why exactly they're detained is already considered sufficient for them to be detained before trial, especially if there is a serious risk of flight (which is the case) or a risk of collusion with other potential witnesses/co-defendants.

Also, the prosecutor needs to present further evidence every 30 days if he wants to extend their detention period. One problem I see here is using terms from the Anglo-Saxon legal terminology to describe a completely different legal system. There may not be exact equivalents for certain terms in English at all. I am a police officer from the Czech Republic, and it is sometimes quite difficult to describe our system in English, because those who are native to the Anglo-Saxon legal system tend to instinctively understand these terms in a way they know them in their own legal system. It doesn't always work quite well. A Romanian lawyer explained why they haven’t been charged yet. In Romania if they find new evidence for a new additional charge, they wait to gather evidence on that new charge. They also gather as much evidence as possible to decide if they have enough to proceed with a trial. This is how Romanian law works. If you want more cushy rights for when you commit a crime, commit them in a different country.

All of the US lawyers that I have seen commenting on this case have come down to the point that "Wow! Romanian law is not like US law and we don't think that's fair." Well congratulations on that groundbreaking realization. If you don't like how things work outside the US, I suggest you burn your passport as US constitutional protections are not extraterritorially applicable.
As a point of note, Romania is part of the EU and thus if there is an issue where Romanian law or criminal procedure itself (or the application of the law and rules in this case) violates the European Convention on Human Rights, there is a clear appeal mechanism to the European Court of Human Rights in Strasbourg. Since there is no appeal that we know of to this court, can we assume that the Tates' lawyers don't believe that filing such an action would be successful? As a side note, it is entirely possible that the Tates' new lawyer is making things worse for the Tates.
Also, Tate is apparently a US citizen/UK subject. Tate has admitted to bribing Romanian officials on video. Who wants to bet that DOJ is investigating with the help of the Romanian Ministry of Justice as to whether charges can be brought in the US for violation of the Foreign Corrupt Practices Act of 1977? I believe that there is an equivalent statute in the UK.
They've said they specifically moved to Romania because that legal system wouldn't give their victims the same rights as in the U.S.
So I have trouble feeling bad for them now that they've gotten scooped up by that legal system and are complaining about their rights. 🤷♀️ Seems like justice to me, in a karmic sense.

Proof that the defendant might tamper with evidence or influence/threaten the witnesses or the victims, the defendant is a major flight risk, or the defendant has committed other crimes after the prosecutors have started their criminal investigation.

What is happening here is they presented him with "potential uncovering of evidence". The judge and the system there are playing a political game to win political points. The prosecutors have the right to detain you for 180 days in increments of 30 if they bring new evidence to the judge EVERY TIME they ask for another 30 days. The evidence must show that they're building the case and they asked for detention and not allow house arrest or bail because they are a flight risk, or they can influence the witnesses or tamper with the collection of evidence.
If it's in the Romanian law, what nonsense is this to complain that the prosecutors are using it?
They DON'T HAVE TO show what evidence they have so far to the defense lawyers ( they'll get to study the complete case file when a trial is set), but they have to show the judges in order for the extensions to be approved.
In the unlikely scenario that the Tates were held in detention and there's no evidence, they have the right to sue the state and the state will pay compensations for the financial losses incurred ( the prosecutors can't risk paying 5-10 millions for every month they keep them in detention ).

As a beginner lawyer from Europe, I'm curious what do you guys in the US do when somebody is deemed a flight - risk and the prosecution needs time to build a case against them? In Poland, we can temporarily detain them for up to 3 months before presenting charges. Of course, it sometimes leads to the prosecutors abusing their power to detain somebody when some other measure would suffice, but that's another story. If I were to prosecute this case I would 100% ask the court to detain Mr. Tate, since he has multiple nationalities, vast amounts of wealth and the alegations againts him are serious, thus making him a text-book example of a flight risk.
Not to mention putting pressure on potential witnesses. Besides the US also keeps people in prison without the right to bail out if accused of terrorism (let alone the Guantanamo).
What drives me mad, is their ignorance and patronizing attitude towards the east European countries. Romania has some corruption issues (which country hasn't?), but it is a part of the EU and it must obey its laws.

Again, I disagree. They do not detain the suspects and throw the key. They are not allow to detain somebody without a court decision more than 24h (and the arrest must be approved!). Then the prosecutors go with SOME evidence in front of a court for 30 days extension. The suspects can APPEAL in front of a court - the Tates did appeal every single time. At every extension request prosecutors must have new evidence - again , the investigation is still in progress , but some evidence is presented every time. The 180 days is an OPTION, the MAXIMUM, pending on the gravity of the claims and mostly because they are DANGEROUS AND FLIGHT RISK. They have been OFFICIALLY ACCUSED (I think this is what you mean by Charged - English is not my language) since day ONE , the accusations are stated in the arrest mandate and than in every court decision at detention extensions the accusations are stated; so far they are: human trafficking, organized crime and rape. They will add more (if not already), definitely something related to the money: money laundry, tax evasion etc. Regarding the conditions in detentions and human rights: they were visited by both US and UK Embassies representatives exactly for this : to make sure their rights are respected, AND THEY ARE. Please contact a Romanian lawyer to explain more. Please get more information before saying their human right are not respected! I am no lawyer but from what I heard from a Romanian attorney, it seems it works pretty similar like my country so here’s the situation. In Chile, after arresting someone, you have something called “ control of detention audience”. Both parties present the current evidence and the judge decides if there is enough probable cause to order a detention order for 30 days (or more) to investigate and see if said probable cause is something like a fluke or serious allegations. They do this to make sure the arrest is legal. They also can decide where the person can spend this time. It can be at home or jail depending the circumstances. The lawyer is downplaying this by making it seem that Romanian law and American law are the same, since this practice would be illegal in the USA but completely normal there. Also, I am sure they did not order jail time just because. Probably the evidence against him is too substantial to ignore and he is also a flight risk.

15:30 I live in Denmark and I think here you can be held under arrest for months without a charge. As long as a judge have ruled that the evidence is clear enough, to lead to a sentence that is longer than the time held under arrest.
Yeah in Sweden they can hold you for up to 9 months (usually less, more in some circumstances) before charging, and there is no bail and no jury. Tate at least got to choose which legal system he wanted to be subject to, most people don't do that.

From what I understand, when the prosecutors were requesting to extend the Tates' detainment, they provided the judge with an argument and a minimal amount of evidence and basically the judge could either agree or disagree and in this case he agreed, and then denied the appeal. What no one seems to get is that prosecution doesn't need to show anyone anything except for the judge, they can build up all the evidence they want until they have a case against the brothers innocence, and clearly they've got enough to prove that the brothers must remain detained. I just can't wait to see what else is coming up for the world to watch. Very very interesting indeed

I don't think Romania has "shitty law". They are part of the EU and thus have to respect the principles of the European convention on human rights, which includes the basic rights of defendants in a criminal procedure.
Being "charged" might mean different stages of the procedure depending on the country and its procedural laws. I think the Tate brothers probably knowing the outlines of why exactly they're detained is already considered sufficient for them to be detained before trial, especially if there is a serious risk of flight (which is the case) or a risk of collusion with other potential witnesses/co-defendants.

Be charged, and wait in a prison cell for about 2 years, waiting on trail. With the same possibility you are Innocent.

You keep saying they've been detained for 60 days. They haven't been detained for 60 days. They were arrested December 30th. The approved a 30 day hold, which was up Jan 31st and now he's started the second 30 day hold but it's only been 33 days.
Guess his is confuse because they gave the en 30 mores day which add up to 60 .
his point is in the usa and most countries he'd be charged or released by now like most states it's well within 48 hours with rare exceptions to 72 hours 33 days without being charged is 30 days too long

US judges give 80% of black men 200k bail knowing they can't pay, so they're all stuck in jail while innocent and before decided as guilty. How is that any different than holding Andrew in jail before trial? And keep in mind when men are held in jail in the US before trial, some of them beat the case and are determined innocent. Yet they were held in jail for 12 months for nothing. So, this woman is an idiot for complaining about Andrew being held before trial.

One problem I see here is using terms from the Anglo-Saxon legal terminology to describe a completely different legal system. There may not be exact equivalents for certain terms in English at all. I am a police officer from the Czech Republic, and it is sometimes quite difficult to describe our system in English, because those who are native to the Anglo-Saxon legal system tend to instinctively understand these terms in a way they know them in their own legal system. It doesn't always work quite well.
For instance, in our country, the criminal proceedings work like this, but it may be different in Romania:
1) pre-proceedings enquiries (police has very limited tools, public prosecutor and judge are generally not involved at all)
2) initiation of the criminal proceedings (public prosecutor's office is notified and assings a supervising public prosecutor - i.e. "dominus litis", generally, the suspect still knows nothing)
3) pre-investigation phase we call "verification" (police collects evidence, and can use various measures, such as wiretaps, if warrants are issued by the public prosecutor or a judge, the suspect generally still knows nothing)
4) initiation of the criminal prosecution (this is when the police issues a resolution to the suspect, telling him/her what he is accused of and why, this is when what we call investigation starts, this is usually when a laywer gets involved, and this is when the suspect can be taken into custody by a judge) - Anglo-Saxon law may call this "charging"?
5) investigation phase (more evidence is collected, e.g. by interview, interrogation, analysis of data collected, and expertise, suspect and lawyer have the right to see most of the case file - specific parts can be hidden, such as classified information that is not used as evidence, protected witness identity and such) - more accusations may occur
6) conclusion of the investigation (the suspect and the lawyer must be presented with the whole case file as it is planned to be given to the court)
7) filing a motion for indictment by the police, passing the whole case file to the public prosecutor
8) indictment by the public prosecutor (the public prosecutor tells the court what they want tried)
9) court trial (tier 1 court) - this is where evidence is used (proving the case)
10) appeal process (tier 2 court) - usually final, meaning the convict goes to jail at this point
11) special appeal measures, if applicable (tier 3 court, then possibly Constitutional court, and European Court of Human Rights) - this generally does not postpone the final decision, so a convict still goes to jail
Disclaimer: There are some exceptions to the usual flow, e.g. the suspects may know from the very beginning that the police is interested and may decide to accuse them, a dying witness will be interviewed with a judge present immediately, regardless of the stage of the proceedings, etc.

The preconditions for pre-trial detention are 1. a formal criminal investigation has been commenced, 2. prosecutor can demonstrate that certain subjects of the investigation are likely to either flee from prosecution, tamper with evidence or witnesses, or commit other crimes if they are not detained, and 3. a judge, having reviewed the prosecutor's argument, agrees and signs off on the detention. For pragmatic reasons, if pre-trial detention is used, this tends to be used in the latter phases of the investigation, because, well, it tends to tip the suspects and/or perpetrators off, but the prosecutor does not need to allege that the subjects to be detained have committed crimes in the process of getting approval for pre-trial detention. In Common Law, charging involves making such allegations, but in Civil Law, the allegations of specific crimes are only available after the investigation is concluded; before that, prosecutors have, formally speaking, only suspicions - but the law recognises that certain actions are appropriate on the basis of well-founded suspicions.
