  • In light of the CPAP settlement offer and order last week, John Albanese joined us to discuss and summarize what to expect moving forward in the next few weeks.
    John provides the following actionable insights:
    1. Obtain Medical Records: Firms should obtain and review medical records quickly to ensure clients have qualifying injuries.
    2. Submit Identification Form: The settlement administrator will provide a template spreadsheet to be filled out and submitted through MDL Centrality by June 10.
    3. Participation Rate: The settlement requires a 95% participation rate from eligible claimants to participate in the settlement. Elapsed claimants can be removed from the participation rate calculation.

    Is it possible to refile a claim? Along with renal cancer I have lung issues, however, my attorney sent me a letter saying that I will no longer be represented due to renal cancer being dropped from the eligible diagnosis. Can I still make a claim based on the lung issues?

    I was told that my bladder cancer qualified me for a personal injury claim. I was using the defective cpap, I have filed medical records and filed a lot of paperwork to my attorneys. Is my cancer no longer qualified?
