Thomas Chan it takes three months once submitted for the application to get to the uspto's trademark attorney. After three months the lawyer will contact you if they have any issue with your application; I.e need additional information. If all is well, it will take a full 12 months to become registered. While you can not add the register logo (the R in the circle ) to your product, you can actually add the TM logo to your product. The USPTO is first come, first serve. And so once your application is accepted, even if not registered yet, your mark is protected. Say someone decided to use your mark after you e applied, once their application reaches the uspto attorney, they would be contacted and told to change the name or the application is rejected. This is why it takes so long. They have to place your application/or mark for public view so others may dispute it in case youve stolen the idea. So sorry for the long answer lol. But I hope that helps 😊

Hey Brian. It is a great video. I have a question: What if I file a trademark name as an individual person but meantime I wanna change it because I established a company? Can I change that with no problem? I guess the only thing to do is paying a fee for changing data. I want to protect my trademark before establishing a company.

I mean, if you want to register for selling clothes (clothing,) are you supposed to have a single line for t-shirts, another line for tank tops, another line for sweat shirts and so on? or just file for clothing, specifying that you are including tshirts, sweatshirts, tank tops, etc.?
If I have not actually sold anything yet but I do have a sample piece is that something that will qualify for a specimen or using it in commerce although I have not sold anything

service mark applys to people selling services but they still call it a trademark in someways its just a different type of trademark .if your selling products then thats a different ball game
Using an example other than "mark" would have been nice. A bit confusing. Making up a company name and stating where this could be problematic within the process would have been more helpful. For example a name that has similarites to existing trademarks and how to differenciate throughout the form.
mitonryu THE LINGUIST hi, nope a business card is not considered a specimen. If you go to the uspto website and click on the trademark basics section, you will see a search bar and you can just type specimen in it. A link to the trademark book will open up. I believe in page 21 it talks about what is acceptable and not acceptable. Hope this helps 😊
a business card is a specimen go read the uspto faq database it tells you you can use a business card if your trademark is a service mark you see there is a difference between trademark and service mark i already filed my trademark and it has been accepted so sorry to burst your bubble but the business card is considered a specimen its on their faq sheet
also they say the trademark symbol or word etc.must be visible on the business card and connected with the goods or services your selling in order for a card to be a specimen.so the point is they do accept business cards but its on certain conditions the uspto has a huge faq database there is a ton of loopholes i discovered this one myself

The mark needs to be shown on the actual good. And yes, if you are requiring a service mark: then a card is fine to use. The video is based upon a good, not a service and so I assumed you needed the advice for a trademark on goods. With that being said, I was polite enough to point you to the website and exact page for reference. So I guess, again, I'm trying to figure out whose bubble your burst as I wasn't incorrect in my answer and again was polite enough to try and help you.
